1. The Subject Of The Contract Is The Provision Of Medical Services, The Scope Of Which Includes The Following Services: 1) Initial Examinations Of Employees; 2) Periodic Examinations Of Employees And Police Officers; 3) Control Examinations Of Employees And Police Officers; Medical Examinations For Sanitary And Epidemiological Purposes, Excluding Laboratory Tests For The Carriage Of Bacteria;6) Examinations Of Drivers, Persons Driving A Company Vehicle As Part Of Their Official Duties, For Whom A Category B Driving License Is Required, And Persons Driving Privileged Vehicles;7) Medical Examination For Candidates For A Forklift Driving Course Or A Category C, E, C+E, T Driving Course; 8) Psychological And Psychotechnical Examination Of Drivers And Persons Driving Emergency Vehicles; 9) Examination Of A Person With A Gunsmiths License; Occupational Health And Safety Committees And Committees Specified In Separate Regulations With The Participation Of A Prophylactic Doctor;11) Performing Preventive Vaccinations, Including: Conducting A Qualified Medical Examination, Issuing A Vaccination Booklet, Purchasing The Vaccine Together With The Procedure And Informing The Person Concerned About The Next Dates Of Vaccine Doses Against: A) Hepatitis A, Type B; B) Tetanus And Diphtheria; C) Tick-Borne Encephalitis; D) Typhoid Fever; E) Measles. Returning To The Country After Finishing Service In The Police Contingent.2. The Police Training Center In Legionowo Employs 580 People, Including: 243 Civilian Employees And 337 Policemen.3. The Contractor Guarantees The Performance Of Benefits And Services In The Contractors Facilities Every Working Day From Monday To Friday From 7:30 To 15:00, After Prior Arrangement Of The Date Of The Visit By Telephone.4. Pursuant To Art. 455 Sec. 1 Point 1 Of The Public Procurement Law Act, In Connection With The Specification Of The Functioning Of The Unit And The Possibility Of A Decrease In The Number Of Civilian Employees And Policemen Of The Police Training Center In Legionowo, Reserves The Right Not To Complete The Entire Order Without Financial And Legal Consequences. The Minimum Remuneration For The Contractor In This Case Will Be Pln 44,000.00 Gross.5. The Detailed Scope And Frequency Of Preventive Examinations Of Employees Is Determined By An Occupational Medicine Physician, In Accordance With The Methodological Guidelines On Conducting Preventive Examinations Of Employees, Constituting Annex No. 1 To The Regulation Of The Minister Of Health And Social Welfare Of May 30, 1996 On Conducting Medical Examinations Of Employees, The Scope Of Preventive Health Care For Employees And Medical Certificates Issued For The Purposes Provided For In The Labor Code (Journal Of Laws Of 2016, Item 2067, Of 2020, Item 2131 And Of 2023, Item 73).6. The Contractor Shall Perform A Basic Blood Test And A General Urine Test Each Time During Periodic Examinations Of Employees.7. The Detailed Scope And Frequency Of Preventive Examinations Of Police Officers Are Specified In Annexes 2 And 3 To The Regulation Of The Minister Of The Interior And Administration Of 9 January 2017 On Periodic And Control Examinations Of Police Officers (Journal Of Laws Of 2017, Item 110, As Amended .).8. The Scope And Frequency Of Examinations Of Drivers And Persons Driving Motor Vehicles Are Determined By Occupational Medicine Physicians On The Basis Of The Act Of 5 January 2011 On Vehicle Drivers (Journal Of Laws Of 2021, Item 1212, As Amended), The Regulation Of The Minister Of Health Of Of December 5, 2022 On Medical Examinations Of Persons Applying For The Right To Drive Vehicles And Drivers (Journal Of Laws, Item 2503), Regulation Of The Minister Of Health Of July 8, 2014 On Psychological Examinations Of Persons Applying For The Right To Drive Driving Vehicles And Persons Working As Drivers (Journal Of Laws Of 2022, Item 165).9. The Scope Of Examinations Of A Police Officer Returning To The Country After Completing His Service In The Police Contingent Is Specified In The Regulation Of The Minister Of The Interior And Administration Of March 9, 2020 On The Examination Of A Police Officer And Police Employee Returning To The Country After Completing His Service Or Work In A Police Contingent And Directing Him To A Camp Therapeutic And Prophylactic (Journal Of Laws Item 392).10. Depending On The Conditions Of Performing Work/Service, And, Above All, The Presence Of Harmful Or Burdensome Factors And Other Factors Indicated In The Referral, An Occupational Medicine Physician, Guided By Applicable Law, May Extend The Scope Of Basic Examinations With Additional Medical Examinations, Consultations With Specialist Doctors Or Diagnostic Tests, Provided For In The Contract, And Set An Earlier Date For The Next Examination, Justifying It In The Documentation.11. Service Period: From The Date Of Conclusion Of The Contract To February 29, 202412. The Contractor Undertakes To Perform Tests On One Day, I.E. Laboratory Tests, Tests Performed By Specialist Doctors, Completed With An Examination By An Occupational Medicine Doctor.13. The Contractor Declares That In The Facility Or Facilities There Are Doctors Offices With Specialties Necessary To Perform The Service.14. The Contractor Declares That The Services Will Be Performed By Doctors Authorized To Conduct Examinations And Nurses With The Required Professional Qualifications.15. The Basis For The Examination Is A Personal Referral Issued In Three Identical Copies, Constituting Appendix No. 5 To The Essential Provisions Of The Agreement.16. The Contractor Shall Ensure The Participation Of A Preventive Medicine Doctor In The Occupational Health And Safety Committee And Committees Specified In Separate Regulations Requiring The Participation Of A Preventive Medicine Doctor.17. The Confirmation Of The Provision Of Medical Services By The Contractor Is The Issuance Of A Medical Certificate In Two Copies About The Examination Or Protective Vaccination.18. The Contractor Is Obliged To Provide The Ordering Party With Name Lists Of Persons Who Performed Only Part Of The Examinations Ordered By An Occupational Medicine Physician And Ceased Their Further Implementation Without Consulting This Physician. If The Referred Person Ceases To Carry Out Further Tests, The Ordering Party Shall Pay The Contractor 50% Of The Price Of The Tests Performed.19. The Contractor Undertakes To Keep Medical Records, Protect Them And Make Them Available In Accordance With Applicable Regulations.20. The Ordering Party Reserves The Right To Extend The Contract Performance Period To 30 Days After The Date Specified In The Contract, Within The Funds Specified For This Purpose, And To Conclude An Annex To The Contract In This Regard, Constituting Annex No. 9 Of The Essential Provisions Of The Contract.21. The Contractor Is Obliged To Fulfill The Obligations Towards The Employer Specified In The Act Of 27 June 1997 On Occupational Medicine Services (Journal Of Laws Of 2022, Item 437).22. The Contractor Is Obliged To Perform Specific Services Using All Organizational Possibilities In Order To Perform Them As Quickly And Efficiently As Possible And In A Manner That Takes Into Account The Interest Of The Ordering Party.23. Symbol According To The Common Public Procurement Vocabulary (Cpv): 85121000-3 - Medical Services.24. The Contractor Is Obliged To Perform The Order On The Terms And Conditions Described In The Essential Provisions Of The Contract, Constituting Appendix No. 13 To Swz.25. The Ordering Party Does Not Allow Variant Offers.26. The Ordering Party Allows Entrusting The Performance Of Part Of The Order To The Subcontractor.27. The Ordering Party Demands That The Contractor Indicate In The Offer The Parts Of The Order That Will Be Entrusted To Subcontractors, And The Names Of Any Subcontractors, If They Are Already Known, According To Annex No. 11 To Swz.28. According To Art. 310 Of The Act, The Contracting Authority May Cancel The Contract Award Procedure If The Public Funds That The Contracting Authority Intended To Allocate To Finance The Whole Or Part Of The Contract Were Not Awarded.29. The Employer Informs That In The Event Of Circumstances Related To The Occurrence Of Covid-19 That Affect Or May Affect The Proper Performance Of The Subject Of The Contract, The Contract May Be Amended.30. The Ordering Party Stipulates That The Total Value Of The Order May Not Exceed The Funds Available For This Purpose.
