The Subject Of The Order Is A Successive Delivery Of Food Products For The Needs Of The Nursing Home In K dzierzyn-Ko le For The Needs Of Current Nutrition In The Assortment And Quantities Included In The Individual Parts Of The Order Specified In Attachments 1 6. The Entire Order Has Been Divided Into Six Parts Of The Order, I.E.: A. Part 1 Bread And Confectioneryb. Part 2 - Dairy Products. Part 3 - Meat And Sausagesd. Part 4 - Fruits, Vegetables And Eggs. Part 5 - Frozen Vegetables And Fruits, Fish And Fish Products And Flour Productsf. Part 6 - Other Foodstuffs Part 1 - Bread And Confectionery Products The Detailed Description Of The Subject Of The Contract Is Set Out In The Technical Specification Of Supplies, Appendix 1 - Constituting An Integral Part Of The Swz Published On The Website Of The Procedure: Https://Epropublico.Pl/Zamiarjacy/Aktualneogloszenia?Zamiarjacyid=77Dc63a8-5C92 -4A75-9319-A101d0990564 In The Line Marked With The Title And Mark Of This Procedure. Applicable To All Parts Of The Order: 1. The Subject Of The Order Are Successive Deliveries Of Food Products Intended For Daily Nutrition In The Assortment And Quantities Included In The Lists Constituting Annexes No. 1 To No. 6. The Ordering Party Emphasizes That The Cyclical Deliveries Should Each Time Be Adjusted By Weight To The Order Placed.2. The Ordering Entity Reserves The Right To Limit The Scope Of The Contract In Individual Parts, While Maintaining The Minimum Value Of The Subject Of The Contract (Specified In The Concluded Contract) At The Level Of 25%, Guaranteeing The Contractor Remuneration Related To This Scope Of The Contract. The Specified Quantity Of Groceries In The Price Form Is An Estimate And May Change (Decrease Or Increase) During The Performance Of The Contract. The Above Cannot Be The Basis For The Contractor To Make Claims For The Purchase Of The Remaining Quantity Of Products Or For Payment Of The Equivalent Of Unordered Products Or Compensation For Their Failure To Order.3. The Food Products Supplied Should Meet The Current Sanitary And Epidemiological Requirements And The Principles Of The Haccp System In Mass Caterers, Among Others: Appropriate Temperature During Transport And Sanitary Conditions Of The Vehicle And The Contractor Must Have Current Required Decisions Related To This. In The Event That Any Of The Existing Decisions Expire Or Are Revoked During The Term Of This Contract, The Contractor Is Obliged To Submit A New Decision In This Regard, No Later Than On The Last Day Of The Previous Ones Validity. The Lack Of Any Required Document Confirming The Possession Of A Valid Valid Decision Or Failure To Complete The Documents Within The Time Limit Set By The Contracting Entity Shall Constitute The Basis For The Contracting Entity To Withdraw From The Contract With Immediate Effect And Charge The Contractor The Contractual Penalty Referred To In 10 Section 1 Point 1.1 Of The Ppu Or, Depending On The Decision Of The Procuring Entity, To Suspend The Performance Of The Contract Until The Deficiencies Are Remedied Within The Time Limit Specified By The Procuring Entity.4. At Each Request Of The Ordering Party, The Contractor Is Obliged To Present An Appropriate Certificate Of Compliance With The Polish Standard Or European Standards For Each Product.5. Quality Requirements Of The Subject Of The Contract: 1) The Contractor Shall Deliver First-Class Food Products, Fresh, Corresponding To The Quality Standards Appropriate For The Type Of Products That Are In Force In Poland, With Current Best-Before Dates. Packaging Of Food Products Supplied By The Contractor Must Be Marked With A Visible Expiration Date. 2) All Dry Products Should Be Packed In Clean Individual Packaging Intended For Contact With Food, Protecting The Contents Against Damage. Groats Should Be Dry, Free Of Pests And Damage Caused By Them, Without Traces Of Mold Or Moisture. Damaged, Broken Products As Well As Damaged Or Open Packaging Or Hermetically Leaking Or Delivered In Replacement/Non-Original Packaging Are Unacceptable.3) Bakery Products (Bakery And Confectionery) Should Be Delivered Dry, Without Pests And Damage Caused Traces Of Mold Or Moisture, No Foreign Smells. Products That Are Mechanically Damaged, Broken, Not Fully Grown, With Calcified Inside Or With Too Dark Skin Color Are Unacceptable. Deliveries Must Meet The Conditions Resulting From The Act Of August 25, 2006. On Food And Nutrition Safety (I.E. Journal Of Laws Of 2022, Item 2132). The Delivered Bread And Cakes Must Have Quality Features Characteristic For A Given Type.6. Upon Request By An Authorized Representative Of The Purchasing Entity, The Contractor Shall Demonstrate That The Assortment It Is Supplying Meets The Minimum Requirements Of The Purchasing Entity As Specified In The Contract, On An Ad Hoc Basis In The Event Of Reasonable Doubt By Presenting The Delivered Goods At The Time Of Transfer To The Procuring Entitys Warehouse. If The Reservations Are Confirmed, A Protocol Signed By Representatives Of Both Parties Will Be Drawn Up, Which May Be The Basis For The Complaint.7. Deliveries Will Be Made Successively Based On The Needs Of The Ordering Entity, Each Time Specifying The Delivery Date And The Assortment Of The Order - Excluding Holidays Of The Ordering Entity.8. The Production Of The Goods, The Method Of Packaging And Transport Must Meet The Requirements Of Applicable National And Eu Food Law, In Particular: 1) From The Act Of August 25, 2006. On Food Safety And Nutrition,2) The Act Of 21 December 2000 On The Commercial Quality Of Agri-Food Products,3) The Act Of 16 December 2005 On Products Of Animal Origin,4) Regulation Of The European Parliament And Of The Council (Eu) No. 1169/2011 Of 25 October 2011 On The Provision Of Food Information To Consumers (...),5) Regulation (Ec) No 852/2004 Of The European Parliament And Of The Council Of 29 April 2004 On The Hygiene Of Foodstuffs, 6) Regulation (Ec) No. 1935/2004 Of The European Parliament And Of The Council Of 27 October 2004 On Materials And Articles Intended To Come Into Contact With Food And Repealing Directives 80/590/Eec And 89/109/Eec (Journal Of Laws Ue.L.2004.338.4 As Amended),7) Regulation (Ec) No. 178/2002 Of The European Parliament And Of The Council Of 28 January 2002 Laying Down The General Principles And Requirements Of Food Law Establishing The European Food Safety Authority And Laying Down Procedures In The Field Of Food Safety,9. Terms Of Delivery: 1) The Contractor Undertakes To Deliver The Subject Of The Contract In Accordance With The Description, With His Own Means Of Transport, At His Own Expense And Risk. Delivery Of Goods By Courier Is Not Allowed. 2) The Execution Of Deliveries Is Made On The Basis Of Orders Submitted By The Purchaser In Writing, Electronically (E-Mail), By Telephone Or Via Fax, Specifying The Quantities And Dates Of Deliveries And, If Necessary, Other Conditions Relevant To From The Point Of View Of The Procuring Entity.3) Deliveries Of Goods Will Be Made During The Hours Specified Below, And During Warehouse Opening Hours (Until 1.30 Pm) The Claimed Goods Can Be Delivered.4) Deliveries Will Be Made On Business Days: Lot 1 Bakery And Confectionery 6.30 To 7.30 Every Day From Monday To Saturday5) The Ordering Entity Reserves The Right To Check The Ordered Assortment In Terms Of Quantity And Quality Also At The Time Of Receipt Of The Goods. The Ordering Entity Reserves The Right To Deliver The First Grade Assortment.6) The Contractor Is Obliged To Mark And Package The Goods In Accordance With Applicable Regulations, Taking Into Account The Requirements Of The Ordering Entity Specified In The Description Of The Subject Of The Order,7) For Each Delivery, The Contractor Is Obliged To Provide: A) Means Of Transport Appropriate To Transport Food In Accordance With Applicable Provisions On The Hygiene Of Foodstuffs, Under Pain Of Non-Acceptance Of Delivery By The Ordering Entity; B) Adequate Protection Of The Goods For The Duration Of Transport, Under Pain Of Liability For Shortages And Defects Arising During Transport; By The Driver Or Other Person To The Storage Room; D) The Presence Of The Driver Or Other Person Representing The Contractor During The Sampling As Part Of A Complaint Or Preventive Inspection, Under The Pain Of Performing These Activities Without The Contractors Participation At His Risk. 8) The Contractor Is Obliged To Accept Complaints And Defects Delivered Products And Replacement Of Defective Products And Acceptance Of The Return Of Expired Or Stale Products (Within The Hours Designated By The Procuring Entity For The Receipt Of Goods).9) Goods May Not Be Left Unattended Or Given To Unauthorized Persons.10. The Procuring Entity Stipulates That The Best-Before Date, If Determinable, Shall Not Exceed Half Of The Manufacturers Best-Before Date.11. The Delivered Assortment Must Be Labeled In An Understandable Way, Inscriptions In Polish Must Be Clear, Legible And Indelible, Placed In A Visible Place, And Must Not Be Hidden, Obscured Or Obscured By Other Prints Or Pictures In Any Way.12. The Subject Of The Order (Appearing In Individual Packaging) Will Be Delivered In Original Packaging - Without The Use Of Substitute Packaging.
