General Description Of The Subject Of The Contract: The Subject Of The Contract Is Comprehensive Paid Performance Of The Duties Of The Investors Supervision Inspector During The Implementation Of The Task Entitled: Stabilization Of The Landslide No. 81112 Along With The Reconstruction Of The Municipal Road - Ul. Le na In Muszyna 2. Specification Of The Subject And Scope Of The Contract: The Contractors Duties Include In Particular: - Acting As A Supervision Inspector In Accordance With The Provisions, In Particular With Art. 25 And 26 Pb, - Ensuring The Correct And Timely Implementation Of The Investment, - Checking The Completeness And Correctness Of The Documents Prepared By The Contractor During The Execution Of The Works (Including Financial Settlements), In Accordance With The Provisions Of The Contract With The Contractor Of The Works, - Representing The Employer On The Construction Site In All Technical Matters Related To The Implementation Of The Investment, - Handing Over, With The Participation Of The Employer, The Construction Site To The Contractor Of The Works, - Ongoing Solving Of Technical Problems Of The Construction Site, - Agreeing With The Employer Any Changes Regarding The Value And Scope Of The Supervised Works, - Informing The Employer About The Progress Of The Works And Any Circumstances That May Impact On Extending The Deadline And Changing The Costs Of Investment Implementation, - Checking The Correctness Of The Scope Of Works Performed And Its Compliance With The Contract Concluded Between The Investor And The Contractor As Well As The Contractor And Subcontractors, - Cooperation With The Employer In The Field Of Project Administration: Providing Information On The Progress Of Works In Financial Terms And Material (Checking Lists Of Partially Completed Works, In Terms Of Material And Financial), Information On Hazards, Conflicts On The Construction Site, Etc., - Checking And Acceptance Of Construction Works That Are Subject To Concealment Or Disappearing, Participation In Tests And Technical Acceptances (Also Those Carried Out By Administrators Network), - Confirmation Of The Works Performed As The Basis For Payment Of The Contractors Remuneration, - Participation In Partial Acceptances And Final Acceptance And Confirmation Of The Removal Of Defects And Faults Indicated In The Acceptance Reports, - Checking The Completeness And Correctness Of The Acceptance Report, Participation In Partial Acceptances And Final Acceptance - Checking The Pre-Acceptance Documents Prepared By The Contractor Of The Works, In The Scope Of The Investors Supervision, - Certifying The Date Of Completion Of The Works, - Organizing And Participating In Coordination Meetings (Construction Council) On Working Days From Office, I.E. Monday 8:00-16:00, Tuesday To Friday 7:30-15:30 And Ensuring The Implementation Of The Arrangements And Decisions Made At The Site Council, - Preparation Of Current Photographic Documentation During The Works, At Each Stage Of The Works, - Providing Written Opinions On Proposals For Changes In The Technology Of Execution And Materials Proposed By The Contractor And The Employer, - Checking The Quality Of Construction Works And Construction Products Before Their Incorporation, And In Particular Preventing The Use Of Defective Devices And Construction Products, Not Approved For Use In Construction Or Not Meeting The Required Technical Parameters, - Cooperation With The Employer In Enforcing The Provisions Of The Contract For Construction Works, - Participation With The Employer In The Acceptance Of The Task, - Preparation Of A Project Acceptance Report With The Contractor Together With The Acceptance Documentation, - Service Of The Warranty Period And The Warranty Period: Participation In Warranty Inspections, Inspection Of Disposal Defects By The Contractor Of Construction Works. 1) The Contractor Is Obliged To Regularly Check The Quality Of Materials And Works, As Well As Equipment, With The Quality And Standards Corresponding To The Requirements Of Products Admitted To Trading And Use In Construction And In Accordance With The Requirements Of The Employer Specified In The Specification Of The Terms Of The Contract And In The Design Documentation 2) The Contractor, At Each Request Of The Employer, Is Obliged To Obtain From The Construction Manager And Provide The Employer A Safety Mark Certificate, Declaration Of Conformity Or A Certificate Of Conformity With The Polish Standard Or Technical Approval Regarding The Offered And Used Materials And Devices. 3) The Contractor Undertakes That The Documents Indicated In The Draft Contract Will Be Attached To The Partial And Final Acceptance Protocol Together With The As-Built Documentation And Relevant Operating Instructions In Polish And Industry Acceptance Protocols. 4) If, During The Execution Of The Works, It Becomes Necessary To Perform Additional Works Not Provided For In The Contract Concluded With The Contractor, The Supervision Inspector Should Immediately Notify The Employer Of This Fact In Order To Decide Whether To Commission Them To The Contractor. 5) Without The Consent Of The Employer, The Supervision Inspector Is Not Authorized To Issuing Orders To The Contractor To Perform Additional Works.6) The Contractor, As The Supervision Inspector, Has The Right To: A) Issue Instructions To The Construction Manager Or Works Manager - Confirmed By An Entry In The Construction Log - Regarding: - Removing Irregularities Or Threats, - Performing Tests Or Examinations, Also Requiring Discovery Works Or Covered Elements And Presentation Of Expert Opinions On Construction Works, - Evidence Of Marketing And Use Of Technical Products And Devices In The Construction Industry. In The Event That Their Continuation Could Cause A Threat Or Cause Unacceptable Non-Compliance With The Design Or Building Permit. 7) The Contractor Should Perform The Subject Of The Contract In Accordance With: ) With The Provisions Of The Contract.8) The Contractor Should Provide, On Its Own, The Equipment And Persons Necessary To Perform The Subject Of The Contract.9) Whenever The Competent Authority Or A Third Party Calls On The Employer To Perform Material And Technical Activities Related To The Scope Of The Subject Of The Contract, The Contractor Is Obliged To Provide Each Necessary Assistance To The Employer In Performing These Activities Or The Employer Will Call The Contractor To Perform These Activities. The Contractor Is Not Entitled To Additional Remuneration For These Activities, And The Ordering Party May Set A Deadline For The Contractor To Perform Them. During The Performance Of Works By The Contractor, The Ordering Party Has The Right To Control The Correctness Of Their Performance. In Order To Enable The Ordering Party To Exercise This Right, The Contractor Is Obliged To Allow The Authorized Representatives Of The Ordering Party To Inspect The Works In Progress - At Their Every Request. In Addition, The Contractor Is Bound By The Content Of The Comments And Instructions Of The Authorized Representatives Of The Employer Regarding The Manner Of Performing The Works In Writing.11) The Contractor Undertakes To Protect Information Obtained And Provided To The Employer In Connection With The Performance Of The Contract, The Disclosure Of Which Could Harm The Interests Of The Employer. Comply With The Requirements Provided For In The Provisions Of Generally Applicable Law.
