1. The Subject Of The Contract Is The Design And Execution Based On The Developed Project Of Construction Works Entitled Modernization Of Park Im. Of The First Residents Of Kobylnica, Including The Construction Of The Polish Olympians Route Along The Kamieniec River In Kobylnica, Along With Ensuring The Possibility Of Using The Buildings Built As Part Of The Task In Accordance With The Construction Law, Including: 1) Preparation Of Design Documentation Constituting The Basis For The Execution Of The Construction Works Referred To In Point 2 Below, Along With Obtaining, On Behalf Of And For The Employer, The Necessary Opinions And Technical Conditions, All Arrangements, Permits, Admissions, Permits, Approvals, Administrative Decisions, Including Decisions On Environmental Conditions, Water Law Permit Decisions, Permits For The Implementation Of A Road Investment And/Or Building Permits And/Or Making Notifications Of Construction/Construction Works, If Necessary, Which Will Be Necessary To Perform The Scope Of The Contract In Accordance With The Requirements Of The Employer And The Terms Of The Contract; 2) Execution Of Construction Works Based On The Developed Design Documentation, Related To: A ) Modernization The Existing Rural Recreation Park In Kobylnica Located At Nad Śluza Street In Kobylnica In The Scope Consistent With The Concept Entitled: Modernization Of The Existing Rural Recreation Park In Kobylnica, Kobylnica, Nad Śluza Street, Plot No.: 235, 929, 767, 238, 714/ 2, 925, 923, Geodetic Precinct Kobylnica [221206_2.0005] Kobylnica Commune, Słupsk Poviat , Constituting Appendix No. 4 To The Functional And Utility Program, Hereinafter Referred To As Pfu, Constituting Appendix No. 1 To The Agreement. Within The Scope Of The Above Modernization Includes: - Reconstruction Of A Section Of The Municipal Road At Ul. Nad Śluza (Length Of The Reconstruction Of The Section Of Nad Śluką Street - From The Bridge Structure (Culvert With A Cascade) To The Intersection With Witosa Street); - Reconstruction Of Park Pedestrian Routes And Squares; - Construction Of The Surface Of The Chillout Zone; - Construction Of Park Surfaces Made Of Composite Terrace Boards On Steel Grid And Foundation Blocks; - Reconstruction Of The Equipment Of The Recreational Square; - Assembly Of Play Equipment; - Assembly Of Fitness Equipment Adapted For The Disabled (Along The Pedestrian Route Next To The Gas Station - Plot No. 714/1); - Replacement And Construction Of Landscaping Elements; - Assembly Of Benches And Seats Along Pedestrian Routes; - Assembly Of Chillout Zone Equipment; - Assembly Of Gazebo Equipment; - Arrangement Of Greenery; - Modernization Of Park Lighting; - Execution Of Overflow Damming In Existing Park Ponds Enabling Free Migration Of Water Organisms .B) Reconstruction Of Three Footbridges And A Concrete Bridge (Culvert With A Cascade) In The Rural Park In Kobylnica Located At Nad Śluką Street In Kobylnica, In The Scope Of Replacement Of Elements Of The Bridge And Footbridge Equipment, In Particular: Pavement, Curbs, Insulation Of The Platform Slab, Drainage Elements And Protective Barriers And Balustrades. C) Construction Of A Pedestrian And Bicycle Route With Three Footbridges Along The Kamieniec River In Kobylnica On The Section From Ul. Główna To Ul. Aleja Orzechowa With Lighting. D) Construction Of A Pedestrian And Bicycle Route On The Section From Ul. Aleja Orzechowa From The Intersection With Ul. Wodna By Referring To The Existing Road Infrastructure In The Lane Of Ul. Aleja Orzechowa To The Pedestrian And Bicycle Route On The Kamieniec River In The Scope Consistent With The Construction Design, Constituting Appendix 3 To The Fup. E) In The Event Of A Collision Of The Road With The Existing Technical Infrastructure, Reconstruction Or Protection Of The Existing Utilities Networks. Investment, In Accordance With The Guidelines Of The Polish Governance Fund: Strategic Investment Programme. The Execution Of Construction Works Includes The Implementation Of All Works Necessary For The Proper Functioning Of The Roads Under Construction And The Infrastructure Serving The Adjacent Areas, Including Construction And Reconstruction Of Roads, Utilities Networks, Demolition Of Buildings Colliding With The Investment, In Accordance With The Swz, Generally Applicable Law, Regulations Of The Employer, Standards, Principles Of Technical Knowledge And Construction Art. 3) Obtaining Documents Allowing For The Lawful Use Of The Completed Construction Works (Depending On The Needs: Obtaining An Occupancy Permit Or Notification Of Completion Of Construction And Obtaining A Certificate Of No Grounds For Raising An Objection In Accordance With Article 54 Of The Above-Mentioned Act). , On The Terms And In The Quantities Specified In Chapter 4.2 Point 19 Fup.5) Execution And Delivery To The Employer Of The As-Built Documentation Referred To In § 9 Section 2 Point 2 Lit. C).2. The Design Documentation Referred To In Par. 1 Point 1 Includes In Particular The Execution Of: 1) Design Documentation Developed In Accordance With § 4 Section 1 Of The Regulation Of The Minister Of Infrastructure Of December 20, 2021 On The Detailed Scope And Form Of Design Documentation, Technical Specifications For The Execution And Acceptance Of Construction Works And The Functional And - Utility Together With Obtaining, As Part Of The Offered Price, All Documents, Certificates, Opinions, Arrangements, Permits (Including Water Law Permits) And Checks Required In Accordance With Applicable Regulations To The Extent That Allows The Commencement Of Construction Works Along With The Agreement With The Employer; 2) Information On Safety And Health Protection, Where Its Development Is Required Under Separate Regulations. The Design Documentation Referred To In Par. 1 Point 1, Necessary For The Execution Of Construction Works, Should Be Delivered To The Employer In The Amount And Form Indicated In Section 4.3 Fup.3. The Detailed Material Scope Of The Works To Be Performed As Part Of The Contractors Duties Is Presented In The Fup. 4. The Ordering Party Indicates That The Subject Of The Contract Is The Performance Of Construction Works And The Preparation Of Documentation For The Implementation Of Works, Notification Of The Execution Of Works To The Competent Authorities And Settlement Of The Obtained Co-Financing. 5. The Contracting Authority Requires The Contractor To Provide A Warranty For The Construction Works Performed, Constituting The Subject Of This Contract, For A Period Of 60 Months From The Date Of Final Acceptance Of The Subject Of The Contract.6. Pursuant To The Content Of Art. 95 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ Persons On The Basis Of An Employment Contract On The Terms Set Out In The Article In Question.7. The Employer Indicates That It Requires The Contractor, Subcontractor Or Further Subcontractor To Employ All Persons Performing Physical Work During Construction Works Under An Employment Contract, Excluding Persons Performing Independent Technical Functions In Construction Within The Meaning Of The Act Of 7 July 1994 Construction Law, And The Contractor Accepts This Obligation.8. The Subject Of The Contract Is Implemented From The Budget Of The Kobylnica Commune And Co-Financed From The Government Fund Of Polish Order: Program Of Strategic Investments.
