1. The Subject Of The Order Is The Successive Delivery Of Endodontic Instruments And Accessories.2. The Goods Offered (Item 3.1 Of The Swz) Must: 2.1. Meet The Conditions For Placing On The Market And For Use, Provided For In The Act On Medical Devices Of May 20, 2010 (Journal Of Laws Of 2010 No. 107, Item 679, As Amended - Hereinafter: Act On Medical Devices), Confirmed By Current Documents (I.E. Complete Notifications Or Notifications To The President Of The Office For Registration Of Medicinal Products, Medical Devices And Biocidal Products, Safety Data Sheets, Ce Certificate, Declarations Of Conformity, Approvals) - For Those Goods That Require It;2.2. Have Documents Allowing Them To Be Traded And Used In Poland, Including The Ce Certificate And Documents Confirming That These Goods Meet The Standards Required By Law In The Case Of Goods That Are Not Subject To The Provisions Of The Medical Devices Act Or The Pharmaceutical Law;2.3. For Products Classified As Cosmetics In Accordance With Regulation Of The European Parliament And Of The Council / Ec / No. 1223/2009 Of November 30, 2009, Have A Notification In The Cosmetic Products Notification Portal (Cpnp Portal); Be New, Packed In The Original Packaging. The Labels And Packaging Of The Goods Should Contain All The Information Required In Accordance With The Act On Medical Devices, The Pharmaceutical Law Or Other Provisions Of Generally Applicable Law; 2.4. Have An Expiry Date Of At Least 12 Months From The Date Of Its Delivery - In The Case Of Goods With A Limited Period Of Validity; 2.5. Have A Constant Spectrum Of Activity Throughout The Period Of Validity Of The Preparation.3. The Contractor Is Obliged To Absolutely Guarantee The Fulfillment Of The Quality Conditions Specified In The Production Permit Or Other Decisions Established By The Ministry Of Health, Based On Which The Goods Have Been Admitted To Trading In The Republic Of Poland, And Compliance With The Expiry Dates For The Delivered Goods. 4. For Each Of The Parts Of The Order Referred To In Point 3.1 Of The Swz, The Contractor Is Obliged, Free Of Charge, To:4.1. Deliver The Goods Successively To The Seat Of The Ordering Party (Ul. Montelupich 4, Krak w), On The Basis Of Orders Specifying The Assortment And Quantity, Within No More Than 5 Working Days From The Moment Of Placing The Order, With The Reservation That Deliveries Will Be Accepted On Working Days (From Monday To Friday, Excluding Public Holidays), From 8:00 To 14:00;4.2. Bring In And Unload The Goods In The Warehouse (Room 07C) At The Ordering Partys Registered Office.5. A Detailed Description Of The Subject Of The Contract (Sopz) Constitutes Appendix No. 3 To The Tor And It Will Be Introduced As An Appendix To The Public Procurement Contract, The Template Of Which Is Attached As Appendix No. 4 To The Tor. This Description Should Be Analyzed Together With Possible Changes To The Content Of The Swz, Which Are, For Example, The Result Of Answers To Inquiries.6. The Numbers Of Ordered Goods Provided In Annex 3 To The Tor Are Estimates And Are Used To Calculate The Offer Price (Contractors Remuneration). In The Event Of A Decrease Or Increase In The Number Of Patients Of The Ordering Party During The Term Of The Agreement, The Ordering Party May Purchase From The Contractor A Smaller Or Larger Number Of Goods Than Specified In Appendix No. 3 To The Tor, And For Each Of The Goods This Difference Will Not Be Higher Than 10% Of The Number Indicated In Annex No. 3 To The Swz. The Above Circumstance Will Also Affect The Final Amount Of Remuneration Due To The Contractor, With The Difference In Its Amount Not Exceeding 10% Of Its Original Value. Detailed Rules For Reducing Or Increasing The Number Of Purchased Goods, As Well As Detailed Conditions For The Performance Of The Contract, Are Described In The Model Contract For The Award Of A Public Contract, Constituting Appendix 4 To The Tor. 7. As Part Of The Offer Submitted By The Contractor, The Ordering Party Will Allow Other Quantities Of Items In The Package Of The Subject Of The Order Than Those Indicated In Annex 3 To The Tor, But Only After Their Appropriate Conversion In Relation To The Ordering Partys Needs. The Contractor Is Obliged To Make The Appropriate Conversion Himself And Mark It In Annex 1A To The Swz, Which He Submits In His Offer.8. According To Art. 101 Sec. 4 Of The Act, In Cases Where The Provisions Of The Swz Refer To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems, The Employer Allows Solutions Equivalent To Those Described, And Such A Reference Is Accompanied By The Words Or Equivalent. The Contractor Should Attach To The Offer Documentation Confirming This Equivalence. In Particular, The Contractor Is Required To Ensure That The Qualitative And Quantitative Composition Of The Substance Meets The Requirements Contained In This Tor. 9. If The Description Of The Subject Of The Order Includes: Names Of Trademarks, Patents Or Origin, It Should Be Treated Only As An Aid In The Description Of The Subject Of The Order. In Each Case, Products Equivalent In Terms Of Parameters, Construction, Purpose, Etc. Are Acceptable.
