1. The Subject Of The Contract Is The Liquidation Of Asbestos-Containing Products, I.E. Waste With Codes 17 06 01* (Asbestos-Containing Insulation Materials) And 17 0605* (Asbestos-Containing Construction Materials) Generated, Among Others, By During The Liquidation Or Replacement Of Roofing Elements, Construction Elements, Partition Walls (E.G. In Basements) Or Facades Of Residential And Non-Residential Buildings, Garages, Liquidation Of Wild Asbestos-Containing Landfills, Owned By Natural Persons Who Do Not Conduct Business Activity, Including Natural Persons Conducting Business Activity Referred To In Art. 6 Sec. 1 Points 1-4 Of The Act Of March 6, 2018. Entrepreneurs Law (Only Local Residents) In The Gniezno Poviat. 2. The Subject Of The Contract Includes The Performance Of Works Related To The Removal And Disposal Of Asbestos-Containing Products Located On Real Estate In The Communes Of The Gniezno Poviat, Including: Collected From Their Holders, In An Estimated Basic Quantity Of 100,000 Kg + An Option Of Up To 30,000 Kg; B) Packaging, Transport And Transfer To A Landfill With An Appropriate Permit For Disposal Of Deposited Asbestos-Containing Products, Collected From Their Holders, In An Estimated Basic Quantity Of 338,000 Kg + An Option Of 120,000 Kg. 3. The Scope Of Work Also Includes The Removal Of Asbestos Plates That Are Fragmented. 4. The Material Scope Of The Subject Of The Contract Includes: 1) Demolition (Disassembly) Of Asbestos-Containing Building Elements, 2) Protection Of Waste In Accordance With Applicable Regulations: Stacking On Pallets, Securing With Foil And Preparation For Transport, 3) Ordering The Performance Of The Service From Asbestos-Containing Waste And Cleaning Of Dust In A Way That Prevents Their Emission To The Environment, 4) Transport Of Collected Asbestos-Containing Waste Using Specialized Equipment In Accordance With The Requirements Set Out In The Act Of 19 August 2011 On The Road Transport Of Dangerous Goods (Journal Of Laws Of 2021, Item 756), In A Way That Prevents The Contamination Of Roads And Public Utility Areas And Does Not Pose A Threat To The Environment, In Accordance With The Act Of 20 June 1997. Road Traffic Law (Journal Of Laws Of 2022, Item 988), 5) Transfer Waste For Disposal In Accordance With The Provisions Of The Waste Act Of December 14, 2012 (I.E. Journal Of Laws Of 2022, Item 699) To The Appropriate A Hazardous Waste Landfill Intended For This Purpose, 6) Keeping The Quantitative And Qualitative Records Of Waste Referred To In Art. 66 Sec. 1 Of The Act Of 14 December 2012 On Waste (I.E. Journal Of Laws Of 2022, Item 699) In Accordance With The Waste Catalog And Applicable Regulations,7) Each Time Weighing Of Asbestos-Containing Products At Individual Applicants And Their Collection At Working Hours Of The Office Competent For The Location Of The Property.5. Liquidation Of Asbestos-Containing Products Concerns Properties Located In The City Of Gniezno And Nine Communes Of The Gniezno Poviat: Witkowo, Kłecko, Trzemeszno, Czerniejewo, Gniezno Commune, Kiszkowo, Łubowo, Mieleszyn, Niechanowo. 6. The Subject Of The Contract Will Be Financed By The Gniezno Poviat And From The Funds Of The Communes Of The Gniezno Poviat And A Subsidy From The Provincial Fund For Environmental Protection And Water Management In Poznań With The Participation Of The National Fund For Environmental Protection And Water Management In Warsaw.7. In Addition, The Contractor, As Part Of The Offer Price, Should Also Provide: - At Least 5 Advertisements In The Local Press Informing About The Removal Of Asbestos (In The First Two Months Of The Program Operation), - Preparation And Dissemination Of Posters Informing About The Removal Of Asbestos (Minimum Of 10 Pieces On The Site In Each Of The Communes Covered By The Program In Agreed Places), - Organization And Securing Of The Work Site, - Cleaning The Area Of Asbestos, - Tidying Up The Area After Completion Of The Works And Possible Payment Of Compensation For Damage Caused As A Result Of The Works Or In Connection With Them. 8. The Employer Requires That The Contractor: A) Meet The Criteria Required In The Regulation Of The Minister Of Economy Of 13 December 2010 On The Requirements For The Use Of Asbestos-Containing Products And The Use And Cleaning Of Installations Or Devices In Which Asbestos-Containing Products Have Been Or Are Used (Journal Of Laws Of 2011, No. 8, Item 31) And The Regulation Of The Minister Of Economy, Labor And Social Policy Of 2 April 2004 On The Methods And Conditions For Safe Use And Removal Of Asbestos-Containing Products (Journal Of Laws Of 2004 No. 71, Item 649, As Amended), As Well As The Regulation Of The Minister Of Economy And Labor Of October 14, 2005 On The Rules Of Occupational Health And Safety When Securing And Removing Asbestos-Containing Products And The Training Program In The Safe Use Of Such Products ( Journal Of Laws Of 2005, No. 216, Item 1824); B) Had At Least One Vehicle Adapted To The Loading And Transport Of Hazardous Waste Containing Asbestos In Accordance With § 10 Of The Regulation Of The Minister Of Economy, Labor And Social Policy Of April 2, 2004 On The Methods And Conditions Of Safe Use And Removal Of Asbestos-Containing Products (Journal Of Laws Of 2004, No. 71, Item 649, As Amended); C) To Perform The Task, He Used A Mobile Scale With A Lifting Capacity Of At Least 1 Mg, With A Valid Legalization, In Accordance With The Provisions Of The Act Of May 11, 2001. Law On Measures (I.E. Journal Of Laws Of 2022, Item 2063) And Relevant Acts Executives; D) At The Stage Of Order Execution, He Used Means Of Transport With Euro Emission Class Not Worse Than Declared In The Offer; E) Had A Valid Contract Concluded With A Landfill Holding An Appropriate Permit/Permit For The Disposal Of Hazardous Waste Containing Asbestos (Waste Code 17 06 01* And 17 06 05*), Guaranteeing The Collection Of Such Waste During The Performance Of The Order, Or Held A Permit/Permit To Conduct Such Landfills. 9. The Economic Operator Must Insure Its Activities Related To The Subject Of The Contract In Terms Of Third Party Liability Covering The Risks Arising From The Contract Concluded As A Result Of The Contract Award, Throughout The Period Of Service Performance, I.E. From The Beginning Of The Service To Its Completion, For The Sum Insured For The Sum Insured Corresponding To At Least The Value Of The Contract. The Contractor, At Each Request Of The Ordering Party, Undertakes To Present A Document Confirming That The Contractor Is Insured Against Civil Liability For The Above-Mentioned Sum Insured. 10. The Subject Of The Contract Must Be Performed In Accordance With Applicable Law, Including: A) The Act Of December 14, 2012 On Waste (I.E. Journal Of Laws Of 2022, Item 699), B) The Act Of July 7, 1994 Construction Law (Journal Of Laws Of 2021, Item 2351), C) Regulation Of The Minister Of Economy, Labor And Social Policy Of April 2, 2004 On The Methods And Conditions Of Safe Use Of Asbestos-Containing Products ( Journal Of Laws Of 2004 No. 71, Item 649, As Amended), D) Regulation Of The Minister Of Economy Of 13 December 2010 On The Requirements For The Use Of Asbestos-Containing Products And The Use And Cleaning Of Installations Or Devices, In Which Asbestos-Containing Products Were Or Are Used (Journal Of Laws Of 2011, No. 8, Item 31),E) By The Regulation Of The Minister Of Economy, Labor And Social Policy Of October 14, 2005 On The Principles Of Occupational Health And Safety In The Protection And Removal Of Asbestos-Containing Products And The Training Program In Z In The Field Of Safe Use Of Such Products (Journal Of Laws Of 2005, No. 216, Item 1824). 11. The Contractor Undertakes To Notify Each Time The Commencement (Along With The Planned Date Of Completion) Of Works To The Relevant Authorities, In Accordance With Applicable Regulations, I.E.: The Competent Construction Supervision Authority, The Competent District Labor Inspector And The Competent State Sanitary Inspector, At Least 7 Days Before Start Of Work. The Contractor Is Obliged To Fulfill All Other Obligations Conditioning The Lawful Performance Of The Obligations Constituting The Subject Of The Contract. 12. Upon Completion Of The Works, Each Applicant (I.E. The Person Applying For The Removal Of Asbestos From Their Property) Will Be Provided With: A Report Of The Final Acceptance Of Works On A Given Property And A Statement From The Contractor That The Commissioned Works Were Carried Out In Compliance With The Relevant Technical And Sanitary Regulations, And The Entire Area Has Been Properly Cleaned Of Asbestos. 13. The Contractors Duties Will Also Include Preparing A Tabular Settlement Of The Works Performed, Including: Commune, Name And Address Of The Applicant, Place Of Work, Type Of Work Performed, Amount In Kg Of Dismantled And Neutralized Asbestos, Value Of Dismantling And Neutralization Corresponding To 100% Of The Value Of The Work Performed. 14. The Contractor Will Also Be Obliged To Prove The Number Of Tons Of Asbestos-Containing Products Dismantled/Accepted By Submitting To The Employer Final Acceptance Reports From Each Real Estate Of Asbestos-Containing Products. The Report In Question Concerns The Completed Works On A Given Property. 15. The Maximum Date Of Delivery Of The Final Acceptance Report Is 30 Calendar Days From The Date Of Completion Of Works On A Given Property. A Possible Shorter Deadline Can Be Indicated In Point 3 Of The Tender Form - Appendix 1 To The Swz. This Deadline Is A Criterion For Evaluating Bids (Detailed Information Is Included In Part Xviii Of The Swz).19. The Total Amount Of Waste Specified In The Contract Is Indicative. The Ordering Party Reserves The Right To Change This Amount (Within The Limits Of Funds Allocated For This Purpose) Depending On The Number Of Submitted Applications.
