The Subject Of The Contract Is A Comprehensive Supply Of Gaseous Fuel In The Form Of High-Methane Natural Gas With The Symbol E, To 4 Gas Consumption Points, For The Needs Of Facilities Owned By The Rzesz w Regional Development Agency S.A. Located On The Premises Of Ppn-T Aeropolis In Jasionka. The Projected Demand For Gaseous Fuel During The Term Of The Agreement Is: 2,561,010 Kwh. The Projected Consumption Is Used Only To Compare Offers And In No Case Does It Constitute An Obligation On The Part Of The Ordering Party To Purchase Gas In The Given Amount. The Contractor Shall Not Be Entitled To Any Claim For Failure To Collect The Expected Amount Of Gaseous Fuel By The Employer During The Term Of The Contract. The Ordering Party Reserves The Right To Reduce Or Increase The Volume Of Deliveries. Settlement Of Liabilities Arising From The Sale And Distribution Of Gaseous Fuel Will Be Based On The Actual Indications Of The Metering And Billing Systems. Natural Gas Will Be Supplied Under The Conditions Specified In The Provisions Of The Act Of 10 April 1997 Energy Law (I.E. Journal Of Laws Of 2022, Item 1385, As Amended) Along With All Its Relevant Executive Acts, Hereinafter Referred To As The Energy Law , The Provisions Of The Act Of April 23, 1964. Civil Code (I.E. Journal Of Laws 2022, Item 1360, As Amended), Hereinafter Referred To As The Civil Code, The Rules Set Out In Concessions, The Provisions Of The Contract And Based On The Public Procurement Law . For The Duration Of The Contract, The Contractor Must Have (A+B Jointly): A) A Valid License To Conduct Business Activity In The Field Of Trading In Gaseous Fuels (Valid For The Entire Duration Of The Contract), Issued By The President Of The Energy Regulatory Office, In Accordance With The Act Of April 10 1997 Energy Law. B) A Valid Concession For The Distribution Of Gaseous Fuels Issued By The President Of The Energy Regulatory Office Or (If The Contractor Is Not The Owner Of The Network In The Area Where The Natural Gas Supply Point Is Located) A Valid Agreement With The Distribution System Operator For The Provision Of The Service Distribution Of Natural Gas Or A Promise Of Such An Agreement In The Area Where The Ordering Partys Consumption Points Are Located, Enabling The Execution Of Deliveries To The Collection Points Described In Appendix No. 1 To The Tor. The Ordering Party Reserves The Right To Request The Contractor (At Each Stage Of The Contract) To Submit Documents Or Statements Confirming The Right To Perform The Subject Of The Contract. The Contractor Undertakes That For The Duration Of The Contract He Will Have A Third Party Liability Insurance Covering The Subject Of The Contract In The Amount Of At Least Pln 500,000.00 (In Words: Five Hundred Thousand Zlotys).
