The Subject Of The Contract Is The Replacement Of The Ventilation System For The Kitchen And Kitchen Areas In Building No. 5 In The Military Complex At Ul. Jagiełły 11-23 In Grudziądz, In Accordance With The Requirements Set Out In The Contract And The Detailed Description Of The Subject Of The Contract And Its Scope Contained In The Technical Specification For The Execution And Acceptance Of Works (Stwiorb) And The Design Documentation Including The Bill Of Quantities. ► The Contractor Is Obliged To Prepare A Works Schedule Before Commencing The Implementation Of Works - In Consultation With The Supervisory Inspector Indicated In The Contract. In The Schedule Of Works, The Contractor Will Specify In Particular The Dates And Scope Of Works Subject To Partial Acceptances. The Contractor Shall Submit The Schedule To The Employer In Four Identical Copies At The Latest On The Day Of Handing Over The Work Site. ►Scope Of The Contract: Disassembly Of Existing Ventilation Devices, Disassembly Of Existing Ventilation Ducts, Preparation Of Openings In The Walls For Ventilation Ducts, Assembly Of Structures For Ventilation Devices, Installation Of A New Ventilation Installation With Devices. Construction Site Facilities, Marking And Securing Installations And Devices On The Site Of Works. The Above Is Implemented By The Contractor With His Own Efforts And At The Price Of The Contract. ►The Facility In The Scope Of Which The Works Will Be Performed Will Be Open For The Duration Of Their Performance, Excluding The Part Of The Building Where The Works Will Be Performed. All Construction Works Should Be Organized And Carried Out In Such A Way As To Ensure Safety For People Staying In The Complex, Building And Uninterrupted Use Of The Building. ►The Contractor Is Obliged To: 1) Ensure The Safety Of Employees Performing Works (In Particular, To Train Employees And Equip Them With The Necessary Equipment); 2) Protect The Building Against Destruction And Other Damage; 3) Execution Of Works In The Area Where Works Are Performed In A Way That Is Not Inconvenient For The Users Of The Military Complex; 4) Enabling Employees, Soldiers And Clients Of A Given Military Unit To Use The Building And The Complex In A Safe And Undisturbed Manner During The Execution Of Works; 5) Provide, On Their Own And At Their Own Expense, The Persons Performing The Subject Of The Contract With Appropriate Occupational Health And Safety Conditions, Protective Clothing And Accessories In Accordance With Applicable Regulations, As Well As Equipment, Means (Including Personal Protective Equipment And Disinfectants) And Devices Necessary To Perform The Activities Covered By The Contract. In The Event Of Failure To Provide The Conditions As Above, The Contractor Shall Be Liable For Damages And Situations Arising As A Result Of His Actions Or Omissions. ►The Contractor Provides All Materials And Equipment Necessary To Perform The Subject Of The Contract On Its Own And At Its Own Expense, And Is Obliged To Use Construction Products In Accordance With The Technical Specification For The Execution And Acceptance Of Works And Approved For Use By The Act Of 07 July 1994 Construction Law (Journal Of Laws Of 2023, Item 682, Consolidated Text), With Valid Attestations And Certificates Allowing For Their Use. Elements Of The Order Or Adversely Affect The Strength, Functionality, Aesthetics And Safety Of Use And Use Of The Site Of Works And Its Boundaries. If A Trademark, Patent, Origin Is Indicated In The Description Of The Subject Of The Order - It Should Be Assumed That The Indicated Trademarks, Patents, Origin Determine Technical, Operational And Utility Parameters, Which Means That The Ordering Party Allows Solutions Equivalent To Those Described (Legal Basis Art. 99 Of The Act), Provided That The Offered Equivalent Products Will Be Used To Achieve The Final Effect Assigned To Them. The Contractor Who Refers To Solutions Equivalent To Those Described By The Ordering Party Is Obliged To Demonstrate (At The Stage Of Submitting The Offer) That The Materials Or Products Offered By Him To Perform The Subject Of The Contract Meet The Requirements Specified By The Ordering Party (Legal Basis Of Article 99 Of The Act) By Submitting A Technical Description And Providing The Name Of The Product And Manufacturer. If The Contractor Fails To Submit Information On The Use Of Equivalent Materials With The Offer, It Is Considered That The Price Calculation Includes The Materials Indicated In The Documentation. ► The Contractor Is Obliged To Perform Works In Accordance With The Construction Art And Building Standards, Applicable Regulations And Technical And Technological Standards, While Maintaining Applicable Health And Safety Regulations. ►The Contractor Is Obliged To Ensure The Collection And Disposal Of Waste (Garbage, Rubble, Etc.) On Its Own, In Accordance With Applicable Law, In Particular The Act On Waste (Article 3(1)(32) Of The Waste Act Of December 14, 2012, Journal Of Laws Of 2022, Item 699, As Amended) And To Document These Activities. The Contractor (Or His Subcontractor) Should Be Authorized To Obtain Permits Under The Waste Act And Meet The Requirements Of The Waste Act Of 14 December 2012 (Journal Of Laws 2022, Item 699, As Amended). If The Contractor Uses A Subcontractor In The Above Scope, He Should Indicate The Subcontractor Along With The Offer. If The Contractor Does Not Indicate Entrusting The Removal And Disposal To A Subcontractor, The Ordering Party Will Consider That The Contractor Will Perform The Scope In Question On Its Own And Has All The Powers In This Respect In Accordance With Applicable Law. ► The Contractor Is Obliged To Collect And Remove The Scrap Obtained During Construction Works. The Scrap Obtained From The Disassembly On An Ongoing Basis Should Be Immediately Weighed In The Presence Of The Supervision Inspector On The Side Of The Employer. Removal Of Scrap From The Construction Site Will Be Possible After A Written Notification And Approval Of The Document By The Supervision Inspector. ►After Each Removal And Weighing, A Quantitative Statement Of Scrap Obtained From Disassembly Will Be Prepared, Indicating The Type Criterion (Steel, Cast Iron, Copper, Brass, Aluminum Scrap). Each Time, Based On The Prepared Statement Obtained From The Dismantling Of Scrap Metal, The Employer Will Issue A Vat Invoice In Accordance With The Currently Applicable Provisions Of The Act And Thus Authorize The Contractor To Sell Or Use The Scrap Obtained From Dismantling. The Scrap Value Will Be Determined As Follows: Quantity Of Kg Of Steel Scrap X Pln 0.88/Kg (Average Wholesale Price In The Kujawsko-Pomorskie Voivodship); Quantity Of Cast Iron Scrap X Pln 1.28/Kg (Average Wholesale Price In The Kujawsko-Pomorskie Voivodship); Kg Of Copper Scrap X Pln 28.37/Kg (Average Wholesale Price In The Kuyavian-Pomeranian Voivodeship); Kg Of Brass Scrap X Pln 16.80/Kg (Average Wholesale Price In The Kujawsko-Pomorskie Voivodship); Kg Of Aluminum Scrap X Pln 5.63/Kg (Average Wholesale Price In The Kujawsko-Pomorskie Voivodship). Employment Contracts Of Persons Performing Construction Works Covered By The Scope Of The Subject Of The Contract - The Performance Of These Activities Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2022, Item 1510, Consolidated Text). The Contractor Or Subcontractor Is Obliged To Employ Persons Under An Employment Contract At Least For The Duration Of The Contract Concluded Between The Contractor And The Employer - Art. 95 Of The Public Procurement Law.
