1. The Subject Of The Contract Is The Performance Of The Task Entitled „„Expansion Of The Nursery In The Shelter For Homeless Animals At Ul. Przybyszewskiego 3 In Toruń. 2. The Subject Of The Contract Includes, In Particular, The Following Scope Of Works: 1) Reconstruction Of The Rooms On The First Floor: Demolition Works, Construction Of Partition Walls, Construction Of New Pvc And Stoneware Floors, Supplementing Plasters And Filling Walls And Ceilings With Painting, Painting Paneling On Walls, Lining Ceramic Tiles In Toilets And Treatment Rooms, Installation Of New Window And Door Joinery, Disassembly Of Window And Door Joinery, Water And Sewage Installations, Central Heating And Electrical Installation Of Led Lighting, Plug Sockets And Teletechnical Installation, 2) Replacement Of Wooden Windows On The Ground Floor, 3) Replacement Of Electrical And Teletechnical Installation And Execution Of Gravitational Ventilation In Rooms On The Ground Floor. 3. The Contractor Will Perform The Subject Of The Contract To The Extent And In The Manner Specified In The Design Documentation And Technical Specification For The Execution And Acceptance Of Construction Works (Studies Prepared By Piotr Bielecki, Running A Business Under The Name: X-Bud Piotr Bielecki; Components Of The Design Documentation And Technical Specification Execution And Acceptance Of Construction Works Listed In Appendix No. 1 To The Agreement) And In Accordance With Applicable Law, Standards, Construction Art, Based On The Inspection Of The Construction Site And In Accordance With The Administrative Decisions Held By The Employer. The Contractor Will Carry Out The Works In Accordance With The Standards For The Protection, Development And Maintenance Of Green Areas, Contained In Appendix No. 1 Entitled Protection Of Trees In The Investment Process To The Environmental Protection Program For The City Of Toruń For The Years 2021-2024, Taking Into Account The Perspective Until 2028, Constituting An Attachment To Resolution No. 699/2021 Of The Toruń City Council Of September 9, 2021 On The Adoption Of Environmental Protection Program For The City Of Toruń For The Years 2021-2024, Taking Into Account The Perspective Until 2028”. 4. A Detailed Description Of The Subject Of The Order Is Included In The Project Documentation And A Model Contract Attached To The Tor. 5. Equivalent Solutions1) Wherever The Subject Of The Contract Is Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process Or Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, The Contracting Authority Allows The Contractor To Offer Materials Or Solutions Equivalent To Those Described In The Documentation, Provided That They Do Not Lower The Standards Specified In The Documentation, Have The Required Appropriate Attestations, Certificates Or Approvals, And Ensure That The Contract Is Performed In Accordance With The Employers Expectations And Requirements Set Out In The Tor. Indication In The Technical Documentation Of Exemplary Trademarks Of Patents Or Origin, Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Is Intended To Clarify The Expectations Of The Ordering Party In Relation To The Subject Of The Order And Is Only A Quality Standard Of The Subject Of The Order. In Such A Situation, The Employer Requires The Contractor, Pursuant To Art. 101 Sec. 5 Of The Public Procurement Law, Submit Appropriate Documents To Authenticate The Use Of Equivalent Solutions. If The Contractor Fails To Submit Documents On The Use Of Other Equivalent Materials Or Devices Or Solutions In The Offer, It Is Understood That The Materials And Devices Proposed In The Technical Documentation Were Included In The Calculation Of The Offer Price And The Performance Of The Subject Of The Order; Therefore, The Contractor Is Obliged To Use The Materials Or Devices Or Solutions Proposed In The Technical Documentation To Perform The Order. 2) If The Contractor Proposes Equivalent Solutions, Including Materials, Devices And Other Elements, He Is Obliged To Prepare And Attach To The Offer A List Of All Proposed Equivalent Solutions (E.G. Materials, Devices And Other Equivalent Elements) And Demonstrate Their Equivalence To Solutions (E.G. Material, Device And Other Element) Described In The Technical Documentation, Indicating The Name, Page And Item In The Technical Documentation To Which It Applies. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Contracting Authority. In This Case, The Contractor Shall Attach To The Offer A List Of Equivalent Solutions Together With Its Description Or Standards. The Description Must Be Detailed Enough For The Ordering Party, When Evaluating The Tenders, To Assess Whether The Requirements Concerning Their Functional And Qualitative Properties And Parameters Have Been Met, And To Decide Whether The Proposed Solutions Are Equivalent. This Means That The Contractor Is Obliged To Demonstrate That The Solutions He Offers (E.G. Materials, Devices And Other Elements) Are Equivalent To Those Described By The Employer. All Trademarks, Patents Or Certificates Of Origin, Source Or Specific Process, As Well As Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Indicated In The Technical Documentation Should Be Treated Only As Examples, And The Ordering Party Allows The Use Of Equivalent Materials, Devices, I.E. Functional Parameters Not Worse Than Those Indicated By The Employer. All Parameters And Technical Requirements Of Sample Materials And Devices Provided For In The Tender Documentation Are Minimum Parameters, Unless Otherwise Stated.3) For All Trademarks, Patents Or Certificates Of Origin, Source Or Specific Process, As Well As Standards, European Technical Assessments, Approvals, Specifications And Technical Reference Systems Indicated In The Design Documentation, The Words Or Equivalent Are Added.
