Work Detail

1. The Subject Of The Contract Is The Purchase And Delivery Of A Municipal Tractor With Accessories Compatible With It, I.E. A Snow Plow And A Butterfly Spreader. 2. Under The Contract, The Ordering Party Provides For Exercising The Option Right. As Part Of The Option Right, The Employer Provides For The Possibility Of Purchasing Additional Equipment Compatible With The Offered Municipal Tractor, I.E. A Drum Mower - 1 Item And/Or A Rear-Mounted Sweeper With A Basket And A Sprinkler - 1 Item. The Value Of The Option Will Result From The Offered Gross Unit Price For The Additional Equipment In The Offer Form. The Ordering Party Estimates The Value Of The Option At Pln 35,000.00, With The Proviso That The Final Value Of The Option Will Result From The Price Offered In The Offer Form. The Place Of Delivery Of Additional Equipment Under The Option Right Will Be The Same As The Delivery Of The Basic Order. 3. The Technical Parameters Of The Assortment Are Described In Annex 3 To The Swz And Constitute The Minimum Requirements Of The Ordering Party. Failure To Meet The Minimum Requirements Will Result In The Rejection Of The Offer As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Sec. 1 Point 5 Of The Public Procurement Law. 4. The Ordering Party Does Not Agree To Change The Delivered Assortment To A Different One Than The One Offered In The Tender Form Constituting Appendix 1 To The Swz, Subject To Point 5. 5. The Ordering Party Agrees To Change The Delivered Assortment To A Different One Than The One Offered In The Tender Form, In Cases Where The Contractor Demonstrates That The Offered Assortment Has Been Withdrawn From Sale Or Its Production Has Been Discontinued, There Is No Access To It On The Polish Market (Confirmed By The Manufacturer Or Sales Representative On The Polish Market) The Ordering Party Allows The Possibility Of Offering And Delivering A Different Assortment Provided That Its Technical Parameters Are Not Worse Than Those Of The Offered Product, And The Price Is Not Higher Than That Offered In The Tender Form.5.1 In The Case Referred To In Point 5, The Contractor Must Obtain The Consent Of The Ordering Party To Change The Offered Assortment. To Change The Offered Range. In Such A Case, The Contractor Will Be Obliged To Deliver The Offered Assortment In Accordance With The Content Of The Offer.5.3 The Ordering Party Will Provide The Contractor With The Consent Or Lack Thereof Referred To In Point 5.1 Or Point 5.2 In Writing. 6. The Municipal Tractor Must Be Compatible With The Equipment Provided Under The Contract, Brand New, Manufactured Not Earlier Than In 2022, Meet Polish And European Safety Requirements, And The Requirements For Driving On Public Roads, In Accordance With The Provisions Of The Road Traffic Law (I.E. Journal Of Laws Of 2021, Item 450, As Amended). 7. The Ordering Party Requires The Contractor To Indicate The Brand, Model, Version, Year Of Production, Symbol Or Other Additional Data Enabling Unambiguous Identification Of The Offered Tractor In Appendix No. 1 To The Swz (Offer Form). Failure To Enter Data In The Places Dotted In The Offer Form Will Result In The Rejection Of The Offer Pursuant To Art. 226 Sec. 1 Point 5 Of The Public Procurement Law - As Inconsistent With The Terms Of The Contract, If It Is Impossible To Specify Them From Any Document Submitted With The Tender. 8. The Ordering Party Requires That The Tractor Has Equipment Enabling The Use Of Additional Equipment Delivered With The Tractor. 9. The Contractor Is Obliged To Organize The Delivery Of The Order To Kwp Katowice At Ul. Lompy 19, At His Own Expense, With Transport Organized By Himself. 10. The Ordering Party Requires The Warranty Period To Be: 10.1 For A Municipal Tractor, A Minimum Of 24 Months With A Limit Of 1000 Motor Hours (Mth) 10.2 For Additional Equipment, A Minimum Of 12 Months 10.3 The Contractor Shall Submit The Warranty Documents On The Day Of Final Acceptance. 11. Removal Of The Defect (Completion Of The Repair) Must Take Place Immediately, But Not Later Than Within 14 Consecutive Days From The Date Of Its Notification. 12. Self-Removal Of Minor Faults And Replenishment Of Consumables May Not Result In The Loss Or Limitation Of Rights Under The Factory Warranty. 13. Periodic Inspections And Repairs Under Warranty Will Be Carried Out At Authorized Service Stations. The Employer Requires The Contractor To Indicate At Least One Authorized Service Station In The l skie Voivodship. 14. The Awarding Entity Requires The Submission Of The Relevant Evidence Specified In Point 2 Of Section Viii Swz Together With The Offer. 15. The Awarding Entity Requires The Provision Of A List Of Authorized Service Stations For A Municipal Tractor. 16. The Ordering Party Demands That The Delivered Vehicle Be Inspected By The Contractor And At His Expense, Which Must Be Confirmed In The Vehicle Documentation. 17. Common Procurement Vocabulary (Cpv): Cpv: 16 73 00 00-1 Traction Tractors 18. All Requirements Specified In The Documents Indicated Above Are Minimum Requirements And Their Fulfillment Is Obligatory. Failure To Meet The Above Minimum Requirements Will Result In The Rejection Of The Tender As Inconsistent With The Terms Of The Contract Pursuant To Art. 226 Sec. 1 Point 5 Of The Public Procurement Law.
