The Subject Of The Contract Is The Construction Of A Water Sports Marina At Lake Paprocańskie Along With Technical Infrastructure, Construction Of Water Facilities: Piers, Retaining Walls Of The Quay, Rainwater Drainage Outlet, Lighting Installation And Construction Of A Maneuvering Yard At The Water Intake Point. The Scope Of The Subject Of The Contract Also Includes The Demolition Of Existing Buildings And Water Facilities. The Intention Includes: 1. The Building Of The Marina Water Sports Marina: - Demolition Of Two Existing Sailing Club Buildings, Along With The Fence, - Liquidation Of The Septic Tank, - Construction Of The Marina Water Sports Marina Building With Retaining Walls, - Construction Of Earth Embankments, - Construction Of A Solid Waste Storage Site, - Hardening Of The Area, Including A Fire Road And Assembly Square, With A Mast, - Construction Of A Sanitary Sewage Pumping Station, - Assembly Of Landscaping Elements: Seats, Bicycle Racks, Waste Bins, - Construction Of Internal Installations, External Networks And Power Connection, - Lighting And Monitoring Of The Facility, - Installation Of Photovoltaic Panels In The Area, - Felling Of Trees Colliding With The Investment Being Carried Out, - Replacement Plantings, - Planting Greenery.2. Water Facilities: - Demolition Of The Existing Piers, - Demolition Of The Existing Slipway For Launching Water Equipment, - Demolition Of The Quay Retaining Walls, - Construction Of Two Floating Piers, - Construction Of A Slipway With A Technical Platform, - Hardening Of The Area, - Construction Of A Rainwater Drainage Outlet To The Lake With Section Of The Sewage System, - Lighting System, - Water And Power Distribution Points At The Piers, - Construction Of Retaining Walls Of The Quay.3. Maneuvering Yard At The Water Intake Point: - Construction Of The Maneuvering Yard At The Water Intake Point, - Restoration Of The Mineral Path. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Contracting Authority. In This Case, The Contractor Shall Attach To The Offer Documents Confirming The Equivalence Of The Solutions Offered. The Burden Of Proving Equivalence Rests With The Contractor. The Contractor Shall Demonstrate Equivalence By Any (Credible) Means. Failure To Demonstrate Equivalence Results In Rejection Of The Offer As Inconsistent With The Terms Of The Contract. The Contracting Authority Requires The Contractor Or Subcontractor To Employ All Persons Performing Construction Works Under The Supervision Of The Construction Site Manager By The Contracting Authority. The Contracting Authority Reserves The Obligation For The Contractor To Personally Perform Key Parts Of The Contract, I.E. Together With Retaining Walls, In The Scope Of Structural Elements To The Open Shell. The Above Should Be Performed By The Contractor Personally (Without The Participation Of Subcontractors). The Contractor Is Obliged To Complete The Subject Of The Contract Within 24 Months From The Date Of Concluding The Contract, Together With Obtaining The Occupancy Permit, Observing The Deadlines For The Implementation Of Individual Milestones And Observing The Following Intermediate Dates:A ) Felling Of Trees By November 30, 2023 B) Installation Of Nesting Boxes By November 30, 2023 And Submission Of A Report On The Activities Performed To The Contracting Authority By December 29, 2023 C) Replacement Planting By October 21, 2024 Reliance On Resources Other Entities.1. In Order To Confirm The Fulfillment Of The Conditions For Participation In The Procedure, In Appropriate Situations And In Relation To A Specific Contract Or Part Thereof, The Contractor May Rely On The Technical Or Professional Abilities Or Financial Or Economic Standing Of The Entities Providing Resources, Regardless Of The Legal Nature Of The Connecting Parties Legal Relationship With Them.2. With Regard To The Conditions Related To Education, Professional Qualifications Or Experience, Contractors May Rely On The Capacities Of Entities Providing Resources If These Entities Perform Works Or Services For Which These Capacities Are Required, Subject To Key Parts Of The Contract (Point 3.17 Of The Swz). 3. An Economic Operator That Relies On The Capabilities Or The Situation Of Entities Providing Resources Shall Submit, Together With Its Tender, An Undertaking By The Entity Providing Resources To Place At Its Disposal The Necessary Resources For The Purposes Of The Performance Of A Given Contract, Or Other Subjective Means Of Evidence Confirming That The Economic Operator, While Performing The Contract, Will Have At Its Disposal The Necessary Resources Of These Entities (Annex 2A To Swz).4. The Contracting Authority Will Assess Whether The Technical Or Professional Abilities Or Their Financial Or Economic Standing Made Available To The Contractor By The Entities Providing The Resources Allow The Contractor To Demonstrate Compliance With The Conditions For Participation In The Procedure Referred To In Chapter 6, And Will Also Examine Whether There Are Exclusions That Have Been Provided For The Contractor, I.E. On The Basis Of The Documents Referred To In Point 7.8. Swz.5. The Entity That Has Undertaken To Make The Resources Available Shall Be Jointly And Severally Liable With The Economic Operator, Based On Its Financial Or Economic Situation, For The Damage Suffered By The Contracting Authority As A Result Of Failure To Make The Resources Available, Unless The Entity Is Not At Fault For The Failure To Provide The Resources.6. The Economic Operator May Not, After The Deadline For Submission Of Tenders, Refer To The Capacities Or The Situation Of The Entities Providing Resources, If At The Stage Of Submitting Tenders It Did Not Rely In A Given Scope On The Capacities Or The Situation Of The Entities Providing Resources. Continued From Section Ix - Other Informationh) In The Event Of Ordering Additional Works Pursuant To Art. 455 Of The Public Procurement Law Or Other Works Necessary For The Proper Performance Of The Basic Order, I) If The Design Documentation On The Basis Of Which The Subject Of The Contract Is Implemented Contains Errors, Shortages Or Defects Not Attributable To The Contractor, Or Has Been Changed For Other Reasons, Such As Improving The Functionality Of The Facility, J) In The Event Of A Significant Extension Of The Public Procurement Procedure, Including The Extension Of The Appeal Procedure Before The National Appeals Chamber, Provided That The Extension Affected The Execution Of The Contract.12. The Condition For Introducing Changes To The Concluded Contract, Referred To In Point 11, Will Be Confirmation Of The Circumstances In A Descriptive And Properly Substantiated Form, Accepted By Each Of The Parties To The Contract.13. In The Event Of The Circumstances Referred To In Point 11, The Parties Agree On New Deadlines For The Performance Of The Subject Of The Contract, Taking Into Account The Impact Of These Circumstances On The Date Of Performance Of The Subject Of The Contract, I.E.: A) - D) And Point. H) And Lit. I) The Deadline May Be Changed By The Number Of Days Of Delay In Construction Works Caused By These Circumstances, B) In Relation To The Circumstances Specified In Point 11 Letter E) The Deadline May Be Changed By The Number Of Days In Which The Performance Of All Or Part Of The Works Affecting The Completion Date Was Impossible Or Significantly Hindered As A Result Of The Actions Of Public Administration Bodies, F) And G) The Deadline May Be Changed By The Number Of Days Of Delay In Obtaining From The Relevant Institutions And Bodies Or Third Parties The Necessary Arrangements, Permits, Decisions, Etc., Or In Obtaining Consents, Admissions And Certificates Enabling The Facility To Be Put Into Use, D) With Regard To Circumstances Specified In Point 11 Letter J), The Deadline May Be Changed By The Number Of Days Of Extending The Public Procurement Procedure, Including Appeal Proceedings Before The National Appeals Chamber, In Relation To The Normal, Foreseeable Or Legal Duration Of These Proceedings.14. Any Changes To This Agreement Should Be Made In Writing (An Annex Signed By Both Parties) Under Pain Of Nullity.
