1. The Subject Of The Contract Is The Provision Of Mobile Telephony And Mobile Internet Services And The Supply Of Brand New Telephone Sets, Lte Modems, Sim Cards For Telephone Sets, Wireless Internet, As Well As Telemetric Sim Cards For The Municipality Of Tychy And Organizational Units. Cellular And Mobile Internet, It Should Be Understood As: A) Delivery Of Inactive Sim Cards And Their Activation After Delivery To The Locations Indicated By The Ordering Party; B) Delivery Of Brand New Mobile Handsets And Modems In Accordance With The Detailed Specification Of The Ordering Party; Mobile Telephony Communication System; D) Provision Of Two-Way Data Transmission Services Using Brand New Mobile Phones And Mobile Modems. To:•Keep 443 Telephone Numbers That The Ordering Partys Units Currently Have;•Transfer Them At The Contractors Expense To Its Own Network From The Date Of Activation Of Services And Provide Mobile Telephony And Wireless Internet Services For These Numbers (According To The Schedule);•Deliver 47 Telephone Numbers New Sim Cards Along With New Telephone Numbers, Activation Of The Service Of Providing Mobile Telephony And Wireless Internet Services For These Numbers (According To The Schedule); • Delivery Of 339 Brand New Telephone Sets With Fully Compatible, Brand New Equipment; Brand New Modems-Routers For Lte Wireless Communication In The Number Of 17 Pcs. With Fully Compatible, Brand New Equipment. The Telephone Numbers Of The Ordering Party Will Remain Unchanged And Will Be Transferred To The Contractors Network After The Expiry Of The Contract For The Provision Of Services With The Current Operator Without Interruptions In The Provision Of Services, Subject To Point 5.2 Item Description Heres Your Order. A Complete List Of Entities Participating In These Proceedings Is Contained In Appendix No. 6 To The Swz - List Of Entities Participating In The Proceedings. Voice, Sms And Mms Text Messages, As Well As Mobile Internet Access, • Other Services, Specified In Detail In The Descriptions Of Individual Tariffs. Obligations Herein, With The Reservation That The Selected Contractor Will Be Obliged To Perform All Technical And Formal Activities Aimed At Effective Takeover Of The Numbering And Commencement Of The Provision Of Telecommunications Services Within The Required Period, Still During The Implementation Of The Currently Binding Agreements. 5. Information On The Organizational Units Of The Municipality Of The City Of Tychy And On The Number Of Numbers Held And Card Activations Planned To Be Launched, Along With The Schedule And Detailed Rules For Assigning Tariffs And Equipment, Are Specified In Appendix No. 5 To The Swz - Schedule Of Numbers And Tariffs. The Ordering Party Informs That All Entities Participating In This Procedure Are Obliged To Comply With The Public Procurement Law. 6. The Subject Of The Contract Will Be Implemented On The Basis Of: A) The Main Contract Concluded In The Course Of A Public Procurement Procedure Between The Contractor And The Municipality Of Tychy. The Draft Provisions Of The Contract Are Set Out In Annex 4A To The Swz; B) Contracts Concluded In The Course Of A Public Procurement Procedure Between The Contractor And The Organizational Units Of The Ordering Party. The Draft Provisions Of The Agreement Are Set Out In Annex 4B To The Tor; C) Regulations For The Provision Of Telecommunications Services Of The Contractor; D) Business Price List For The Contractors Services, Including Services Not Described In The Business Price List, And Covered By These Proceedings; E) Provisions Of The Act - Public Procurement Law; F) The Provisions Of The Civil Code. 7. If It Is Necessary To Transfer Individual Numbers From Other Operators, The Contractor Will Be Obliged To Submit A Request To The Ordering Party For Information Necessary To Perform All Technical And Formal Activities. The Employer Shall Provide The Contractor With The Necessary Documentation. A Detailed Description Of The Subject Of The Contract Is Included In Annex 3 To The Swz. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Contracting Authority. In This Case, The Contractor Shall Attach To The Offer Documents Confirming The Equivalence Of The Solutions Offered. The Burden Of Proving Equivalence Rests With The Contractor. The Contractor Shall Demonstrate Equivalence By Any (Credible) Means. Failure To Demonstrate Equivalence Results In Rejection Of The Tender As Inconsistent With The Terms Of The Contract. Reliance On The Resources Of Other Entities. Or The Financial Or Economic Situation Of The Entities Providing Resources, Regardless Of The Legal Nature Of The Legal Relations Between Them. For Which These Capabilities Are Required. 3. The Economic Operator That Relies On The Abilities Or The Situation Of The Entities Providing Resources Shall, Together With Its Tender, Submit An Undertaking By The Entity Providing The Resources To Place At Its Disposal The Necessary Resources For The Purposes Of The Performance Of A Given Contract, Or Other Subjective Means Of Evidence Confirming That The Economic Operator, While Performing The Contract, Will Have At Its Disposal The Necessary Resources Of These Entities (Annex 1B To The Swz). Chapter 6, And Will Also Examine Whether There Are Grounds For Exclusion Against This Entity That Have Been Provided For The Contractor, I.E. On The Basis Of The Documents Referred To In Point 7.8. Swz.5. The Entity That Undertook To Make The Resources Available Is Jointly And Severally Liable With The Contractor, Which Is Based On Its Financial Or Economic Situation, For The Damage Suffered By The Contracting Authority As A Result Of Failure To Make These Resources Available, Unless The Entity Is Not At Fault For The Failure To Make The Resources Available.6 The Contractor May Not, After The Deadline For Submission Of Tenders, Refer To The Abilities Or Situation Of Entities Providing Resources, If At The Stage Of Submitting Tenders He Did Not Rely In A Given Scope On The Abilities Or Situation Of Entities Providing Resources. However, Not Earlier Than From April 21, 2023, For A Period Of 24 Months, Taking Into Account The Intermediate Dates Indicated In The Schedule - Annex No. 5 To The Swz. The Employer Requires The Contractor Or Subcontractor To Employ At Least Two Persons On The Basis Of An Employment : 1. A Supervisor For Operational Service;2. A Sales Assistant; However, At Least One Of The Above-Mentioned Persons Must Be Available At The Disposal Of A Physical Meeting With Representatives Of The Entities Participating In The Proceedings (Up To 12 Hours In Advance).
