The Subject Of The Order Includes The Repair Of Lean Lift Devices With Serial Numbers 229.032/3-5, 229.032/4-5, 229.032/5-5: A) Of The Rack No. 229.032/3-5 Consisting In The Replacement Of Elements: - M1 Ll Gearmotor -300,- Horizontal Chains For Vertical Movement Ll-340,- Spiral Signal Cable X9-50,- Spiral Power Cable X9-60.B) Of The Rack No. Ll-330,- X9-50 Spiral Signal Cable,- X9-60 Spiral Power Cable,- Extractor Horizontal Movement Chain (Set) Ll-217,- Guide In The Access Window Ll-090,- Vertical Movement Chain Tensioners (Set) Ll-332.C) Shelving No. 229.032/5-5 Consisting In The Replacement Of Elements: - X9-50 Spiral Signal Cable, - X9-60 Spiral Power Cable, - Horizontal Extractor Movement Chain (Set) Ll-217, - Guide In The Window Ll-090,- Shelf For Lean Lift 2460/825/250*. 2 Repairs Will Be Carried Out In An Active Facility, Which Is A Public Utility Building. The Contractor Acknowledges That The Active Facility Is Not Expected To Be Shut Down. The Organization Of Works Must Take Into Account The Specificity Of The Facility, The Consequent Limitations And Must Not Interfere With The Operation Of The Facility. Prior To The Commencement Of Works, A Work Organization Plan Should Be Submitted To The Employer For Approval, Ensuring The Least Nuisance For The Facility.3 A Detailed Description Of The Subject Of The Contract, The Scope And The Method And Requirements For The Implementation Of The Contract Are Specified In The Draft Provisions Of The Contract - Contract Template, Hereinafter Also Referred To As The Contract Template, Constituting Annex 2 To Swz.4. In The Proceedings In Question, The Contracting Authority Applies The Social Clause Pursuant To Art. 95 Sec. 1 Of The Public Procurement Law. The Employer Requires That The Persons Performing The Subject Of The Contract And Performing Activities Related To The Repair Of The Racks Are Employed By The Contractor Or Subcontractor, On The Basis Of An Employment Contract, In Accordance With The Act Of June 26, 1974 - Labor Code (Journal Of Laws Of 2020, Item 1320, As Amended). The Method Of Documenting The Employment Of These Persons, The Employers Rights To Control This Employment And Sanctions For Failure To Meet These Requirements Are Included In The Contract Template Constituting Appendix 2 To The Tor. Parts, As Such A Division Would Result In Excessive Technical Difficulties And Excessive Costs Of Performing The Contract. The Need To Coordinate The Activities Of Various Contractors Performing Individual Parts Of The Contract Could Seriously Jeopardize The Proper Performance Of The Contract, Because The Subject Of The Contract Is Homogeneous And There Is No Possibility Of Separating Its Parts. In Addition, We Would Like To Inform You That The Value Of The Contract Indicates That Contractors From The Small And Medium-Sized Enterprise Sector May Apply For It.6. Pursuant To 3 Sec. 5 Of The Contract Template, The Contractor Is Obliged To Have A Civil Liability Policy For The Conducted Activity For The Sum Insured Not Less Than Pln 100,000.00 (In Words: One Hundred Thousand Zlotys 00/100), For The Entire Duration Of The Contract.7. The Ordering Party Informs That It Intends To Allocate The Gross Amount Of Pln 169,543.45 To Finance The Awarded Contract.8. Guarantee And Warranty: The Contractor Will Provide A Guarantee For The Completed Subject Of The Contract For A Minimum Period Of 24 Months. The Contractor May Propose To Extend The Warranty Period For The Completed Subject Of The Contract To 48 Months. The Warranty Period For The Completed Subject Of The Contract Is A Criterion For Evaluating Tenders - See Chapter Xiv Of The Swz. Regardless Of The Rights Arising From The Guarantee, The Ordering Party Is Entitled To Rights Under The Warranty For Physical And Legal Defects Of Things In Accordance With The Provisions Of The Civil Code, Starting From The Date Of Signing The Acceptance Report, After Completion Of The Subject Of The Contract - 10 Section 3 Of The Contract Template.9. The Ordering Party Does Not Provide For The Possibility Of Awarding Contracts Pursuant To Art. 214 Sec. 1 Point 7 Of The Public Procurement Law. 10. Subcontractors: All Regulations And Requirements Regarding Subcontracting Have Been Included By The Ordering Party In The Contract Template, Constituting Appendix 2 To The Swz.
