The Subject Of The Contract Is The Reconstruction Of The Road In Sułkowo Borowe, With A Total Length Of 990 M And A Width Of 3.5 M, Consisting In Measuring Works When Determining The Route, Profiling And Compacting The Existing Gravel Surface, Making A Foundation Of Broken Aggregate 15 Cm Thick, Liquefying It With Asphalt Emulsion , Execution Of A Two-Layer Surface Made Of Mineral-Asphalt Mixtures (4 Cm Binding Layer And 3 Cm Wearing Course) And Execution Of 0.5 M Wide Shoulders On Both Sides Made Of Natural Sand Aggregate - The Upper Layer 7 Cm Thick After Compaction.2. The Description Of The Subject Of The Contract Includes: - Design Documentation, - Notification Of Construction Or Other Construction Works, Together With A Certificate Of No Grounds For Raising An Objection, - Technical Specification For The Execution And Acceptance Of Construction Works, - Bill Of Quantities.3. If The Description Of The Subject Of The Contract In This Procedure - Also In The Design Documentation Used To Describe The Subject Of The Contract For The Performance Of Construction Works - Contains Any Trademarks, Patents Or Origins, Sources Or Specific Processes That Characterize The Products Or Services Provided By A Specific Contractor, The Contracting Authority Allows Equivalent Solutions (“Or Equivalent” – Article 99(5) Of The Public Procurement Law). When Preparing The Description Of The Subject Of The Contract On The Basis Of The Design Documentation, The Employer Did Not Find Any Trademarks, Patents Or Origins, Sources Or Specific Processes That Characterize The Products Or Services Provided By A Specific Contractor. However, If The Contractor Finds / Notices, Analyzing The Description Of The Subject Of The Contract, That There Are Such Cases Or Indirectly Pointing To One Specific Product, The Contractor Is Asked To, In Accordance With Art. 284 Sec. 1 Of The Public Procurement Law, When Asking The Contracting Authority To Explain The Content Of The Swz, He Indicated Such Products. A Similar Rule Applies In Cases Where References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Sec. 3 Of The Public Procurement Law.4. If The Description Of The Subject Of The Contract Refers To The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Sec. 3 Of The Public Procurement Law, The Contracting Authority May Not Reject A Tender Only Because The Offered Works, Supplies Or Services Do Not Comply With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Of The Contract Refers, Provided That The Contractor Proves Offer, In Particular By Means Of Evidence Referred To In Art. 104-107 Of The Public Procurement Law That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract To An Equivalent Degree.5. Offering Solutions Equivalent To Those Indicated In The Description Of The Subject Of The Contract Requires Proving That The Offered Equivalent Solution Has Technical, Operational And Operational Parameters Not Worse Than Those Required By The Contracting Authority. The Burden Of Proving Compliance With These Requirements Lies With The Contractor In The Submitted Offer. 6.
