Tenders Are Invited For Supply Of Medical Gases Together With The Lease Of Cylinders For The Needs Of The Railway Hospital In Wilkowice-Bystra

1. The Subject Of The Contract Is The Supply Of Medical Gases Together With The Lease Of Cylinders For The Needs Of Spzoz Of The Railway Hospital In Wilkowice-Bystra In The Assortment And Quantities Specified In Detail In Appendix No. 2 To Swz.2. The Subject Of The Contract Has Not Been Divided Into Parts. The Contracting Authority Has Not Divided The Contract Into Parts Due To The Nature Of The Contract, Where The Division Into Parts Would Cause An Unjustified Increase In Costs. At The Same Time, The Lack Of Division Of The Contract Into Lots Does Not Restrict Competition And Ensures Equal Access For Entities From The Sector Of Small And Medium-Sized Enterprises.3. The Ordering Party Reserves The Right To Increase The Value Of The Order To 30% During The Implementation Of The Scope Of Supplies Specified In Annex 2. Conditions For Exercising The Option Right: A. The Use Of The Optional Order Will Depend On The Current Needs Of The Ordering Party As An Entitlement That It May, But Does Not Have To, Use. B. The Ordering Party Has The Right To Exercise The Option Right During The Term Of The Contract.C. Orders Carried Out Under The Option Right Are A Unilateral Right Of The Ordering Party. Failure To Place An Order Covered By The Option Right Does Not Give Rise To Any Claims On The Part Of The Contractor Against The Ordering Party. D. The Contractor Is Obliged To Perform The Contract Provided For In The Option Law On The Terms Described In The Swz And The Contract Template.4. The Ordering Party Declares A Minimum Order Value Of 70% Of The Value Of The Contract Which The Ordering Party Will Sign With The Contractor. The Ordering Party Will Perform Only The Minimum Value Of The Order, In Particular In A Situation Where 100% Execution Of The Order Will Not Be In The Interest Of The Ordering Party For Economic, Organizational Or Technical Reasons, I.E. E.G. Organizational Changes At The Ordering Party Or Changes In The Rules Of Treating Patients. The Contractor Is Not Entitled To Any Claims In A Situation Where The Ordering Party Performs Only The Minimum Value Of The Order (70%).5. The Offered Products Are Medicinal Products (Oxygen) Within The Meaning Of The Act Of 6 September 2001. Pharmaceutical Law (Consolidated Text, Journal Of Laws Of 2022, Item 2301, As Amended) Must Have A Valid Marketing Authorization Within The Meaning Of The Pharmaceutical Law. Issued Before 1 October 2002 Registration Certificates And Certificates Of Admission To Trading Are Authorizations Within The Meaning Of The Pharmaceutical Law And Remain Valid Within The Validity Dates Specified For Them.6. All Offered Products That Are Medical Devices Must Have Valid Marketing Authorization Documents And Meet The Requirements Of The Act Of 7 April 2022 On Medical Devices (Journal Of Laws Of 2022, Item 974), Its Transitional And Executive Provisions And The Regulation 2017/745 On Medical Devices - Mdr (If The Law Imposes An Obligation To Have Such Documents).7. Each Delivery Of Gases Must Meet All Requirements Allowing Them To Be Traded In Medicine And Have Instructions For Use In The Form Of A Leaflet In Polish.8. Requirements For The Delivery: - The Current Supply Of Gases Carried Out By The Contractor Must Be Consistent With The Assortment And Quantity Of The Order Received By The Ordering Party; - Gases Will Be Delivered In Cylinders Owned By The Contractor; - The Ordering Party Will Lease The Delivered Cylinders From The Contractor; Together With The Next Delivery Of Gases; - Delivery Of The Ordered Gases Will Be Carried Out By The Contractor To The Ordering Partys Seat; - The Contractor Shall Attach Documents Confirming The Type And Quantity Of The Delivered Gas To Each Delivery; Authorized Employee; - In The Case Of Defectiveness Of The Delivery, Found Upon Receipt Of The Delivery, The Contractor Is Obliged To Immediately Replace The Delivered Goods; - Quantitative And Qualitative Complaints Not Found During The Delivery, The Ordering Party Immediately Reports To The Contractor By Telephone And In Writing; - The Contractor Is Obliged To Consider The Complaint In Within 3 Days From The Date Of Its Receipt, - The Contractor Undertakes To Deliver 15 40-Liter Cylinders, Referred To In Appendix No. 2 To The Swz In The Event Of A Failure Or Inability To Use The Oxygen Tank - Within 12 Hours From The Date Of Notification By Of The Ordering Party.9. The Contractor Whose Offer Is Considered The Most Advantageous, After Signing The Contract, At The Request Of The Ordering Party, Is Obliged To Provide Safety Data Sheets For Each Of The Offered Gases.10. The Payment Deadline For The Completed Delivery Is Not Shorter Than 60 Days From The Date Of Correct Issue Of A Proper Invoice To The Ordering Party.11. The Delivery Of The Subject Of The Order Shall Be At The Expense And Risk Of The Contractor.
