1. The Subject Of The Contract Is The Implementation Of The Investment Task Entitled Improvement Of The Water, Sewage, Road And Recreational Infrastructure Of The Former State-Owned Farm In Rszew In Konstantynów Łódzki, On The Plot With Registration Number 484/6, Precinct K-21 Konstantynów Łódzki, Konstantynów Łódzki Commune, Pabianice Poviat.2. The Material Scope Of The Contract Includes In Particular: 1) Preparation Of Design Documentation, To The Extent Necessary For The Implementation Of The Investment Task, Together With Obtaining A Decision Authorizing The Execution Of Construction Works In Accordance With Applicable Regulations (Decision On The Building Permit / Or Notification Of Works), As Well As Any Other Administrative Decisions, Arrangements And Opinions Necessary For The Implementation Of The Investment, As-Built Documentation (Hereinafter Also Referred To As Design Documentation) And Authors Supervision During The Implementation Of Works Performed On The Basis Of The Prepared Design Documentation, Referred To In Art. 20 Sec. 1 Point 4 Of The Act Of July 7, 1994 Construction Law (I.E. Journal Of Laws Of 2021, Item 2351, As Amended), 2) Execution Of Construction Works On The Basis Of Design Documentation Developed By The Contractor And Approved By The Employer Consisting In The Performance Of The Subject Of The Contract And Obtaining A Permit For The Use Of The Completed Investment Task. The Construction Works Include, Among Others: - Construction Of A Biological Sewage Treatment Plant In The Technology Of Rotating Biological Beds, Serving Up To 160 Pe And With A Flow Rate Of Up To 30 M3/D, Together With A Section Of Sewage System Sewage System Supplying Sewage To The Treatment Plant And Discharging Sewage To The Existing Canal Discharging Treated Sewage To The Receiver, Including Technical And Technological Start-Up, - Construction Of A Slope Around The Sewage Treatment Plant, - Construction Of A Sewage Pumping Station In Front Of The Sewage Treatment Plant (Or Modernization Of The Existing Pumping Station) Along With The Installation Of A New Basket Grate, - Construction Measuring Chamber (Well) Of Treated Wastewater With Equipment, - Construction Of Electrical Installations Supplying The Designed Technological Facilities As Well As Control And Measurement Equipment And Automation (Akpia), - Construction Of Pavements In The Sewage Treatment Plant And Fencing Of The Sewage Treatment Plant Area Together With The Entrance Gate, - Cleaning Of The Sewage Collection Ditch Cleared Of The Sewage Treatment Plant, - Construction Of Area Lighting (Led Lanterns - 2 Pcs.), - Construction Of An Access Road To The Sewage Treatment Plant Made Of Concrete Cubes, - Expansion Of The Playground By Installing Small Architecture Objects, I.E. Two New Playground Equipment, Benches, A Trash Can And Assembly New Regulations With A Metal Structure, - Construction Of A Playground Fencing, - Disassembly Of The Tank Of The Existing Sewage Treatment Plant And Tidying Up The Area, - Construction On The Existing Dn200 Channel, Collecting Sewage From Buildings At Ul. Klonowa No. 79, 81, 83, An Inspection Chamber Enabling Flushing Of The Canal, - Making And Setting Up An Information Board In Accordance With The Assumptions Of The Polish Governance Fund: Strategic Investment Program.3. The Order Should Be Implemented In Accordance With The Functional-Utility Program (Pfu) With Attachments, Constituting Appendix No. 9 To The Tor And On The Terms Set Out In Appendix No. 8 To The Tor - Contract Template.4. The Contractors Remuneration Is A Lump Sum, Which Is Equivalent To The Contractors Performance Described In The Fup. 5. All Performed Works And Delivered Materials Will Comply With Fup. In The Event That Materials Or Works Do Not Fully Comply With The Fup And This Affects The Unsatisfactory Quality Of Construction Works, Such Materials Will Be Replaced With Others, And The Completed Elements Will Be Dismantled And Rebuilt At The Contractors Expense. 6. Guarantee. The Duration Of The Quality Guarantee Period For The Construction Works Performed And The Materials/Devices Used/Delivered, Which The Contractor Grants To The Ordering Party, Is One Of The Tender Evaluation Criteria, Which Will Be Assessed In Accordance With Chapter Xxi Point 2.2 Of The Swz. The Employer Sets The Minimum Required Term For The Quality Guarantee Provided By The Contractor For The Construction Works Performed And The Materials/Devices Used/Delivered For A Period Of 48 Months (4 Years), Counting From The Date Of Final Acceptance Of The Works, Excluding The Installed Play Equipment (Playground Equipment), For Which A 36-Month Quality Guarantee Period Is Required, And With The Exception Of Installed Equipment/Subassemblies Of The Sewage Treatment Plant, For Which A 24-Month Quality Guarantee Period Is Required.7. Accessibility Requirements. Pfu Meets The Requirements For Accessibility For People With Disabilities And Design For All Users In Accordance With The Provisions Of The Construction Law And Executive Regulations. Playground Equipment Should Be Selected So That It Can Serve Children Of Different Age Groups And With Different Levels Of Physical And Intellectual Fitness. The Area Intended For The Installation Of New Play Equipment Should Not Pose Obstacles To Accessibility For People Using Them.8. Equivalent Solutions. In Each Case Of Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Par. 3 Of The Public Procurement Law, The Contractor Should Assume That Such A Reference Is Accompanied By The Words Or Equivalent. If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Fup, The Employer Allows Solutions Equivalent To Those Described. When Analyzing The Fup, The Contractor Should Assume That Each Reference Used In The Fup Is Accompanied By The Word Or Equivalent. If Trademarks Are Used In The Fup, This Means That They Are Given As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Qualitative Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Fup. Equipment And Materials Meet The Requirements Specified By The Employer. The Use Of A Label In The Fup Means That The Employer Accepts All Labels Confirming That The Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Employer. May Obtain A Label Or An Equivalent Label Specified By The Contracting Authority, The Contracting Authority, Within The Time Limit Set By It, Accepts Other Relevant Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Given Economic Operator Proves That The Works, Supplies Or Services To Be Performed By It Made, Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Ordering Party. Use In The Fup Of The Requirement To Have A Certificate Issued By A Conformity Assessment Body Or Test Reports Carried Out By This Body As Evidence Confirming Compliance With The Requirements Or Characteristics Specified In The Description Of The Subject Of The Contract, Tender Evaluation Criteria Or Conditions Of Order Performance Means That The Ordering Party Also Accepts Certificates Issued By Other Equivalent Conformity Assessment Bodies. The Employer Also Accepts Other Appropriate Means Of Proof, In Particular The Manufacturers Technical Documentation, In The Event That A Given Contractor Has Neither Access To Certificates Or Test Reports Nor The Possibility Of Obtaining Them In A Timely Manner, Unless This Lack Of Access Cannot Be Attributed To A Given Contractor , And Provided That The Contractor Proves That The Construction Works, Supplies Or Services Performed By Him Meet The Requirements Or Criteria Set Out In The Description Of The Subject Of The Contract, Criteria For The Evaluation Of Tenders Or Requirements Related To The Performance Of The Contract. If The Description Of The Subject Of The Contract Includes A Provision Indicating The Need To The Use Of Specific Equipment With Specific Parameters In The Execution Of The Order The Ordering Party Allows The Use Of Other Equipment, Provided That It Ensures The Achievement Of The Assumed Design Parameters And Does Not Cause The Risk Of Non-Compliance Of The Performed Works With The Technical Documentation.
