1. The Subject Of The Contract Is The Reconstruction Of The Sports Stadium In Żołynia Along With The Accompanying Infrastructure And Cloakroom And Sanitary Facilities - The Contract Is Co-Financed From The Governmental Fund Polish Order: Program Of Strategic Investments.2. The Subject Of The Contract Includes The Execution Of: 1) Stage I - Including At Least The Execution Of The Works Indicated Below: Execution Of Demolition Works, Execution Of Reinforced Concrete Strip Footings And Foundation Walls With Anti-Moisture And Thermal Insulation, Execution Of Under-Floor Sanitary Sewage System, Concrete Base For Floors, Construction Of Structural Walls On The Ground Floor, 2) Stage Ii - Including At Least The Performance Of The Works Indicated Below: - Execution Of The First Floor Walls, Reinforced Concrete Ceiling, Gable Walls, Roof Truss, Roofing, Partition Walls, Installation Of Pvc Window Joinery, Internal Electrical Installation, Sanitary Sewage System, Water Supply System, Central Heating System, Internal Plastering, Anti-Moisture And Thermal Insulation Of Floors, Concrete Floors, Assembly Of Aluminum Door Frames, Removal Of Topsoil And Execution Of Trenches Under Pitch Boards And Execution Of A Drainage Layer, Connections To The Building, External Electrical System, Assembly Of Foundations And Lighting Masts, Construction Of A Technical Building For A Filter Station With An External Cold Water System And A Sprinkler System, Construction Of The Buildings Facade, Construction Of Foundations For The Assembly Of Stands. Scope Constituting The Subject Of The Contract: Execution Of Natural And Artificial Surface On Pitches, Execution Of Fencing, Retaining Wall, Arrangement Of Wall And Floor Tiles, Execution Of Painting Works, Equipment For The Boiler Room, Locker Room, Gym, Installation Of An Elevator, Heat Pump, Photovoltaics, Installation Of Barrier Nets, Assembly Of Stands , Construction Of Parking Spaces And Paved Surfaces, Installation Of Shelters For Competitors And Medical Service. Stage Iii Will Be Settled Once, After The Entire Scope Of Works Covered By The Subject Of The Contract Has Been Completed. The Described Scope Of Works Does Not Introduce Any Accessibility Barriers For People With Disabilities Or Az Is Designed For All Users.3. The Scope Of The Contract Also Includes: 1) Preparatory And Measurement Works, Documentation Of The Tests Carried Out, Development And Execution Of The As-Built Geodetic Inventory, 2) Performance Of All Tests And Checks Necessary To Perform The Subject Of The Contract In Accordance With Applicable Regulations And Necessary To Apply To The Competent Authorities For Permission To Use And Commissioning,3) The Contractor Will Be Obliged, At The Request Of The Employer, To Take Into Account The Changes Classified By The Designer As Insignificant (Within The Meaning Of The Construction Law Act) In The Design Documentation During The Execution Of The Task.4. The Detailed Scope Of Works Is Determined By: 1) Design Documentation (According To Appendix No. 8 To The Technical Specifications)2) Technical Specification For The Execution And Acceptance Of Works (According To Appendix No. 9 To The Technical Specifications)3) Bills Of Quantities (According To Appendix No. 10 To The Technical Specifications)4) Equipment For Three Cloakrooms And Power Plant (According To Appendix No. 11 To The Swz) The Employer Will Not Implement The Full Scope Of The Design Documentation, Namely The Scope Of The Contract Does Not Include: 1) Construction Of Two Cash Register Buildings, Including The Cable Installation To These Buildings, 2) Construction Of A Sanitary Building And Water Supply And Sewage Connections , As Well As An External Energy Installation For This Building, 3) Construction Of An Outbuilding, 4) Construction Of A Grandstand For Visitors And Two Toi-Toi Toilets, 5) Construction Of Five Lighting Poles Marked From So-2 To So-6 And Cable Wells At The Poles In Question, 6) Execution Of The Designed Asphalt Pavement, Instead, The Pavement Should Be Made Of Stone Materials While Maintaining The Load Capacity In Accordance With The Design 7) Laying The Designed Surface Of Cobblestones On The West Side Of The Pitch, While The Designed Surface Of Cobblestones Should Be Made Next To The Cloakroom And Club Building. Therefore, The Contractor In The Offer For The Valuation Of Works Does Not Include The Execution Of The Above-Mentioned Elements And The Related Electrical, Sanitary And Electrical Installations – External And Internal.6. Equivalent Solutions: In Each Case Of Using Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Sec. 3 Of The Public Procurement Law, The Employer Allows Solutions Equivalent To Those Described. When Analyzing The Design Documentation, The Contractor Should Assume That Each Reference Referred To In Art. 101 Sec. 1 Point 2 And Sec. 3 Of The Public Procurement Law Used In The Design Documentation Is Accompanied By The Word Or Equivalent. All Criteria And Features Described In Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Set The Minimum Standards That The Offered Product Or Service Must Meet. Specified In The Design Documentation, Bills Of Quantities , St Types Of Materials And Devices Are Given To Determine The Minimum Technical Standard. The Contractor Of The Works Has The Right To Replace Them With Materials And Devices With At Least Equivalent Technical Parameters, Provided That The Assumed Technical Standards Are Met. The Contractor Proposing Equivalent Materials And Devices Is Responsible For Checking The Possibility Of Their Use In Performance Of The Subject Of The Contract In Every Respect (Including, For Example: Properties, Dimensions, Weight, Method Of Transport And Assembly). A Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solutions Offered By Him Meet The Requirements Specified By The Ordering Party. In Such A Case, The Contractor Shall Attach To The Offer A List Of Equivalent Solutions Together With Its Description Or Standards. 7. Building Materials Used To Perform The Subject Of The Contract Must Meet The Requirements Of Art. 10 Of The Act Of July 7, 1994 Construction Law. 8. The Exact Scope Of The Task And Other Information Necessary For The Valuation Of Works Are Presented In The Design Documentation, Technical Specification For The Execution And Acceptance Of Works, Bills Of Quantities, Equipment For Three Cloakrooms And A Gym. Bills Of Quantities Are Only Auxiliary And Informative Material And Are Not Used To Determine The Amount Of Remuneration Due To For A Lump-Sum Form Of Remuneration.9. The Contractor Shall Provide The Ordering Party With A Set Of Documents To Report The Completion Of Works (Protocols, As-Built Inventory, Quantity Survey, Construction Log, Certificates And Declarations Of Conformity For Built-In Materials, Waste Transfer Card).10. The Contractor Is Obliged To Transfer The Waste Generated During The Performance Of The Subject Of The Contract To The Entity Authorized To Dispose Of Waste And To Provide The Ordering Party With A Document Confirming This Activity (Waste Transfer Note).
