1. The Subject Of The Order Is The Investment Task Entitled: Part I: Execution Of Pavement On A Fragment Of Ul. Trakcyjna, The Order Includes The Execution Of Construction Works In Accordance With The Design Documentation Constituting Appendix No. 8A To The Swz, The Bill Of Quantities Constituting Appendix No. 9A To The Swz And The Price List Constituting Appendix No. 10A To The Swz. The Construction Works Will Consist, Among Others, In The Execution Of: - Demolition Works - Execution Of Measurement Works, - Execution Of Earthworks, - Execution Of Resistors And Footings For Resistors, - Execution Of Pavement Made Of Concrete Cubes, - Execution Of Concrete Base For The Pavement, - Execution Of Profiling Of Roadsides, Exits And The Adjacent Area, - Execution Of Greenery, - Execution Of Height Adjustment Chambers For Underground Equipment And Manholes, Hydrants, Water And Gas Valves, Construction Of A Rainwater Inlet, - Execution Of Vertical Markings. Contained In Appendix No. 9A And Appendix No. 10A In The Part Entitled Remarks On The Valuation Of Works - Comments Refer To The Bill Of Quantities, Price List, Description Of The Subject Of The Contract. When Valuing And Performing Works, Decisions, Conditions, Arrangements, Opinions To The Developed Design Documentation Should Also Be Taken Into Account. The Fulfillment Of The Conditions Contained In The Above-Mentioned Documents And The Costs Associated With Them Should Be Included In The Offer Price. The Contractor Is Also Responsible For Obtaining An Occupancy Permit On Behalf Of The Ordering Party Or Making An Effective Notification Of The Completion Of The Works And The Intention To Commence Use (If Required Under Applicable Law). To Provide The Employer With A Price Calculation Price List - Prepared In Accordance With Appendix 10A To The Swz, Prepared On The Basis Of The Bills Of Quantities Included: • The Contractor Should Separately Evaluate Each Item In The Price List (Cw) (Appendix 10A To The Swz), Observing The Rules For Calculating The Value In Of Each Item And A Summary Of The Total Amounts Stated In The Cw. The Contractor Is Not Allowed To Change The Quantities Given In The Cw, • Cw Should Be Read Together With Other Contract Documents. It Is Assumed That The Contractor Has Carefully Read The Detailed Description Of The Works To Be Performed And The Manner Of Their Execution. All Works Should Be Performed In Accordance With The Intention And Purpose Of The Subject Of The Order, • The Quantities Given In Each Item Of The List Are Indicative Values, Indicating Only The Indicative Scope Of Works That Should Be Performed To Complete A Given Element (Work), For Which A Flat-Rate Remuneration And They Are Not Relevant When Settling The Value Of A Given Element (Work) After Its Completion, • Short Descriptions Of Items Presented In The Cw Are Provided For Identification Purposes Only And In No Way Modify Or Cancel Detailed Descriptions Contained In Technical Specifications And Designs. Note: 1. Wherever The Subject Of The Order Is Described By Indicating Trademarks, Patents Or Origin, The Ordering Party Allows The Contractor To Use Solutions Equivalent To Those Described In The Documentation, Provided That They Have At Least The Same Or Better Technical And Functional Parameters And Will Not Lower The Standards Specified In The Documentation.2. If The Contractor Proposes Materials And Other Equivalent Elements, He Is Obliged To Prepare And Attach To The Offer A List Of All Proposed Materials And Other Equivalent Elements And Demonstrate Their Equivalence To The Materials And Other Elements Described In The Documentation Constituting The Description Of The Subject Of The Contract, Stwior With An Indication Name, Page And Item Of The Bill Of Quantities To Which It Applies.3. All Equivalent Materials Or Other Elements Proposed By The Contractor Must: A. Have Technical And Functional Parameters Not Worse Than Those Specified In The Documentation, B. Have Appropriate Approvals And Certificates.4. The Description Of The Proposed Equivalent Solutions Should Be Attached To The Offer And Must Be Detailed Enough For The Ordering Party, When Evaluating The Offer, To Assess The Fulfillment Of The Requirements Regarding Their Technical Parameters And Decide Whether The Proposed Solutions Are Equivalent. This Means That The Contractor Is Obliged To Indicate That The Materials And Other Elements Offered By Him Are Equivalent To Those Described By The Ordering Party.5. In The Event That The Construction/Executive Design Does Not Directly Indicate The Scope Of Works, The Elements Contained In The Bill Of Quantities Of Works Should Be Used.2.
