The Order Includes: A) Development Of Project Documentation In Accordance With The Fup, Together With Obtaining A Building Permit, Including: - Preparation Of A Map For Design Purposes, - Obtaining A Public Purpose Decision, - Obtaining An Environmental Decision, - Development Of A Construction Project To The Extent Necessary To Obtain A Permit For Construction, - Preparation Of A Technical Design, - Preparation Of Bills Of Quantities, - Execution Of Geological Surveys, - Obtaining Water Law Permits, - Development Of Traffic Organization Designs For The Construction Period, - Other Required Opinions, Permits And Arrangements. B) Construction Of A Distribution Water Supply Network: - Construction Of A Distribution Water Supply Network Made Of Pe(Rc) 160 Mm Pipes With Fittings (Dn 100 Mm Hydrants), Krzyżewo; Areas And Road Lanes. A Detailed Description Of The Entire Subject Of The Contract Is Included In The Functional-Utility Program (Hereinafter Referred To As Pfu). This Documentation Is Attached To The Contract Notice And Is Available On The Website Of The Procedure. If The Documentation Would Indicate Trademarks, Patents Or The Origin Of Materials And Devices, The Ordering Party - In Accordance With Art. 99 Sec. 5 Of The Public Procurement Law - Allows The Submission Of Equivalent Products. All Products From Specific Manufacturers Define The Minimum Quality Parameters And Functional Characteristics That The Goods Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only A Quality Standard Of The Subject Of The Order. By The Provision Concerning The Minimum Requirements Of Quality Parameters, The Ordering Party Understands The Requirements Of The Goods Contained In Publicly Available Sources, Catalogs And Websites Of Manufacturers. The Use Of Exemplary Names Of The Manufacturer Is Only Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. Thus, The Use Of The Names Of Manufacturers/Products Is For Illustrative Purposes Only. The Contracting Authority, Indicating In The Description Of The Subject Of The Contract, The Designation Of A Specific Manufacturer/Supplier Or A Specific Product, At The Same Time Allows Equivalent Products With Quality Parameters And Functional Characteristics At Least At The Level Of The Parameters Of The Indicated Product, Thus Recognizing Each Product With The Parameters Indicated Or Better. In Such A Situation, The Ordering Party Requires The Submission Of Relevant Documents To Authenticate These Materials Or Devices. They Will Be Assessed By The Author Of The Design Documentation, Who Will Prepare An Appropriate Opinion. This Opinion Will Be The Basis For The Ordering Party To Make A Decision On Accepting The Equivalents Or Rejecting The Offer Due To Their Non-Equivalence. Subjective Means Of Evidence: In The Case Of Using Materials, Devices, Products Or Equivalent Solutions Within The Meaning Of Art. 99 Sec. 5 Of The Public Procurement Law, The Contractor Is Obliged To Indicate Them In The Tender And To Submit Technical Sheets Or Other Documents Confirming That The Equivalent Solutions Meet The Requirements Of The Employer Described In The Subject Of The Contract, I.E. That They Meet The Criteria Specified In The Description Of The Subject Of The Contract Used To Assess Equivalence. If The Contractor Fails To Submit The Above Documents Or Submitted Documents Will Be Incomplete (Thus Not Confirming The Equivalence Of The Offer In The Scope Described In The Description Of The Subject Of The Contract), The Ordering Party Will Not Call For Their Submission/Supplementation. Pursuant To Art. 101 Sec. 4 Of The Public Procurement Law, When The Documents Describing The Subject Of The Contract Contain References To Standards, Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Sec. 3 Of The Public Procurement Law And Such References Were Not Accompanied By The Phrase Or Equivalent, The Employer Allows Solutions Equivalent To Those Described In Each Such Standard, Technical Assessment, Approval, Technical Specification, Technical Reference System. In Connection With The Above, It Should Be Assumed That Each: Standard, Technical Assessment, Approval, Technical Specification, System Of Technical References Appearing In The Description Of The Subject Of The Contract Is Accompanied By The Words Or Equivalent. According To Art. 101 Sec. 5 Of The Public Procurement Law, The Contractor Who Refers To Solutions Equivalent To Those Described In These Documents Is Obliged To Prove, By Attaching To The Offer Relevant Evidence Referred To In Art. 104-107 Of The Public Procurement Law That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract To An Equivalent Degree.
