The Scope Of Works Includes: - Measurement And Preparatory Works; - Demolition And Earthworks; - Execution Of Trenches For The Designed Pavement Structures; - Laying Of Resistors, Edges; - Execution Of Foundation Layers; ;- Finishing Works. The Detailed Scope Of The Order And The Terms Of Implementation Are Contained In The Design Documentation Prepared By Kampas Paweł Baran From Marek (Appendix No. 8 To The Swz): - Technical Design With A Geotechnical Opinion - Technical Specification For The Execution And Acceptance Of Construction Works.2. The Scope Of The Contract Includes All Works, Materials, Equipment And Services Necessary For The Comprehensive Performance Of The Contract And Handing Over The Facility For Use - Both Resulting Directly From The Design Documentation And Technical Specifications For The Execution And Acceptance Of Works, As Well As Not Included, E.G. Works, Preparatory And Cleaning Works, Waste Collection And Disposal, Development Of The Construction Site, Including: Construction Site Facilities, Fencing, Access And Assembly Roads As Well As Water And Electricity Supply, Supervision.3. Indication In The Description Of The Subject Of The Contract: Trademarks, Patents Or Origin, Is Not Intended To Violate Art. 16 And Art. 99 Sec. 4 Of The Public Procurement Law, And Serves Only The Most Accurate Presentation Of The Employers Quality And Technological Expectations. The Employer Allows Equivalent Solutions Provided That At Least The Same Technological And Performance Level Is Maintained. The Employer Allows Solutions Equivalent To Those Described In The Standards, Approvals, Technical Specifications And Reference Systems Referred To In Art. 99 Sec. 1-3 Of The Public Procurement Law. A Contractor Who Refers To Solutions Equivalent To Those Described By The Employer Is Obliged To Demonstrate That The Construction Works Offered By Him Meet The Requirements Specified By The Employer In Art. 99 Sec. 5 Of The Public Procurement Law. The Employer Allows Equivalent Solutions Described By Standards, Approvals, Technical Specifications And Reference Systems Referred To In Art. 101 Sec. 1-3 Of The Public Procurement Law. If The Contractor Does Not Attach A List Of Equivalent Solutions To The Offer, Then It Will Be Understood As Offering Materials Indicated In The Design Documentation. If The Contractor Submits Proposals For Equivalent Solutions, It Is The Contractors Responsibility To Prove That The Supplies, Services Or Construction Works Offered Comply With The Requirements Of The Ordering Party. If The Use Of An Equivalent Solution Requires Supplementing The Formal Side, Making Designs, Drawings, Etc., The Contractor Is Obliged To Complete These Activities And Include Them In The Price Of The Offer. The Obligation To Submit In The Offer Solutions Equivalent To Those Described In The Design Documentation And Technical Specifications For The Execution And Acceptance Of Works And To Demonstrate The Provision Of Equivalence Parameters Lies With The Contractor. If The Requirements In The Design Documentation And Technical Specifications For The Execution And Acceptance Of Works Refer To A Trademark, Patent, A Given Origin Or A Given Production, The Contracting Authority Requires That The Contractor Has Already Presented In His Offer Proof Of The Equivalence Of The Products Offered By Him In Relation To Those Specified In Design Documentation And Technical Specifications For The Execution And Acceptance Of Works (As In The Judgment Tsuec-14/17 Of 2018-07-12), E.G. Product Data Sheets, Technical Documentation. If The Requirements In The Design Documentation And Technical Specifications For The Execution And Acceptance Of The Works Refer To Standards Or Other Reference Systems, The Contracting Authority Requires The Contractor To Present Proof Of Equivalence In Its Tender In The Manner Specified In Art. 101 Sec. 5 And 6 Pzp. 4. The Bills Of Quantities Of Works Attached To The Swz Are Only Informational Material And Do Not Constitute A List Of Planned Works.5. The Ordering Party Does Not Reserve For The Contractor To Perform Key Parts Of The Order In Person. 6.
