The Subject Of The Contract Is The Performance Of The Function Of A Substitute Investor For The Implemented Task Entitled: Adaptation Of Part Of The School Premises For The Local Government Kindergarten In G uszyca. The Service Is Related To The Organization, Coordination, Supervision, Management Of The Investment Process, Enforcement Of Powers, Warranties And Guarantees From The Contractor Of Construction Works.2. The Subject Of The Contract Includes Acting As A Substitute Investor As Part Of Investors Supervision For The General Construction Industry, Sanitary Industry, Electrical Industry And Road Industry During The Adaptation Of Part Of The School Premises For Kindergarten Samorz dowe Ul. Grunwaldzka 37 In G uszyca. 3. The Scope Of Activities Includes In Particular: Organization, Coordination And Supervision - From Checking The Design Documentation To Construction Works, Construction Law (I.E. Journal Of Laws Of 2023, Item 682, As Amended); B) Coordination Of The Activities Of The Investors Supervision Inspector; C) Keeping Documentation Of The Conducted Supervision In The Form Of Meeting Minutes; D) Making Regular Entries Construction Log; E) Solving Problems Related To The Technology Of Conducting Works, Possibly Initiating Meetings As Part Of Current Needs; F) Participating In Warranty Inspections For The Duration Of The Warranty And Guarantee Granted By The Contractor Of Construction Works, Enforcing The Employers Rights Under The Guarantee And Warranty; G) Reporting And Justifying The Notification Of Defects And Faults Of The Contractor Of Construction Works.3. The Substitute Investor And His Supervision Team As The Employers Representative: 1) Acts On Its Behalf And Is Responsible For The Implementation Of The Investment In Accordance With The Provisions Of The Construction Law, Public Procurement Law And The Conditions Set Out In The Contract; 2) Makes Decisions In All Matters Related To The Interpretation Of The Design Documentation, Specifications And Matters Related To The Contractors Acceptance Of The Fulfillment Of The Terms Of The Agreement, Proper Legal Interpretation Of All Facts And Events That Have Occurred;3) Bears Responsibility For The Compliance Of The Material Scope Contained In The Design Documentation With The Material Scope Specified In The Contract With The General Contractor. He Is Authorized To Issue Recommendations Resulting From The Design Documentation And Technical Knowledge In Order To Properly Perform The Scope Of Works. The Ordering Party Shall Not Make Any Binding Decisions In This Regard Without Its Consent; 5) The Contractor And The Investors Supervision Inspectors Are Not Authorized To Make Independent Decisions Regarding The Commissioning Of Additional, Replacement Or Abandoned Works.4. The Substitute Investor Will Be Obliged To Ensure Systematic Monitoring Of The Investment Implementation And To Immediately Inform The Employer Of Any Irregularities.5. The Substitute Investor Will Organize Full-Discipline Construction Councils, Depending On The Needs, But Not Less Frequently Than Once A Week And At Each Request Of The Employer. 6. Each Of The Supervision Inspectors Is Obliged To Be Present At The Construction Site At Least Once A Week (Except For The Obligatory Full-Discipline Construction Council), Confirmed By An Entry In The Construction Logbook Or Attendance List.7.
