1. The Subject Of The Contract Is: Execution Of Construction Works Entitled: Extension And Reconstruction Of The Building Of The Fire Station Of The Volunteer Fire Department In Jasionka, Together With Internal Installations: Gas, Central Heating, Water And Sewage, And Electricity. The Extension And Reconstruction Of The Building Should Be Made As A 2-Storey Structure: Ground Floor + First Floor, Without A Basement. On The Ground Floor, In The Expansion Part, A Staircase With A Boiler Room And A Storage Room Has Been Designed. Then, On The Ground Floor, In The Existing Part, The Staircase Was Removed And A Place For A Freight Elevator Was Allocated To Serve The Kitchen Facilities On The First Floor Of The Building. On The First Floor Of The Extended Part, Sanitary Facilities And A Utility Room Have Been Designed. While In The Rebuilt Part, The Kitchen Facilities Serving The Banquet Hall Were Redesigned. The Scope Of Works Includes: • Liquidation Of A Non-Use Liquid Waste Tank • Reconstruction Along The Existing Route Of The Water Supply Connection • Forging New Internal And External Door Openings In Order To Change The Interior Arrangement Of The Facility, • Insulation With Polystyrene Foam And Finishing Plastering The Existing Wall On The South Side • Removing The Existing Floor In Part Existing Kitchen, Raising The Level Of The Floor To Align The Levels On The First Floor Of The Building, • Removing Part Of The Partition Walls And Building New Ones In Order To Change The Arrangement Of The Rooms; • Partial Replacement And Partial Liquidation Of Window And Door Woodwork, • Liquidation Of The Existing Internal Stairs, • Enlargement Of The Existing Building By Extending It To The West 4.07 M And To The North By 15.80 M, • Equipping The Extended Part With A Staircase, Boiler Room, Sanitary Facilities, Utility Room, Technical Room, • Construction Of An Aluminum Pergola In Front Of The Main Entrance To The Extended Part Of The Building, • Repainting The Banquet Hall - Walls, Ceilings • Reconstruction Of The Existing Chimneys - Cleaning Of The Existing Chimney Ducts Together With The Assembly Of Cowls, Made Of Clinker, Replacement Of Sheet Metal Elements, Reinforced Concrete Caps, Deflectors • Painting Of The Roof - Part Of The Old Building • Repainting The Buildings Facade The Detailed Scope Of Works Is Specified In The Design Documentation Attached To Swz. 2. Any Demolition Materials That Are Not Suitable For Reuse, The Contractor Of Construction Works Is Obliged To Remove And Dispose Of Using His Own Efforts And At His Own Expense. Above Materials Are To Be Transported To The Place Indicated By The Employer. 2) The Activities Of Qualification Of Materials From Demolition Into Suitable And Non-Suitable For Reuse, Including Metal Scrap The Contractor Of Construction Works Will Write A Written Report With The Participation Of The Employer. 3. The Subject Of The Contract Includes The Performance Of All Basic And Accompanying Construction Works, Services And Supplies Related To The Performance Of The Contract For The Ready-To-Use Facility Described In The Swz, Resulting From Applicable Law And The Developed Design Documentation.4. The Scope Of The Contract Includes Other Works Necessary To Complete The Contract, Accompanying The Basic Scope Of Works, Not Included In The Bill Of Quantities And Swz, And Without Which The Contract Cannot Be Performed. In Connection With The Above, It Is Recommended To Check The Design Documentation And The Future Construction Site In Detail.5. A Detailed Description Of The Subject Of The Contract Is Specified In The Design Documentation And Technical Specifications For The Execution And Acceptance Of Construction Works. This Documentation Is Attached To The Announcement In The Procedure And Is Available On The Website Of The Procedure. 6. The Execution Of The Order Is Subject To Polish Law, Including In Particular The Act Of July 7, 1994. Construction Law, Act Of April 23, 1964. Code And The Act Of September 11, 2019. Public Procurement Law.7. If The Origin (Brand, Trademark, Manufacturer, Supplier) Of Materials Or Standards, Approvals, Specifications And Systems Referred To In Art. 99 Sec. 5 Of The Public Procurement Law, The Contracting Authority Allows Offering Materials Or Equivalent Solutions, Provided That They Guarantee The Proper Implementation Of The Works And Ensure The Achievement Of Technical Parameters Not Worse Than Those Assumed In The Above-Mentioned Documents, I.E. In Particular In The Technical Documentation, In The Bill Of Quantities And Stwior. 8. Pursuant To Art. 101 Sec. 4 Of The Public Procurement Law In A Situation Where The Project Documentation Or Stwiorb, I.E. The Documents Describing The Subject Of The Contract, Contain A Reference To The Standards, Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Sec. 3 Of The Public Procurement Law, And Such References Were Not Accompanied By The Phrase Or Equivalent, The Employer Allows Solutions Equivalent To Those Described In Each Such Standard, Technical Assessment, Approval, Technical Specification, Technical Reference System. In Connection With The Above, It Should Be Assumed That Each: Standard, Technical Assessment, Approval, Technical Specification, System Of Technical References Appearing In The Description Of The Subject Of The Contract Is Accompanied By The Words Or Equivalent. 9. All The Criteria And Features Described In The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Set The Minimum Standards That Must Be Met By The Offered Product Or Service.10. According To Art. 101 Sec. 5 Of The Public Procurement Law, A Contractor Who Refers To Solutions Equivalent To Those Described In These Documents Is Obliged To Prove, By Attaching To The Offer Relevant Evidence Referred To In Art. 104-107 Of The Public Procurement Law That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract To An Equivalent Degree.11. If The Proposed Equivalent Solution Is Not Indicated, The Employer Acknowledges That The Contractor Will Perform The Subject Of The Contract In Accordance With The Solutions Indicated In The Tor And Other Documentation Of The Procedure. The Contracting Authority With Regard To The Performance Of The Contract, If The Performance Of These Activities Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2020, Item 1320). Determining The Requirements Referred To In Art. 95 Of The Public Procurement Law Regarding The Performance Of The Contract And Enforcement Of The Requirement Of Employment Based On An Employment Relationship: The Contracting Authority Requires Employment On The Basis Of An Employment Relationship. ; The Employer Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing Activities During The Execution Of The Contract, Under The Direction And Supervision Of The Construction Management, Physical Work Related To The Performance Of Construction, Installation And Assembly Works (Workers) On The Construction Site - 2 People.- Persons Performing The Activities Indicated By The Ordering Party Should Be Employed By The Contractor Or Subcontractor On The Basis Of An Employment Relationship, At Least For The Entire Period In Which They Will Perform The Above-Mentioned Activities. This Obligation Does Not Apply To Persons Performing Independent Functions In Accordance With Their Powers, In Particular: Self-Employed Persons, Etc. - In Order To Verify The Employment Of The Above-Mentioned Persons, The Contractor Should Declare In The Tender Form That Persons Performing The Above-Mentioned Activities During The Execution Of The Order Will Be Employed On On The Basis Of An Employment Relationship. - Detailed Requirements For The Implementation And Enforcement Of The Employment Requirement On The Basis Of An Employment Relationship Have Been Specified In The Draft Contractual Provisions Of The Order, Constituting An Appendix To The Tor. 19.
