The Subject Of The Order Is The Delivery And Assembly Of A Complete, Multimedia Portable Shooting School And Training System, Necessary For The Implementation Of The Project Entitled Shooting Range In The District 2023. 2. The Detailed Scope Of Deliveries Is Specified In Appendix No. 6 To The Tor, Description Of The Subject Of The Contract. 3. Wherever The Origin (Brand, Trademark, Manufacturer, Supplier, Etc.) Of Materials Or Standards, Approvals, Specifications And Systems Referred To In The Public Procurement Law Act (Hereinafter Referred To As The Act) Is Indicated, The Ordering Party Allows Offering Equipment Or Equivalent Solutions, Provided That They Ensure The Achievement Of Technical Parameters That Are The Same Or Better Than Those Required By The Ordering Party In The Order Documentation. The Ordering Party Informs That In Such A Situation The Provisions In Question Are Only Exemplary And Constitute An Indication For The Contractor What Characteristics The Components Used To Perform The Subject Of The Order Should Have. The Ordering Party Allows Offering Equivalent Materials Or Devices. Materials Or Devices From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Characteristics, As Well As Qualitative (E.G. Dimensions, Composition, Material Used, Color, Shade, Intended Use Of Materials And Devices, Aesthetics, Etc.) That Materials Or Devices Must Meet Offered By The Contractor To Meet The Requirements Set By The Employer. The Use Of Exemplary Names Of The Manufacturer Is Only To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. The Use Of Names Of Manufacturers/Products Is For Illustrative Purposes Only. The Ordering Party, Indicating The Designation Of A Specific Manufacturer (Supplier), A Specific Product Or Materials In The Description Of The Subject Of The Contract, At The Same Time Allows Equivalent Products With Quality Parameters And Functional Characteristics At Least At The Level Of The Parameters Of The Indicated Product, Thus Recognizing Each Product With The Indicated Or Better Parameters.4. The Burden Of Proving The Equivalence Of The Offered Item Rests With The Contractor (Pursuant To Article 101(5) Of The Act). The Contractor Must Prove In The Offer, In Particular By Means Of Evidence Referred To In Art. 104-107 Of The Act That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract To An Equivalent Degree. In The Event Of Doubts Regarding The Equivalence Of The Offered Products, The Ordering Party Shall Call On The Contractor To Submit Explanations Regarding The Content Of The Offer Within The Specified Period.
