3.1.1 The Subject Of The Order Is The Establishment And Equipment Of The Senior Club + The Scope Of Work Includes: 1) Reconstruction And Partial Change Of Use Of Mgokis For The Needs Of The Senior Club 2) Reconstruction Of Sanitary Facilities In Order To Adapt Them To Current Technical Regulations (Enlargement Of Door Openings, Construction Of Necessary Partition Walls, Installation Of Standard Door Leaves). 3) Reconstruction Of The Toilet For Disabled People. 4) Reconstruction Of The Window Opening On The Western Façade, Including The Construction Of A Steel Lintel, Disassembly/Installation Of Joinery. 5) Construction Of Partition Walls, Replacement Of Internal Door Joinery. 6) Replacement Of Existing Floors (Ceramic Tiles) With Pvc Flooring And Performance Of Necessary Works To Prepare The Ground For The Replacement In Question.7) Laying New Paint Coatings, Filling Defects And Plasters Created As Part Of The Work Carried Out.8) The Subject Of The Order Should Be Carried Out In Accordance With The Design Documentation Prepared By Architektoniczna Pracownia Autorska Grażyna Krzypkowska - Architect, Ul. Poprzeczna 3, 98-330 Pajeczno, Together With Technical Specifications For The Execution And Acceptance Of Works And The Principles Of Technical Knowledge.3.1. A Detailed Description Of The Subject Of The Order Is Included In Chapter V Of The Swz, Which Consists Of: - Construction Designs, - Detailed Technical Specification For The Execution And Acceptance Of Works (Construction Industry, Sanitary Industry And Electrical Industry); - Bills Of Quantities (Construction Industry, Sanitary Industry And Electrical Industry); Note: The Ordering Party Is At The Stage Of Obtaining A Replacement Permit For Decision No. 423/2019 Of August 29, 2019. Note: The Bills Of Quantities Have Been Attached For Informational Purposes, They Do Not Constitute The Basis For Calculating The Price By The Contractor. Before Starting The Works, The Contractor Is Obliged To: - Mark The Construction Site (Information And Warning Boards), - Notify The Owners Of Neighboring Plots And Any Persons Staying On Neighboring Plots About The Works Being Carried Out, Supplementary Works Required By The Ordering Party: 1) Performing Full Surveying Services For The Investment, 2) Preparation Of Acceptance Documentation In Two Copies In Polish, Divided Into Industries (Bound In Binders With A Detailed Table Of Contents), Containing At Least: A) An Occupancy Permit Or Application For Use To Pinb Accepted Without Objection, B) Original/Photocopy Of The Construction Log, C ) As-Built Geodetic Maps With Stamps Confirming Contribution To The Geodetic Resource By The Center For Cartographic And Geodetic Documentation, D) The Original Written Declaration Of The Construction Manager: - On The Execution Of Works In Accordance With The Construction Design, The Final Decision Of The Building Permit And The Construction Law, - On Ensuring Proper The Condition And Order Of The Construction Site, As Well As Roads, Streets, Neighboring Properties, Buildings And/Or Premises, - Appropriate Development Of The Areas Adjacent To The Construction Site To Enable Proper Operation Of The Constructed Facility. E) A List Of The Built-In Materials Along With Documents Confirming Their Approval For Use In The Republic Of Poland, F) The Original/Copy Of The As-Built Construction Design - Signed By The Construction Manager/Works Managers, G) A List Of Significant Changes (If Any) With A Graphic Attachment, Signed By The Construction Manager, Works Manager Appropriate To The Characteristics Of The Industry Affected By The Change, Supervision Inspector, Designer, Along With Documents Confirming The Correct Legalization Of These Changes, H) Reports On Tests Performed During The Implementation Of Construction Works, I) Electronic Version (In The Amount Consistent With Paper Version) Acceptance Documents And As-Built Documentation (Inventory In Pdf Format) On A Cd/Dvd, J) Instructions For The Use And Operation Of The Facility Along With A List Of Built-In Devices That Require Service Inspections, K) All Operating Instructions And Operation And Maintenance Manuals Of The Devices ( In Polish), Along With Confirmation Of Training In The Use Of These Devices.3.2. The Ordering Party Does Not Divide The Order Into Parts: 4. The Ordering Party Does Not Divide The Order Into Parts. Therefore, The Ordering Party Does Not Allow The Possibility Of Submitting Partial Offers Referred To In Art. 7 Point 15 Of The Public Procurement Law. Each Contractor Has The Right To Submit Only One Offer. A Situation In Which The Same Entity Appears In Two Or More Offers Submitted Jointly Or Is An Independent Contractor And At The Same Time Participates In A Joint Offer Will Be Considered Equivalent To The Submission Of More Than One Offer By The Same Contractor. Separating Part Of The Order Given The Small Scope Of The Entire Order And The Short Order Execution Time Would Require The Ordering Party To Coordinate The Works Of Several Contractors And May Pose A Risk Of Untimely Completion Of The Works. The Order In Question Is An Order With A Real Scope To Be Performed By An Sme, And Even By A Micro-Entrepreneur, As Referred To In Art. 7 Sec. 1 Point 1) Act Of March 6, 2018 Entrepreneurs Law. To Sum Up, In The Proceedings In Question, Dividing The Contract Into Parts Would Not Bring Any Benefits To The Ordering Party Or The Contractors, And Due To The Scope And Value Of The Contract, It Would Not Lead To Opening The Procedure To Competition. Only The Completion Of The Order In Its Entirety Will Allow For The Assessment Of Its Correctness. In The Opinion Of The Contracting Authority, The Subject Of The Contract Justifies Awarding The Contract To One Contractor Who Will Assume Responsibility For The Risk And Any Failures, And Dividing The Contract Into Parts Could Transfer This Risk To The Contracting Authority And, Consequently, Make It Impossible To Achieve The Objective Of The Public Procurement. Implementation Of The Contract By Several Contractors Also Makes It Difficult To Exercise The Rights Under The Warranty And Quality Guarantee.5. For Organizational And Logistical Reasons, The Order Should Be Performed By One Contractor. The Lack Of Division Into Parts Does Not Limit The Participation Of Companies From The Sector Of Small And Medium-Sized Enterprises, And Does Not Affect The Change Of The Group Of Contractors Who May Apply For A Contract
