The Medical Unit, As The Contracting Authority, Initiates This Procedure With The Object Purchase Of Medical Equipment To Equip The Codlea Municipal Hospital, Lots 1,2,3,4, Respectively Lot 1 According To The Specifications In The Specifications, Including Annexes Lot 2, According To The Specifications In The Specifications, Including Annexes Lot 3, According To The Specifications In The Specifications, Including Annexes Lot 4, According To The Specifications In The Specifications, Including Annexes We Make It Clear That The Contracting Authority Has Submitted A Funding Request To The Ministry Of Health Through The Public Health Directorate Of Brasov County, And Co-Financing Of 10% From The Local Budget Of The Municipality Of Codlea, For Which In Order To Streamline The Process Of Contracting Medical Equipment And Equipment Protection, This Public Procurement Procedure Is Initiated Under The Incident Of The Suspensive Clause, In The Sense That The Conclusion Of The Public Procurement Contract Is Conditional On The Allocation Of Budget Credits For This Purpose, The Signing Of The Contract Being Done In Compliance With The Provisions Relating To The Commitment Of Expenses From The Budgets That Fall Under The Legislation On Finances Public. Taking Into Account The Provisions Of Law 98/2016 On Public Procurement And H.G. No. 395/2016, With Subsequent Amendments And Additions, The Contracting Authority Specifies That It Will Conclude The Contract With The Bidder Declared The Winner Only To The Extent That The Funds Necessary For The Purchase Will Be Secured By Allocating Budget Credits For This Purpose. In Case, Regardless Of The Reasons, The Budget Credits Will Not Be Allocated, The Contracting Authority, After Receiving The Notification Regarding The Non-Awarding Of The Financing, From The Ministry Of Health, Reserves The Right To Cancel The Awarding Procedure, Provided That There Is No Another Source Of Financing, In Accordance With The Provisions Of Art. 212 Paragraph (1), Letter C) Sentence 2 Of Law 98/2016 With Subsequent Amendments And Additions, It Being Impossible To Conclude The Public Procurement Contract. Bidders Within This Procedure Understand That The Authority The Contracting Party Cannot Be Held Liable For Any Damage In The Event Of The Cancellation Of The Award Procedure, Regardless Of Its Nature And Regardless Of Whether The Contracting Authority Has Been Notified Of The Existence Of Such Damage. Bidders Within This Procedure Accept The Use Of The Above Special Conditions, Assuming Full Responsibility In Relation To Any Damages They May Suffer In The Described Situation.
