The Subject Of The Contract Is The Cleaning And Maintenance Of Beaches In The Kosakowo Commune In The Towns Of Mechelinki And Rewa, With A Total Length Of Approximately 3,700 M, Excluding Places Fenced Off For Conducting Business By Third Parties. 2. Cleaning And Maintenance Services Apply To The Following Beaches And Areas: 1) Area A - Is A Section Of Approximately 2700 Meters From The Beach In Mechelinki (Geographical Coordinates: 54°3646.4N, 18°3045, 4”E) To The Base Of Cypel Rewski Together With The Beach On The Promontory (Geographical Coordinates: 54°3809.1”N, 18°3051.2”E) Beach Area - Approx. 40,000 M2.2) Area B - Is A Section With A Length Of About 1000 Meters, From The Beach To The Base Of Cypel Rewa (Geographical Coordinates: 54°3809.1”N, 18°3051.2”E) To The Stone Breakwater At The Pier In Rewa (Geographical Coordinates: 54 °3755.4” N, 18°2950.6” E) Beach Area - Approx. 32,000 M2, The Total Area Of The Beaches Is Approx. 72,000 M2. 5. 3. Characteristics And Scope Of Services Constituting The Subject Of The Contract: 1) Sand Cleaning - Includes: A) Mechanical Screening Of Beach Sand To The Depth Necessary To Eliminate At Least 15 Cm Of Pollution Such As: Cigarette Butts, Household Waste, Other Organic Origin B) Aeration And Loosening Of The Sand By Turning Its Bottom Layer Over, C) Leveling Of The Beach Area In Order To Eliminate Depressions And Hills, D) Removal Of Waste And Impurities Collected As A Result Of The Above-Mentioned Activities For Storage, Neutralization Or Disposal In Accordance With Applicable Regulations. During The Term Of The Contract, The Service Will Be Provided On The Request Of The Ordering Party (Form Of Notification: E-Mail, Telephone, Text Message) (Sand Cleaning Should Take Place In The Early Morning Hours Up To 9:00 A.M. May Not Interfere With The Operation Of Bathing Areas). The Employer Provides For Approximately 17 (Seventeen) Such Treatments, Including 10 (Ten) Treatments On The Beach Of Region A, 7 (Seven) Treatments On The Beach Of Region B - Where 1 Treatment Means One Sand Cleaning Service On One Beach. 2) Sand Aeration - Includes A Set Of Mechanical Activities Aimed At Aerating The Sand And Then Leveling The Beach Surface By Harrowing And Raking, And Removing Waste And Impurities Collected As A Result Of The Above-Mentioned Activities. During The Term Of The Agreement, The Service Will Be Provided On Notification Of The Employer (Form Of Notification: E-Mail, Telephone, Sms) (Sand Aeration Should Be From Arrive Early In The Morning, Up To 9:00 A.M., While The Descent Of Machines From The Beach Area After The Work Is Completed Must Not Interfere With The Operation Of The Bathing Areas). (Seven) Treatments On The Beach Of Area B - Where 1 Treatment Means One Sand Cleaning Service On One Beach. 3) Cleaning Of Pollution From The Beach - Includes The Performance Of A Service Consisting In Removing Major Types Of Solid Waste On The Beaches, In Particular Storm Residues (E.G. Trees On Communication Crossings, Thrown Utility Equipment) Also Using The Necessary Mechanical Equipment. Cleaning Of Pollution From The Beach Will Be Carried Out On Each Request Of The Employer (Form Of Notification: E-Mail, Telephone, Text Message). The Scope Of The Service Does Not Cover Non-Standard Situations Resulting From Extraordinary Weather Phenomena (Tornado, Storm, Gales, Etc.). The Ordering Party Provides For About 10 (Ten) Such Treatments, Including 5 (Five) Treatments On The Beach Of Region A, 5 (Five) Treatments On The Beach Of Region B - Where 1 Treatment Means One Service Of Cleaning Pollution From One Beach. 1)-2). Intervention Cleaning Will Be Performed Only On Each Request Of The Ordering Party (Form Of Notification: E-Mail, Telephone, Text Message). The Employer Provides For Approximately 4 (Four) Such Treatments, Including The Employer Provides 2 (Two) Treatments On The Beach Of Region A, 2 (Two) Treatments On The Beach Of Region B - Where 1 Treatment Means One Intervention Cleaning Service From One Beach. 2. The Frequency Of Services Performed And The Type Of Treatments Performed Assumes A Break (From May 13, 2023 To June 29, 2023) In The Performance Of Services For The Duration Of Silting Works On The Beach In Rewa (Area B). The Implementation Of The Treatments Will Depend On The Work Schedule Established By The Maritime Office In Gdynia. 3. The Conditions And Requirements Regarding The Method Of Providing Sand Cleaning And Aeration Services Referred To In Par. 1 Point 1) And 2): A) The Subject Of The Contract Will Be Implemented Successively, In Accordance With The Ordering Partys Needs And At Its Request Each Time, B) The Contractor Is Obliged To Proceed With The Performance Of The Reported Service/Works Within 12 Hours From The Moment Of Submitting The Request / From Establishing A Telephone Connection Or Sending Information Via Text Message (Text Message) Or Sending An E-Mail Message (E-Mail) By An Authorized Employee Of The Ordering Party/. C) The Ordering Party Does Not Provide For The Contractor To Perform One Type Of Services/Works At The Same Time On More Than One Beach. D) The Ordering Party Provides Performance Of Different/Different Types Of Services/Works At The Same Time On More Than One Beach. E) The Ordering Party Reserves The Right To Change Or Cancel The Performance Of A Given Type Of Treatment. In Such A Case, The Ordering Party Shall Notify The Contractor Of Resignation From The Implementation Or Change Of The Planned Service At Least 8 Hours Before The Date Of Commencement Of The Performance Of A Given Service. 4. The Conditions And Requirements Concerning The Method Of Providing The Service Of Interventional Cleaning Of Pollutants From The Beach, Referred To In Par. 1 Point 3): A) The Service Will Be Performed On Each Request Of The Ordering Party (Form Of Notification: E-Mail, Telephone, Text Message); B) The Contractor Is Obliged To Start The Implementation Of The Notified Service/Work Within 12 Hours From The Moment Of Submitting The Request / From Making The Telephone Connection Or Sending Information By Message (Text Message) Or Sending A Message By E-Mail (E-Mail) By An Authorized Employee Of The Ordering Party/. 5. The Conditions And Requirements Regarding The Method Of Providing The Intervention Cleaning Service Referred To In Par. 1 Point 4): A) The Service Will Be Performed Only And Exclusively Upon Each Request Of The Ordering Party, B) The Ordering Party Requires The Contractor To Take Action In The Field Of Intervention Cleaning, Referred To In Sec. 1 Point 4) The Maximum Time To React To The Intervention Beach Cleaning Service From The Receipt Of The Request Was Up To 4 (Four) Hours (Up To 240 Minutes) From Making A Telephone Call Or Sending Information Via Text Message Or Sending A Message By E-Mail To An Authorized Representative Of The Employer . 6. After Each Performance Of The Services Referred To In Par. 1 Point 1)-4) The Works Will Be Accepted In Writing From The Contractor, In The Event Of Irregularities, The Contractor Is Obliged To Repeat The Incorrectly Performed Activity And/Or To Perform The Abandoned Activity.7. The Contractor Is Obliged Within 24 Hours Of Being Summoned To Perform The Activities Referred To In Section 1 Point 1) - 4) Incorrectly Performed And/Or Omitted Action/From Making A Telephone Connection Or Sending Information Via Text Message Or Sending A Message By E-Mail (E-Mail) By An Authorized Employee Of The Ordering Party/.8. The Ordering Party Reserves The Right To Change The Quantity And Frequency Of The Provision Of Services Or Resign From Some Of The Services Referred To In Paragraph 1 Point 1) - 4). The Indicated Quantities And Frequency Of Service Provision Were Adopted To Calculate The Estimated Value Of The Order, Which Does Not Reflect The Real Demand During The Term Of The Contract And In No Way Can Be The Basis For Any Claims On The Part Of The Contractor. 9. Throughout The Duration Of The Contract, The Ordering Party Is Entitled To Control The Performance Of The Services Covered By The Contract By The Contractor. 10. The Contractor Is Obliged To Keep A Journal Of Performed Works Throughout The Duration Of The Contract. In The Journal, The Contractor Will Record On An Ongoing Basis (I.E. On The Day Of Their Performance) All Works Performed Under This Contract. These Works Will Be Confirmed In The Journal By The Person(S) Authorized By The Employer. In Addition, The Contractor Is Obliged To Describe The Weather Conditions In The Journal. 11. The Contractor Will Be Obliged To Perform The Subject Of The Contract At His Own Expense, With The Use Of His Own Equipment, Transport. 11. The Description Of The Subject Of The Order Is Provided In Chapter No. 4 Of The Terms Of Purchase.
