1. The Subject Of The Contract Is A Comprehensive Supply Of Natural Gas To Public Utility Facilities In The Commune Of Wolb rz.2. The Description Of The Subject Of The Contract And The Terms Of The Contract Are Included In The List And Characteristics Of Collection Points Constituting Appendix No. 3 To This Swz And The Draft Agreement Constituting Appendix No. 6 To This Swz.3. Implementation Of The Subject Of The Contract Will Take Place In Accordance With The Provisions Of The Act Of April 10, 1997 - Energy Law (I.E. Journal Of Laws Of 2022, Item 1385, As Amended). And Executive Acts Issued On Its Basis. The Quality Of The Delivered Subject Of The Order Must Comply With The Polish Standard Pn-C-04750 Gaseous Fuels - Classification, Marking And Requirements. The Distribution System Operator Is Responsible For The Quality Of The Subject Of The Contract, In Accordance With The Regulation Of The Minister Of Economy Of July 2, 2010 - On Detailed Conditions For The Operation Of The Gas System (I.E. Journal Of Laws Of 2018, Item 1158, As Amended).4. The Contractor Undertakes To Sell Type E High-Methane Natural Gas And Ensures Its Continuous Distribution To The Employer Throughout The Term Of The Contract. The Contractor Is Obliged To Make All Actions And Arrangements With The Distribution System Operator Necessary To Carry Out The Supplier Switching Procedure And Conclude A Distribution Agreement On Behalf Of The Ordering Party. Ownership Of The Gaseous Fuel Is Transferred To The Ordering Party Within The Border Of The Ownership Of The Gas Network Of The Distribution System Operator Specified In The Conditions Of Connection To The Gas Network. As Part Of The Performance Of The Subject Of The Contract, The Settlements For The Consumption Of Gaseous Fuel Will Be Based On The Reading Of The Actual Reading Of The Measurement System.5. The Total Estimated Demand For Natural Gas In The Period From 01/01/2024 To 31/12/2024 For The Consumption Points Specified In Appendix No. 3 To The Swz Is 920311 Kwh (The Amounts Provided In This Specification Are Approximate And May Change).6. The Given Consumption Of Natural Gas During The Term Of The Contract Is An Estimate Used To Calculate The Price Of The Offer, Compare Offers And Select The Most Advantageous Offer. It Does Not Constitute An Obligation For The Ordering Party To Purchase Natural Gas In The Specified Quantity. The Actual Consumption Will Result From The Current Demand Of The Employer. The Contractor With Whom The Ordering Party Will Sign The Contract Shall Not Be Entitled To Any Claim For The Delivery Of Natural Gas In The Amount Entered In The List And Characteristics Of Consumption Points - (Appendix No. 3 To Swz).7. The Contractor Who Refers To Equivalent Solutions Is Obliged To Prove That The Solution He Offers Meets The Requirements Specified By The Contracting Authority. In This Case, The Contractor Shall Attach To The Offer A List Of Solutions Equivalent To Its Description Or Standards, Together With Evidence - In Order To Prove In Its Offer That The Proposed Solutions Meet The Requirements Specified By The Contracting Authority To An Equivalent Degree.
