1. The Subject Of The Order Is A Successive Delivery Together With The Service Of Transporting Liquid Fuel, I.E. Diesel Oil To The Tank Located At The Aquaplus Sp. Z O. O. Located In Bobrowniki At Ul. Communal 8.2. Estimated Amount Of Ordered Diesel Oil In The Estimated Amount Of 24,000 Liters (24 M3).3. The Size Of A Single Fuel Supply To The Tank Is About 1,600 Liters Of Diesel Fuel At A Frequency Of Not Less Than Once A Month. (The Size Of The Tank Owned By The Ordering Party Is 2,500 Liters And A Single Delivery Will Not Exceed The Indicated Amount).4. The Contractor Shall Be Obliged To Have A Paid Insurance Policy Or Other Insurance Document Confirming That He Is Insured Against Civil Liability In The Scope Of His Activities Related To The Subject Of The Contract For The Duration Of Its Implementation For The Amount Not Less Than Pln 500,000.00 (Five Hundred Thousand Zlotys).5. The Contractor Is Obliged To Deliver Fuel Of The Quality And Parameters (Composition) Compliant With The Law. Diesel Fuel Must Meet The Requirements Of The Act Of August 25, 2006 On The Fuel Quality Monitoring And Control System, The Regulation Of The Minister Of Economy Of October 9, 2015 On Quality Requirements For Liquid Fuels And The Parameters Of The Pn-En 590+A1:2017 Standard 06, And In The Event Of Changes In Regulations Or Standards, The Supplied Fuel Will Comply With The Changed Regulations And Standards.6. For Each Delivery Of Fuel, The Contractor Shall: A) Attach A Document On The Quality Of A Given Batch Of Fuel, In Particular Specifying The Physical And Chemical Parameters (Quality Certificate) In The Original Or A Certified Copy. B) Provide The Ordering Party With The So-Called Mediation Sample. For This Purpose, The Contractors Employee, Prior To Refueling To The Tank, Will Infuse A Sample Of Diesel Oil In The Amount Of Approx. 5 Liters Into A Metal Canister In The Presence Of The Employers Employee, And Then Seal It With His Mark (Arbitration Sample). The Seal Will Be Signed By: An Authorized Employee Of The Employer And The Representative Of The Contractor - The Driver. The Collected Sample Is The Basis For Pursuing Possible Claims For Improper Fuel Quality. Containers For Samples And Seals Are Provided By The Contractor.7. The Ordering Party Requires Deliveries To Be Made By A Road Tanker Truck Equipped With A Pump Or Distributor, Meeting All The Requirements Of Applicable Law, In Particular The Act Of May 11, 2001. Law On Measures And Executive Acts To The Law On Auto-Tanks (Vehicles For The Transport Of Liquid Fuels). The Vehicle Used For Fuel Deliveries Should Be Equipped With A Legalized Measuring Device Measuring The Amount Of Fuel Discharged To The Container Filling Station. Both The Tank And The Measuring Device Should Have Valid Verification Features And A Set Of Undamaged Seals Applied By An Authorized Body.8. The Contractor Shall Ensure The Organization And Implementation Of Safe Fuel Supplies, The Grade Of Which Will Be Appropriate To The Season And The Prevailing Temperature Conditions In Terms Of Cloud Point And Cold Filter Blockage Temperature.9. The Contractor Is Obliged To Ensure Constant, Successive Deliveries According To The Needs Reported By The Ordering Party For The Duration Of The Concluded Contract.10. The Ordering Partys Request For A Current Delivery Specifying The Quantity Shall Be Made By E-Mail Or By Telephone To The Number Provided By The Contractor. The Contractor Is Obliged To Confirm Each Order By E-Mail.11. The Contractor Is Obliged To Deliver Fuel To The Ordering Party Within 24 Hours From The Moment (Date And Time) Of Placing The Order. The Driver Performing The Delivery Is Obliged To Have And Present, At The Request Of An Authorized Employee Of The Ordering Party, Documents Confirming The Legalization Of The Road Tanker (Tank And Measuring Device) - It Is Allowed To Present Certified Copies Of Documents.12. The Collection Of Fuel Will Be Confirmed Each Time With The Acceptance Report/Proof Of Delivery Based On The Indications Of The Road Tankers Measuring Device.13. In The Case Of Violation Of The Provisions Of Points 9 And 12, The Amount Of Fuel Supplied Is Determined On The Basis Of The Indications Of The Measuring Bar Of The Container Filling Station Or Based On The Volume Of The Ordering Partys Measuring Flask - Non-Verified Devices.14. The Subject Of The Contract May Not Be Described By Indicating Trademarks, Patents Or The Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, If This Could Lead To Favoring Or Eliminating Some Contractors Or Products, Unless It Is Justified By The Specificity Of The Subject Of The Contract I The Ordering Party Cannot Describe The Subject Of The Order Using Sufficiently Precise Terms, And Such An Indication Is Accompanied By The Words Or Equivalent. 15. In A Situation Where The Ordering Party Describes The Subject Of The Contract By Referring To Standards, European Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Sec. 3 Of The Public Procurement Law, Solutions Equivalent To Those Described Are Allowed.
