The Subject Of The Order Is The Execution Of: Construction Works Consisting In The Construction Of Partition Walls And Plasterboard Structures And Painting The Surfaces Of The Rooms Of The Gallery Of Variable Exhibitions In The National Museum In Warsaw. All Works Covered By The Subject Of The Contract Should Be Performed In Accordance With Modern Technical Knowledge, Applicable Regulations, Construction Law, Standards And Construction Practice. The Materials Used Should Be Approved For Marketing And Use In Construction.• Installation Of Led Lighting In Showcases;• Delivery Of Lampshades And Glass Panes, Their Installation In Accordance With The Design;• Delivery Of Metal Trusses And Their Assembly In Accordance With The Design. When Submitting The Offer, The Contractor Will Use The Bill Of Quantities Form - Annex No. 6 To The Swz. 5. The Cost Of The Project Does Not Include The Following Elements Included In The Project: - A Suspended Ceiling Made Of Barrisol In The First Room - Making Mdf Elements (Pedestals And Free-Standing Display Cases) - Installing Stabilized Plants In Rooms 1-4 - A Wall Located On The Platform In Front Of The Exhibition Halls Za.01 - The Cost Of Paints For Painting The Walls (Provided By The Ordering Party).6. The Contractor Will Be Obliged To Have Liability Insurance For His Business Activity For The Entire Duration Of The Order, For An Amount Not Less Than Pln 400,000.00.7. The Contractor Will Provide A Guarantee And Warranty For The Works Performed As Part Of The Subject Of The Order For A Period Of 5 Months, Counting From The Date Of Signing The Final Acceptance Report In Relation To The Completed Order. Detailed Terms Of The Guarantee And Warranty Are Specified In The Contract Template Constituting Annex No. 4 To The Swz.8. On-Site Visit. The Ordering Party Does Not Require The Contractor To Carry Out An On-Site Visit, However, Due To The Specific Nature Of The Order, It Recommends Carrying Out An On-Site Visit.9. Subcontracting. The Ordering Party Does Not Reserve The Obligation To Directly Perform The Subject Of The Order By The Contractor. If The Contractor Uses Subcontractors To Perform The Subject Of The Contract, He Is Obliged To Indicate In The Offer The Part Of The Order That He Will Entrust To Them For Execution And Provide Their Companies If Known On The Date Of Submission Of The Offer.10. All Works Covered By The Subject Of The Contract Should Be Performed In Accordance With Modern Technical Knowledge, Applicable Regulations, Construction Law, Standards And Construction Practice. The Materials Used Should Be Approved For Marketing And Use In Construction.11. If, When Describing The Subject Of The Contract, The Ordering Party Refers To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 2 And Section 3 Of The Public Procurement Law, Solutions Equivalent To Those Described Are Allowed. 12. If The Description Of The Subject Of The Order Includes Indications Of Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes Products Or Services Provided By A Specific Manufacturer, It Should Be Understood In Accordance With The Provisions Of Art. 99 Section 5 Of The Act, That It Is Justified By The Specificity Of The Subject Of The Contract And The Ordering Party Cannot Describe The Subject Of The Contract In A Sufficiently Precise And Understandable Way, And These Indications Should Be Treated As Examples In Terms Of Technical And Functional Parameters. In Such Circumstances, The Ordering Party Allows The Possibility Of Submitting Equivalent Solutions In The Offer, Pointing Out That The Minimum Requirements To Be Met By Equivalent Solutions Are Requirements Not Worse Than The Parameters Indicated In The Technical Specification For The Execution And Acceptance Of Works.13. A Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate That The Supplies Or Services Or Construction Works Offered By Him, Including Solutions/Materials, Meet The Requirements Specified By The Ordering Party. The Ordering Party Will Assess The Equivalence Of The Materials Used On The Basis Of Documents (Technical And Operational Documentation, Material Card, Etc.) Issued Or Published By The Manufacturer Of A Given Material. In Such A Situation, The Contractor Will Be Obliged To Submit To The Employer Relevant Documents Stating That The Proposed Equivalent Materials Are Not Worse Than The Materials Specified In The Design, And To Obtain The Employers Consent For Their Introduction.
