Work Detail
The Subject Of The Contract Is The Reconstruction Of The Existing Boiler Room Along With The Execution Of Gas Supply To New Gas Boilers Located In The Boiler Room Of The Building Of The School And Kindergarten Complex Located In Wilcza At Ul. Karola Miarki 27. The Scope Of Works Has Been Divided Into Two Stages. Stage I Includes In Particular: 1) Laying A Gas Installation, Made Of Electrofusion-Welded Pe Pipes And Steel Pipes Joined By Welding, Running (In The Outer Part In The Excavation, In The Inner Part On The Walls) From External Junction Box (Connection Prepared By The Gas Plant) To The Existing Boiler Room; 2) Reconstruction Of The Boiler Room Consisting In The Disassembly Of The Existing Oil Boilers Together With The Flue Gas Discharge System And Automation; 3) Liquidation Of The Oil Storage, I.E. Connected To The Boilers; 4) Disassembly Of The Existing Flue Gas System; 5) Installation Of A New Heat Source In The Form Of Condensing Gas Boilers In A Cascade System Together With Circulation Pumps And Fittings; 6) Checking, Possible Unblocking Or Modernization Of The Boiler Room Ventilation; 7) Execution Of A Collector Single-Wall Chimney System In Place Of The Dismantled Flue Gas System; 8) Electrical Power Supply For The Boiler Rooms Electrical Switchboard And Technical Room; 9) Installation Of An Active Gas Safety System; 10) Leak And Pressure Tests And Chimney Sweep Acceptance; A) Removal And Disposal Of Earth Masses, Rubble And Dismantled Elements; B) Restoring The Area To Its Original Condition And Building Elements Damaged As A Result Of The Works; Use. 2. Other Provisions Regarding The Subject Of The Contract: 1) The Detailed Scope Of The Contract Is Described In The Technical Documentation (I.E. In Particular: Construction Design, Technical Specification For The Execution And Acceptance Of Construction Works, Bill Of Quantities, Arrangements Of Network Administrators And Issued Connection Conditions To The Network And Existing Infrastructure ) Constituting Appendix No. 1 To The Swz. In The Event Of Discrepancies In The Technical Documentation, The Provisions According To The Following Hierarchy Of Documents Are Binding: A) Construction Design; B) Technical Specification For The Execution And Acceptance Of Construction Works (Hereinafter: Stwiorb); C) Bill Of Quantities. Due To The Fact That The Contractors Remuneration Is A Lump Sum, When Valuing The Offer, The Contractor Should Rely On The Scope Indicated In The Design Documentation And Stwiorb. The Bill Of Quantities Is Auxiliary. Occurrence Of Works Not Included In The Bill Of Quantities During The Execution Of The Order Or In The Event Of Works Occurring In A Larger Quantity Than In Any Item Of The Bill Of Quantities Will Not Entitle The Contractor To Demand Additional Remuneration, And The Contractor Shall Perform The Works Under The Standard Contractual Risk - If These Works Were Included In The Design Documentation Or Stwiorb. The Contractor Is Obliged To Carefully Check The Number Of Works With The Design Documentation And Stworb. A Possible Lack Of The Bill Of Quantities Of Works Necessary To Be Performed Resulting From The Design Documentation Or Stwiorb Does Not Release The Contractor From The Obligation To Perform Them At The Contractual Price. The Technical Documentation Referred To Above Has Been Developed By The Design Group Marwit: Sp. Z O.O., 44-100 Gliwice, Ul. Częstochowska 16.2) The Contract May Be Applied For By Contractors Whose Knowledge And Experience Will Allow For The Proper Performance Of The Contract; 3) The Contract May Be Applied For By Contractors Whose Technical Potential Will Allow For The Proper Performance Of The Contract, Specified In The Subject And Scope Of The Task; 4) The Contractor In His Own Within The Scope And At Its Own Expense, It Provides: A) Storage Of All Materials Needed To Perform The Order, B) Delivery Of All Materials Needed To Perform The Order To The Place Indicated By The Ordering Party, C) Removal And Possible Disposal Of Materials Created During The Execution Of The Order, Execution Of The Order;5) The Condition For The Final Acceptance Is Prior Partial Acceptance And The Contractors Obtaining A Decision On The Occupancy Permit.3. Requirements For Accessibility For People With Disabilities And Design For All Users, In Accordance With Art. 100 Sec. 1: The Subject Of The Contract Concerns Construction Works And Technological Installations That Do Not Introduce Any Changes In The Way The Facility Is Used, Including Accessibility For The Disabled. 4. Before Signing The Contract, The Contractor Shall Submit To The Contracting Party A Detailed Cost Estimate Indicating The Method Of Calculating The Offer Price, Broken Down Into Industries And The Material Scope Of The Contract, Specifying The Price-Generating Components. The Cost Estimate Will Be Used To Calculate The Remuneration Due To The Contractor, In Particular In The Case Of: 1) Withdrawal From The Contract, 2) Resignation From Performing Part Of The Subject Of The Contract, 3) Ordering Additional Works Not Included In The Technical Documentation, 4) Replacement Works And The Need To Change The Remuneration Related To These Works 5) Settlement Of Completed Stages.5. Within 5 Working Days From The Date Of Concluding The Contract, The Contractor Is Obliged To Prepare And Submit To The Ordering Party A Material And Financial Schedule, Hereinafter Referred To As The Schedule, For Approval. The Employer Shall Approve Or Submit Comments To The Schedule Within 5 Working Days From The Date Of Submission Of The Schedule By The Contractor. The Contractor Is Obliged To Adapt The Schedule To The Employers Indications Within 5 Working Days From The Date Of Receipt Of Comments And Objections. The Schedule Should Include In Particular: 1) The Dates Of Commencement And Completion Of The Implementation Of Individual Stages, 2) The Value Of Works Provided For In Each Stage As For The Entire Task. Contract (Provided That It Does Not Lead To A Change In The Content Of The Contract). Changing The Schedule Requires The Consent Of Both Parties To The Contract.6. Below, The Ordering Party Specifies The Activities Related To The Performance Of The Contract By Persons Employed By The Contractor Or Subcontractor Under An Employment Contract, In The Circumstances Referred To In Art. 95 Of The Public Procurement Law: 1) Performing Earthworks; 2) Performing Construction And Assembly Works; 3) Performing Installation Works In The Field Of Heating Installations; 4) Performing Installation Works In The Electrical Specialty; 5) Performing Installation Works In The Sanitary Specialty. With Regard To Contractors Based Outside Poland, The Ordering Party Allows The Employment Of Employees On The Basis Of Equivalent Legal Regulations Of The Home Country.7. The Contractor Is Obliged To Perform The Order Under The Terms And Conditions Described In The Draft Provisions Of The Public Procurement Contract - Contract Template Constituting Appendix 2 To The Tor. Offers With Equivalent Solutions: Indications For Technical Devices And Materials Presented In The Technical Documentation, With The Manufacturer, References To Standards , Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Article 101 Of The Public Procurement Law Should Be Treated As Exemplary. The Employer Allows Solutions Equivalent To Those Described. This Means That Contractors May Propose Solutions Other Than Those Specified In The Documentation, While Maintaining Appropriate Equivalent Technical Parameters To Achieve The Expected Functionality Of The Entire System Being The Subject Of The Contract, Ensuring That Any Necessary Arrangements Are Obtained. The Use Of A Label In The Technical Documentation Means That The Employer Accepts All Labels Confirming, That The Given Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Employer. In The Event That The Contractor, For Reasons Beyond His Control, Cannot Obtain The Label Or Equivalent Label Specified By The Ordering Party, The Ordering Party, Within The Time Limit Set By Him, Accepts Other Relevant Evidence, In Particular The Manufacturers Technical Documentation, If The Given Contractor Proves That The Construction Works Or Services To Be Performed By It Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party. The Use In The Technical Documentation Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or A Test Report Carried Out By This Body As Evidence Confirming Compliance With The Requirements Or Characteristics Specified In The Description Of The Subject Of The Contract, Tender Evaluation Criteria Or Contract Performance Conditions Means That The Contracting Authority Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Bodies. The Employer Also Accepts Other Appropriate Means Of Proof, In Particular The Manufacturers Technical Documentation, And If A Given Contractor Does Not Have Access To Certificates Or Test Reports, Or The Possibility Of Obtaining Them In A Timely Manner, Unless This Lack Can Be Attributed To A Given Contractor And Provided Provided That The Given Contractor Proves That The Construction Works, Supplies Or Services Performed By Him Meet The Requirements Or Criteria In The Description Of The Subject Of The Contract, Criteria For The Evaluation Of Tenders Or Requirements Related To The Performance Of The Contract. The Need To Use Specific Equipment With Specific Parameters When Performing The Order, The Ordering Party Allows The Use Of Other Equipment, Provided That It Ensures The Achievement Of The Assumed Design Parameters And Does Not Cause The Risk Of Non-Compliance Of The Performed Works With The Technical Documentation.
