1. The Subject Of The Contract Is Reconstruction Of The Municipal Road At Ul. Plenerowa In The Town Of Tuchomie. The Scope Includes The Reconstruction Of A Municipal Road To A Surface Made Of Concrete Cubes On A Section Of Approx. 360 Meters With Exits And A Pavement Along With The Accompanying Infrastructure. The Detailed Scope Of The Works Is Described In The Construction Design (Appendix To Swz No. 4), Technical Specifications For The Execution And Acceptance Of Construction Works (Appendix To Swz No. 5), Bill Of Quantities (Appendix To Swz No. 6) With The Proviso That The Employer Allows Solutions Equivalent To Those Described In The Above-Mentioned Design Documentation. The Contractor Is Obliged To Mark Out The Main Points By An Authorized Surveyor And Is Responsible For Protecting The Marked Out Measurement Points Until The Final Acceptance Of The Works - If Applicable. Damaged Or Destroyed Geodetic Marks Will Be Restored And Recorded By The Contractor At His Own Expense - If Applicable. Prior To Commencing The Works, The Contractor Shall Also Notify Interested Institutions And Owners Of Underground Utilities About The Commencement Of Construction (If Applicable). In The Case Of Carrying Out Earthworks In The Very Close Vicinity Of Buildings, Special Care Should Be Taken And The Provisions Of The Construction Law Must Be Strictly Observed. The Contractor Undertakes To Perform The Subject Of The Contract In Accordance With The Documentation, Principles Of Technical Knowledge And Construction Art, Applicable Regulations And Polish Standards, Under The Conditions Specified In The Contract And The Swz. The Devices And Materials Adopted In The Documentation And Technical Specifications, Bills Of Quantities, Guarantee The Achievement Of The Assumed Effect. If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Documentation Describing The Subject Of The Contract, The Employer Allows Solutions Equivalent To Those Described. When Analyzing The Design Documentation, The Contractor Should Assume That Each Reference Used In The Design Documentation Is Accompanied By The Word Or Equivalent. If The Documentation Describing The Subject Of The Contract Contains Trademarks, Patents Or The Origin Of Products/Source/Specific Process That Could Characterize Products Or Services Provided By A Specific Contractor, This Means That They Are Given As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard.The Contractor May Use Materials Or Devices Equivalent, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Affect Proper Functioning Of The Solutions Adopted In The Design Documentation The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Devices And Materials Used By Him Meet The Requirements Specified By The Employer. According To Art. 101 Sec. 4 Of The Public Procurement Law, The Contractor Using Equivalent Materials Undertakes To Use Materials With Parameters Not Worse Than Those Specified In The Documentation. If The Contracting Authority Allows Solutions Equivalent To Those Described In The Documentation, But Does Not Specify The Minimum Parameters That Would Confirm This Equivalence, The Contractor Is Obliged To Offer A Product Similar, Functionally Suitable For The Required Application. The Contracting Authority May Not Reject A Tender Only Because The Offered Construction Works Or Supplies Do Not Comply With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Of The Contract Refers, Provided That The Contractor Proves In The Tender That The Proposed Solutions Meet The Requirements Set Out In The Description Of The Subject Of The Contract To An Equivalent Degree. The Contractor Who Refers To Equivalent Solutions Is Obliged To Prove That The Solution He Offers Meets The Requirements Specified By The Employer. In Such A Case, The Contractor Shall Attach To The Offer A List Of Equivalent Solutions Together With Its Description Or Standards (If Applicable). The Use Of A Label In The Documentation Describing The Subject Of The Contract Means That The Employer Accepts All Labels Confirming That The Given Works, Supplies Or Services Meet Equivalent Requirements Specified By Contracting Label. If The Economic Operator, For Reasons Beyond Its Control, Cannot Obtain The Label Or Equivalent Label Specified By The Contracting Authority, The Contracting Authority, Within The Time Limit Set By It, Accepts Other Relevant Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Given Economic Operator Proves That The Construction Works , Supplies Or Services To Be Performed By It Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party (If Applicable). If The Description Of The Subject Of The Contract Includes A Record Resulting From The Knr Or Knnr Indicating The Need To Use Specific Equipment With Specific Parameters In The Performance Of The Order, The Employer Allows The Use Of Other Equipment, Provided That It Ensures The Achievement Of The Assumed Design Parameters And Does Not Cause The Risk Of Non-Compliance Of The Performed Works With The Technical Documentation (If Applicable ). All Used Elements Are To Be Brand New, Admitted To Trading And Have All Certificates Of Admission To Use. In Addition, The Elements Used Should Meet The Safety Standards Set By Law. Description Of The Subject Of The Contract, Design Documentation Includes The Requirements Of Art. 100 Of The Public Procurement Law. The Tuchomie Commune Intends To Implement The Investment Under The Government Road Development Fund 2023.
