The Subject Of The Contract Must Meet All The Requirements For Food Products Set Out In Applicable Regulations, In Particular: 1) The Act Of August 25, 2006. The Subject Of The Public Procurement Is The Supply Of Dairy Products According To The Assortment And In The Quantities Specified In Annex 1 To The Tender Form (To Be Completed And Submitted With The Offer) According To Orders Placed By The Employer, Delivered To The Kitchen - Food Warehouse At The Employers Headquarters, Ul. Pocztowa 11 In Tuchola, Within 12 Months From The Date Of Signing The Contract. Deliveries Will Take Place Every Day From Monday To Friday Between 5:00 And 5:30, In Sporadic Cases At Other Times Agreed With The Ordering Party And The Contractor, Based On Telephone Orders Placed On The Previous Day.2. The Delivered Products Must Be Packed In Original Packaging With The Name Of The Product, Manufacturers Details, Raw Material Composition And Best-Before Date. They Must Be Fresh, Have An Appropriate Shelf Life, And The Required Attestations And Certificates. They Must Be Manufactured And Delivered In Accordance With The Requirements Of Sanepid And The Haccap System, They Must Comply With Polish And European Standards. Deliveries, Transport And Unloading To The Storage Forklifts At The Expense, Forces And Risk Of The Contractor In A Way That Allows The Ordering Party To Check The Quantity, Quality And Compliance Of The Delivered Goods With The Order In A Calm And Detailed Manner. The Contractors Driver/Escort And A Representative Of The Ordering Party Participate In Checking The Delivery. It Is Not Allowed To Deliver The Goods By Courier Company And Not To Unload The Goods On The Trolleys Provided. If The Supplier Fails To Unload The Goods Onto The Forklifts, The Goods Will Not Be Accepted And The Delivery Shall Be Deemed Not To Have Been Completed. The Means Of Transport Must Meet Sanitary Requirements In Accordance With The Requirements Of Haccp, Sanepid And Be Intended Only For The Transport Of Food, And The Driver / Escort Must Have A Valid Health Book, Be Equipped With Clean, White Protective Clothing And Have Completed Training In The Minimum Sanitary Procedure In The Field Of Food Safety And Food Haccp And Sanepid. The Contractor Whose Offer Is Selected As The Most Advantageous Shall Provide Product Specification Sheets - Labels With A Detailed Composition Of Raw Materials And Possible Allergens Of Each Product Included In The Offer Form In The Form Of A Printout Or In An Electronic Version On A Cd, Dvd, At The Latest On The Day Of Signing The Contract. The Goods Offered In The Assortment And Price Offer Cannot Be Changed During The Term Of The Contract To Another, Nor Can Their Prices Be Changed.4. During Holidays And Holidays, The Ordering Party May Limit Or Suspend Orders Depending On The Number Or Absence Of Consumers, Which Cannot Be Predicted At The Stage Of The Procedure.5. In The Event Of Late Delivery Or Lack Of Deliveries Due To The Contractors Fault Or The Contractors Delivery Of Goods Of Poor Quality, The Ordering Party Shall Order The Goods From Another Supplier And Charge The Contractor With The Costs. And In The Event Of A Repeated (Three Times) Situation With Untimely Deliveries Or Lack Of Deliveries Or Deliveries Of Goods Inconsistent With The Tor And Of Poor Quality, The Ordering Party Shall Terminate The Supply Contract With Immediate Effect, And The Contractor Shall Not Be Entitled To Any Claims In This Respect. 7. Markings Of Some Materials Or Their Producers Have Been Given In Order To Specify The Parameters Of The Subject Of The Order And They Are Only Indicative, I.E. Contractors May Offer An Assortment Equivalent To Other Brands, But Maintaining The Percentage Composition Of Raw Materials And Not Lower Technical, Quality And Taste Parameters With The Same Efficiency , Consistency And The Same Organoleptic Characteristics, Of The Same Weight.9. The Ordering Party Reserves The Right To Substitute The Purchase Of Goods Outside The Current Contract And Charge The Contractor With The Purchase Costs If The Contractor Fails To Deliver Or Is Unable To Deliver Within The Prescribed Period The Ordered Product In Accordance With The Description Contained In The Tor Or Its Appropriate Equivalent. 10. The Ordering Party Reserves The Right To Change The Quantity Of Ordered Articles, The Given Value Is An Estimate And The Change May Result From A Change In The Number Of People Fed Or The Variety Of The Menu, Which Cannot Be Predicted At The Time Of Preparing The Offer.11. Settlements Between The Contractor And The Ordering Party Will Be Based On Unit Prices Resulting From The Assortment And Price Form Attached To The Offer According To Successive Orders Placed By The Ordering Party.12. All Information Necessary To Prepare The Offer Is Available For Inspection At The Registered Office Of The Ordering Party And Made Available On The Website Of The Conducted Procedure On The E-Procurement Platform.
