The Subject Of The Contract Is The Performance Of The Contract Entitled: Maintenance Of Park Greenery In The Ursyn w District - Park Of Polish Inventors. Obligations Arising From The Social Clause1. In The Proceedings In Question, The Contracting Authority Applies The Social Clause Pursuant To Art. 95 Sec. 1 Of The Public Procurement Law.2. The Contractor Undertakes To Ensure That The Activities Related To The Performance Of The Contract For The Maintenance Of The Park During Their Performance Will Be Performed By Persons Employed Under An Employment Contract Within The Meaning Of The Labor Code, By The Contractor Or Subcontractor. 3. The Condition Referred To In Par. 2, Will Be Fulfilled By Employing New Employees Under An Employment Contract Or Appointing Already Employed Persons To Perform The Order, Performing Activities Consisting In: Mowing Lawns, Raking And Collecting Pollution From Green Areas And Emptying Waste Bins. 4. Detailed Conditions Of Implementation And Control As Well As Requirements Related To This Obligation, As Well As Contractual Penalties Are Specified In The Draft Provisions Of The Agreement - Appendix 2 To The Tor.
