The Subject Of The Contract Is The Modernization Of The Internal Access Road, Ul. Słowackiego In Kunów, Following The Existing Track: - Modernization Of The Existing Road Surface With A Width Of 3.5 M To 5.0 M, A Length Of 172.6 M, - Restoring The Correct Roughness Of The Road And Its Load Capacity, - Restoring Comfortable Communication Services In The Area In Question, - Construction Of The Road : Wearing Course Made Of Concrete Cobblestones, 8 Cm Thick, 2-8 Mm Gravel Bedding, 5 Cm Thick, Subbase Made Of A Mixture Not Bound With Aggregate C90/3 0/31.5 Mm, 23 Cm Thick, - Arrangement Of Curbs And Resistors, - Height Adjustment Of Existing Valves And Manholes.3. The Detailed Scope Of Construction Works Is Specified In: 1) Technical Documentation Under The Name: Renovation Of The Internal Road At Ul. Słowackiego In Kunów”; 2) Detailed Technical Specification; 3) Bill Of Quantities. 4. The Scope Of The Subject Of The Contract Includes: 1) Measurement, Preparatory And Demolition Works; 2) Earthworks; 3) Road Works (Road Structure, Curbs, Resistors); 4) Securing The Network With Pehd Bipartite Protective Pipes; 5) Regulation Of Existing Manholes; 6) Leveling And Topsoiling Of The Area.5. The Ordering Party Does Not Allow The Submission Of Partial Tenders Referred To In Art. 7 Point 15 Of The Public Procurement Law. Reasons For Not Dividing The Contract Into Lots: Pursuant To Art. 91 Sec. 2 Of The Act Of September 11, 2019 - Public Procurement Law (Journal Of Laws Of 2022, Items 1710 And 2185), A Detailed Analysis Of The Subject Of The Contract Was Made And The Advisability Of Dividing The Contract Into Parts Was Considered. The Task Will Be Implemented In Accordance With The Notification Of Construction Works Of May 6, 2022. The Investment Concerns The Modernization Of An Internal Municipal Road. During The Implementation Of The Project, The Works Performed By The Contractor Of One Part Of The Order Would Have A Direct Impact On The Works Performed By The Contractors Of The Subsequent Parts. Therefore, There Is A Serious Risk Of Excessive Technical And Organizational Difficulties In The Proper Performance Of The Entire Contract In The Event Of Its Division Into Parts. Also, Due To The Need To Coordinate Activities During The Implementation Of Construction Works Described In The Project Documentation, Dividing The Contract Into Parts Is Unjustified, As It Could Seriously Jeopardize The Proper Execution Of The Entire Project Within The Specified Period. In Addition, Dividing The Order Into Parts Would Cause Difficulties In Asserting Warranty Rights By The Ordering Party During The Warranty Period. The Lack Of Division Into Parts Of The Contract In Question Will In No Way Limit The Principle Of Competitiveness, Because The Contracting Authority Allows Subcontracting Under This Contract, Moreover, The Contractors May Also Jointly Apply For A Public Contract. It Should Also Be Noted That The Issue Of The Divisibility Of The Performance Has Not Been Regulated In The Public Procurement Law, Therefore, Pursuant To Art. 8 Sec. 1 Of The Public Procurement Law - The Ordering Party Applies The Provisions Of The Civil Code In This Respect, In Particular Art. 379 § 2 A Benefit Is Divisible If It Can Be Partially Fulfilled Without A Significant Change In The Object Or Value. Considering The Above, It Should Be Recognized That The Performance Cannot Be Performed Without A Significant Change In The Subject, Which Means That It Should Be Treated As One Whole. At The Same Time, The Lack Of Dividing The Contract Into Lots Does Not Restrict Competition And Ensures Equal Access For Entities From The Sector Of Small And Medium-Sized Enterprises. It Should Also Be Noted That The Possible Division Of This Contract Into Lots Would Be Pointless, As The Established Estimated Value Of The Contract (Below The Amounts On Which The Obligation To Submit Notices To The Publications Office Of The European Union Depends) Is Not A Value High Enough To Hinder The Participation Of Small And Medium-Sized Enterprises In In This Proceeding.7. The Ordering Party Does Not Allow The Possibility Of Submitting Variant Offers And In The Form Of Electronic Catalogues.8. The Ordering Party Does Not Provide For The Award Of Contracts Referred To In Art. 214 Sec. 1 Point 7 And 8 Of The Public Procurement Law.9. A Detailed Description And The Method Of Order Execution Are Contained In The Description Of The Subject Of The Order (Opz), Constituting Annex No. 8 To The Specification Of The Terms Of The Order.10. After A Detailed Analysis, The Employer Waives The Requirement To Take Into Account The Requirements Regarding Accessibility For People With Disabilities And Designing For All Users, Because Pursuant To Art. 100 Sec. 1 Of The Public Procurement Law, It Is Justified By The Nature Of The Subject Of The Contract. Road Modernization Is A Universal Service. As A Road Infrastructure, It Will Be Generally Accessible To The General Public, It Will Improve The Quality Of Life Of People Living Within The Range Of The Modernized Road. In The Places Of Applied Depressions, An 8 Cm Thick Cube With Bumps Should Be Laid (Indicator Cube Facilitating The Movement Of People With Disabilities). Non-Chamfered Paving Stones Should Be Used Along The Entire Road.
