Where In The Construction Design, Detailed Design, Technical Design, Technical Specification For The Execution And Acceptance Of Works, Bills Of Quantities, A Trademark (Brand), Manufacturer, Supplier, Patent, Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific The Contractor Or Standards, European Technical Assessments, Common Technical Specifications Or Other References Referred To In Art. 101 Section 1 Item 2 Or Section 3 Of The Act, The Ordering Party In Accordance With Art. 99 Sec. 5 Of The Act Allows The Submission Of An Equivalent Offer Or Pursuant To Art. 101 Sec. 4 Of The Act, Offering Equivalent Solutions To Those Indicated In The Documentation, Provided That They Ensure The Achievement Of Technical Parameters Not Worse Than Those Assumed In The Documentation And Are Consistent In Terms Of: 1) Dimensions And Construction (Size, Type, Physical Properties, Number Of Components) ,2) Utility Character (Identity Of Functions), 3) Material Characteristics (Type And Quality Of Materials), 4) Technical Parameters (Strength, Durability, Technical Data, Hydraulic Data, Linear Characteristics, Construction), 5) Safety Parameters Of Use, 6) Emission Standards.7. The Contractor, At Each Request Of The Ordering Party, Is Obliged To Present, In Relation To The Indicated Materials, Safety Marks, A Declaration Of Conformity Or Technical Approval Or A Certificate Of Conformity With The Polish Standard Transposing European Standards Or Equivalent Or The Standard Of The Member States Of The European Economic Area Transposing This Standard Or Equivalent Or Polish Standard Or Equivalent In The Absence Of A Polish Standard Transposing European.8. Whenever The Construction Design, Detailed Design, Technical Specification For The Execution And Acceptance Of Works, Bills Of Quantities Mention Polish Standards, It Should Be Understood As Polish Standards Transposing European Or Equivalent Standards Or Standards Of Other Member States Of The European Economic Area Or Equivalent Or Other Standards Or Documents, Referred To In Art. 101 Sec. 1 Point 2 Of The Act.9. Materials, Equipment And Devices Used To Perform The Contract Should Meet The Quality Requirements Of Products Admitted To Trading And Use In Construction, As Specified In The Act Of 7 July 1994 Construction Law (I.E. Journal Of Laws Of 2023, Item 682 Of As Amended), The Act Of 16 April 2004 On Construction Products (I.E. Journal Of Laws Of 2021, Item 1213) And The Requirements Of The Technical Specification, Performance And Acceptance Of Works And Swz.10. Prior To The Incorporation Of The Materials, The Contractor Shall Submit Their Patterns And Technical Sheets For Approval To The Supervision Inspector And The Employer Confirming The Compliance Of The Technical Parameters With The Construction And Executive Design.
