1. The Subject Of The Contract Are Construction Works Entitled: Adaptation/Modernization Of The Building At Ul. Rydygiera 23 In Piła For The Project Entitled Poviat Community Mental Health Center For Children And Youth In Piła As Part Of The Wielkopolska Regional Operational Program For 2014-2020 - Additional Adaptation Works, Part 2.2. The Order Is Implemented As Part Of The Project Poviat Community Mental Health Center For Children And Youth In Piła Submitted To The Wrop For 2014-2020 Co-Financed By The European Social Fund Under Sub-Measure 7.2.2. Social And Health Services - Competition, Non-Competition And Extraordinary Projects.3. The Subject Of The Contract Is Construction Works Consisting In: 1) Knocking Out Door Openings (Moving); 2) Disassembly Of Old Doors And Disposal After Demolition; 3) Building Partition Walls; 4) Assembly Of Doors With Frames; 5) Assembly Of Aluminum Doors With A Combination Lock; 6 ) Photo Wallpapers For Corridors And Rooms; 7) Execution Of A Water And Sewage System With Openings Through The Ceilings To Be Included In The Installation In The Basement; 8) Execution Of Ventilation For Offices; 9) Transfer Of Part Social Room To Room 2.02; 10) Assembly Of Three Washbasins; 11) Electrical Installation (Including Lighting); 12) Replacement Of Damaged Carpeting; 13) Execution Of Tiles On The Walls At The Washbasins; 14) Painting And Patching Walls And Ceilings.3.4. The Subject Of The Order Is Described In Detail In Appendix No. 4 To Swz.5. The Employer Requires That The Contractor, In Order To Supervise The Execution Of Works, Have A Construction Manager With Unlimited Building Qualifications In The Construction And Building Specialty. The Contractor Shall Provide The Employer With The Site Managers Details Immediately Before Concluding The Contract.6. Guarantee And Warranty Period For The Performed Construction Works - Minimum 12 Months (The Guarantee And Warranty Period Is The Criterion For Evaluating Tenders In Accordance With Point 16 Of The Swz).7. Building Materials Necessary For The Performance Of The Contract Must Meet The Quality Requirements Of Products Admitted To Trading And Use In The Construction Industry And Must Have Valid Certificates Or Declarations Of Compliance With The Technical Approval.8. If The Documents Describing The Subject Of The Order Contain The Names Of Manufacturers Of Materials Or Any Other Products Or Products, They Are Used Only And Exclusively To Determine The Desired Standard Of Performance And To Determine The Characteristics Of The Technical And Functional Requirements Assumed In The Technical Documentation For A Given Type Of Solution, They Are Not Binding And Should Be Treated As Designers Suggestions. They Are Not Binding For The Future Contractor To Use Them. The Contractor May Use Equivalent Materials With Technical And Operational Parameters Corresponding At Least To The Parameters Of The Materials Proposed In The Design Documentation. In Relation To Equivalent Materials, The Contractor Is Obliged To Have Documents Confirming The Permission For Use / Incorporation (Certificates Or Declarations Of Performance). Equivalent Materials Are Allowed, Provided That: 1) They Guarantee The Performance Of The Order In Accordance With The Quality, Technological And Operational Assumptions Contained In The Design Documentation And Swz, 2) Ensure The Achievement Of Technical, Technological And Quality Parameters At Least Equal To The Parameters Assumed In The Design Documentation And Swz, The Contractor Will Be Obliged To Prove To The Ordering Party That The Materials Intended For Incorporation Are Equivalent To Those Proposed In The Design. If The Materials Do Not Confirm The Equivalence, The Contractor Will Not Be Entitled To Use Them And Will Replace Them At His Own Expense With Materials That Meet The Conditions Of Equivalence.9. Due To The Fact That The Contract Will Be Performed In A Functioning Building, The Employer Has The Following Requirements For The Implementation Of Works: 1) Works, Including The Replacement Of Doors, In Rooms 1.03-1.06 And 1.13-1.14 Should Be Performed In Consultation With The Managers Of The Poviat Environmental Health Center For Children And Teenagers,2) The Area Should Be Properly Secured,3) All Materials, Devices And Equipment Should Be Secured Against Unauthorized Access,4) The Area Should Be Tidied Up Every Day After The Work Is Completed.10. The Contractor Takes Full Responsibility For Any Infringements Of The Law And Damages That May Occur In Connection With The Performance Of The Contract.11. The Use Of Materials Without Acknowledgment Of Origin Is Unacceptable. In The Event Of Installation Of Material That Does Not Comply With The Above-Mentioned Requirements, The Contractor Will Be Obliged To Dismantle Them, And The Refusal To Perform Such Activities Will Result In Absolute Disassembly At The Expense Of The Contractor And With The Resulting Consequences.12. The Contractor Is Obliged To Have Documents Confirming The Permission For Use / Incorporation In Relation To The Materials And Devices Used. The Documents May Be Certificates Or Test Reports, Ce Declarations Of Conformity Or Declarations Of Performance.13. The Contractor Shall Secure The Materials And Devices Temporarily Stored At The Construction Site - Until They Are Installed, Against Destruction, Damage, Theft Or Loss Of Quality, Properties Or Parameters, And Shall Make Them Available For Inspection By The Employers Representative. 14. The Contractor, As A Waste Producer, Is Responsible For The Recovery Or Disposal Of Any Waste Generated During The Execution Of The Works Constituting The Subject Of The Contract And For Indicating The Place And Process Of The Recovery Or Disposal Of This Waste.15. The Contracting Authority Specifies The Requirements Referred To In Art. 95 Of The Public Procurement Law. The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing The Following Activities In The Scope Of Contract Performance: - Sanitary And Electrical Installation Works; - General Construction Works (E.G. Plastering, Painting, Tiling). Of These Persons And The Employers Rights To Control The Contractors Compliance With The Above Requirements And The Sanctions For Failure To Meet These Requirements Are Set Out In Appendix 3 To The Tor - Draft Provisions Of The Public Procurement Contract, Which Will Be Included In The Content Of This Contract.16. The Employer Provides For The Possibility Of A Site Visit By Contractors. Participation Of Contractors In The Site Visit Is Not Obligatory, Failure To Carry Out The Site Visit Will Not Result In The Rejection Of The Offer Pursuant To Art. 226 Sec. 1 Point 18 Of The Public Procurement Law.
