1. Due To The Developing Housing Development In The Commune Of Demand For Water Is Increasing. Due To The Unsatisfactory Condition Of The Equipment At The Water Intakes In The Commune Of Zapolice, It Is Necessary To Improve The Functioning Of The Water And Sewage System By: - ​​Modernization Of The Water Treatment Plant In Rembieszów Along With The Construction Of A Second Deep Well, - Assembly And Connection Of A Power Generator For Suw Rembieszów, - Installation And Connection Of A Power Generator For Suw Paprotnia, - Assembly And Connection Of A Power Generator For Suw Zapolice, - Modernization Of The Water Treatment Plant In Zapolice, Including The Construction Of A Second Deep Well, - Modernization Of The Water Treatment Plant In Paprotnia, Installation Of Gate Valves On Water Supply Networks Connected To Suw Paprotnia In The Amount Of 10 Pcs - Replacement Of Hydrants On Water Supply Networks Located In The Commune Of Zapolice In The Amount Of Approx. 30 Pcs. - Purchase Of A Drinking Water Barrel - Purchase Of A Farm Tractor With A Septic Tank To Carry Out Tasks Related To The Collection Of Municipal Sewage From Property Owners - Construction Of A Water Supply Network In The Commune Of Zapolice. The Task Also Includes Cleaning And Disinfection Of The Water Supply Network With The Use Of Devices With Compensation For Hydraulic Shocks And An Accelerator Of The Flow Rate Of The Cleaning Medium: Chlorinated Water - Air - Cleaning Cloth (Mineral Abrasive Material) Connected To The Suw Zapolice. The Implementation Of The Project Will Significantly Improve The Condition Of The Water Supply And Sewage Infrastructure, The Effects Of Which Will Affect The Comprehensive Development Of The Network, Failure-Free And Continuity Of Water Supply For Social And Living Purposes Directly To The Inhabitants Of The Commune. Zapolice. A Detailed Description Of The Subject Of The Contract Can Be Found In Annexes 8 And 9. The Task Covered By The Contract Is Co-Financed From The Polish Ład Government Fund Strategic Investment Programme. Employment Based On An Employment Relationship, In Accordance With Art. 95 Sec. 1 Of The Public Procurement Law. Pursuant To Art. 95 Sec. 1 Of The Public Procurement Law Requires That Throughout The Entire Period Of Works Implementation, The Contractor Must Employ Persons Performing Activities Related To The Performance Of The Contract On The Basis Of An Employment Relationship, If The Performance Of These Activities Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974 - Labor Code. The Requirements In This Regard Apply To The Employment By The Contractor On The Basis Of An Employment Relationship, In Particular Of Manual Workers (Construction Workers), Performing Works Directly Related To The Performance Of Works Under The Supervision Of And Operators Of Mechanical Equipment With Which The Subject Of The Contract Will Be Implemented (This Requirement Does Not Apply To, Among Others, Persons Managing The Construction Site Or Suppliers Of Building Materials, And Situations When These Works Are Performed Personally By A Natural Person Who Independently Conducts Business Activity Under A Subcontract). The Type Of Activities Necessary For The Execution Of The Order By Persons Employed Under An Employment Contract By The Contractor Is The Performance Of Construction Works Specified In Detail In The Order Documents. 2. If The Contractor Finds That The National Or European Standards Or International Standards Used In The Tor And In The Appendices To The Tor May Indicate Product Manufacturers Or Their Sources Of Origin, The Employer Shall Allow Equivalent Solutions In This Respect. This Means That The Technical Parameters Of The Products Indicated In This Way Define The Minimum Expectations Required By The Ordering Party As To The Quality Of The Products To Be Used To Perform The Subject Of The Contract. In Addition, In Each Case, A Statement That The Description Or Feature Of The Described Product, Which May Indicate The Source Of Origin Or Manufacturer, The Contractor Is Also Entitled To Use Equivalent Products, Which Are Understood As Having Technical Parameters Not Worse Than Those Indicated In The Tor And/Or In Attachments To The Swz. It Is Also Allowed To Demonstrate This Equivalence With Standards Equivalent To Those Indicated In The Procurement Documents. The Contractor Bears The Burden Of Indicating Equivalence. When Selecting Equivalent Materials, The Contractor Is Also Obliged To Ensure The Achievement Of The Indicators Specified In The Order Documents.3. The Ordering Party Does Not Plan To Submit Partial Tenders. Justification: Due To The Co-Financing Of The Order From The Polish Governance Fund, The Program Of Strategic Investments, The Ordering Party Is Obliged To Carry Out All The Tasks Covered By The Promise. Dividing The Contract Into Lots, Assuming That At Least One Of Them Is Invalidated And That Another Procedure Is To Be Initiated Against It, Which For Various Reasons (E.G. Fortuitous Events, Appeal To The National Appeals Chamber, Etc.) Would Prevent The Conclusion Of The Contract With The Contractor Before The End Of The Required Period, Which Would Mean The Loss Of Co-Financing For The Entire Project. In Addition, It Would Be Necessary To Perform The Contracts Already Concluded Under The Previous Parts, Despite The Lack Of Funds And The Inability To Implement The Part For Which The Contract Could Not Be Signed Within The Prescribed Period. Therefore, Taking Into Account The Financial Security Of The Commune, In Order To Prevent Potential Difficulties That May Arise In The Event Of Dividing The Contract Into Parts, Ultimately Resulting In The Inability To Use The Promise Co-Financing, The Employer Decided Not To Divide The Contract Into Parts. In Addition, The Comprehensive Performance Of The Order Results From The Nature Of The Order. Dividing The Contract Into Lots Could Significantly Jeopardize The Timely And Qualitative Performance Of The Contract Due To The Inability To Coordinate The Cooperation Of Several Contractors In A Precise And Timely Manner. The Order Was Not Divided Into Parts For The Following Reasons: 1) The Subject Of The Order Is The Performance Of Functionally Related Works. Separation Of The Works Would Pose A Risk Of Organizational Problems Related To The Responsibility For Individual Elements Of The Works Performed By Different Contractors, Which Cannot Be Eliminated. 2) The Subject Of The Contract Must Be Implemented In Stages And In The Order Of Stages. 3) With This Type Of Work Carried Out By Different Contractors, It Would Be Impossible To Clearly Define The Rules Of Third Party Liability (E.G. In The Event Of Simultaneous Performance Of Works By Many Contractors, It Would Be Difficult To Determine The Entity Responsible For Damage Covered By The Third Party Liability Policy).4) Contractors Would Duplicate The Costs Of Works, Which Would Affect Investment Costs. In Each Of The Partial Offers, The Contractor Would Have To Assume A Separate Valuation Of The Use Of The Same Type Of Equipment, In A Situation Where, By Submitting One Offer, The Use Of The Equipment Would Be Priced Once. The Design Documentation Indicates Solutions That Require The Use Of Multi-Type Construction Equipment. 5) Each Of The Contractors Would Include Separate Insurance Costs In The Price, Which Would Increase The Level Of The Employers Expenses. To Sum Up, The Ordering Party Did Not Divide The Contract Into Parts Due To The Fact That Such A Division Would Result In Excessive Technical Difficulties And Excessive Costs Of Performing The Contract. The Need To Coordinate The Activities Of Various Contractors Performing Individual Parts Of The Contract Could Seriously Jeopardize The Proper Performance Of The Contract. The Employer Requires The Contractor To Provide A Guarantee For The Subject Of The Contract For A Period Of Not Less Than 36 Months And Not More Than 60 Months. The Warranty Period Is Set For The Period Equal To The Warranty Period.5. It Is Recommended That The Contractor (At His Own Expense) Visit The Site In Order To Obtain Information Necessary To Prepare The Offer Due To The Flat-Rate Nature Of The Remuneration.
