The Ordering Party Plans To Carry Out This Order Under The Program For The Development Of Childcare Institutions For Children Up To The Age Of 3 Maluch + 2022-2029. The Toddler+ 2022-2029 Program Is Financed With Funds From The National Recovery And Resilience Plan (Kpo) And The European Funds For Social Development (Fers) Program Financed From The European Social Fund Plus Under The 2021-2027 Financial Perspective, As Well As State Budget Funds. A Detailed Description Of The Subject Of The Contract, Specifying The Minimum Parameters Required By The Ordering Party, Is Included In Appendix No. 6 To The Tor. Implementation Conditions: The Subject Of The Order Should Be Delivered Directly To The Places And Within The Time Limit Indicated By The Ordering Party: 1) In Quantities And Assortment Consistent With The Description Of The Subject Of The Order, Bring It To The Indicated Room. The Subject Of The Contract Shall Be Delivered By The Contractor With Its Own Means Of Transport, At Its Own Expense And Risk. The Contractor Shall Be Liable For Any Damage Caused During Transport; 2) The Delivered Assortment Should Be Brand New, Unused, Complete, Free From Defects, Including Legal Defects, Equipped With The Necessary Accessories, Did Not Require Any Additional Expenditure And Was Ready For Operation / Use And Cover All The Requirements Indicated In The Swz And The Annexes In The Full Scope Specified;3) The Offered Assortment Must Have All The Attestations, Tests And Ce Certificates Required By Law For Which It Is Required. The Assortment Must Be Brand New Without Traces Of Use, It Cannot Be Post-Leasing And Post-Exhibition. 4) All Requirements Regarding The Subject Of The Contract Indicated In The Tor And Attachments Should Be Treated As Minimum; 5) The Contractor Shall Ensure That The Delivered Assortment Meets The Requirements Of Applicable Law, In Particular In Terms Of The Required Attestations, Technical Opinions And Approvals For Use In Poland, If Required; Nursery. The Documents Referred To In The Previous Sentence Will Be Submitted For Inspection At The Contracting Authoritys Request. 8) The Return Of Goods That Are Not Suitable For Use And Delivery Of Replacement Goods, Free From Defects And Faults, Will Be At The Expense Of The Contractor. The Part Of The Subject Of The Contract Not Accepted During The Final Acceptance Will Be Replaced By The Contractor With A New One Of The Same Parameters And Type Within The Time Limit Indicated By The Ordering Party, At His Own Cost. Minimum Guarantee Conditions: 1) The Guarantee And Warranty Period Required By The Ordering Party Is Min. 24 Months (Concerning Parts I, Ii, Iii, Iv, V) From The Date Of Final Acceptance, Unless The Description Of The Subject Of The Order Indicates Otherwise (Then The Period Is Longer); The Warranty And Warranty Period Begins Simultaneously For The Entire Delivery And From The Date Of Effective Acceptance Confirmed By The Protocol. 2) The Warranty And Warranty Granted Cover All Elements Of The Delivered Assortment. Defects. 4) If The Repair Period Of The Assortment Will Be Longer Than 2 Weeks, An Efficient Replacement Assortment With Parameters Not Worse Than The Replaced Assortment Should Be Delivered For This Time. 5) The Minimum Provisions Indicated Above Must Be Included In The Warranty Card (Annex To The Contract Template), 6) Other Requirements: 1) Free Delivery, Bringing In, Placing In The Place Indicated By The Ordering Party, 7) And Putting Into Operation; 2) User Manual In English. In Polish In The Printed/Electronic Version (If Applicable); 8) The Warranty Card Provided By The Contractor May Not Impose Additional Financial And Material Obligations On The Ordering Party, Which Would Make The Entitlement To The Guarantee Granted Conditional.
