Note: The Bills Of Quantities Attached To The Swz Are Auxiliary. Due To The Lump-Sum Nature Of The Contractual Remuneration, The Offer Price Should Include The Actual Costs Of The Task Implementation Resulting From The Design Documentation, Stwiorb And The Provisions Of The Swz. As Part Of The Subject Of The Contract, The Contractor Is Obliged To Provide Geodetic Services, Restore The Area To Its Previous Condition. The Contractor Must Prepare The Following Documents At Its Own Expense: As-Built Geodetic Inventory For All Roads Covered By The Public Procurement Procedure And As-Built Documentation For All Roads. The Employer Requires A Guarantee For The Completed Subject Of The Contract For A Period Of: Minimum 3 Years - Maximum 5 Years From The Date Of Acceptance Of The Construction Works By The Employer And Signing (Without Comments) Of The Final Report. Statutory Warranty Period. Source Or A Particular Process That Characterizes The Products Or Services Provided By A Particular Contractor, Such Indication Shall Be Understood To Be Accompanied By The Words Or Equivalent. The Ordering Party Accepts Materials And/Or Equivalent Solutions, Provided That The Technical, Quality And Functional Parameters Are Not Worse Than Those Indicated In The Documentation And Do Not Lead To A Change In Technology. The Names Indicated In The Documentation Should Be Treated As Examples. Technical And Quality Features Of The Subject Of The Contract Should Comply With Polish Standards Transposing European Standards Or Standards Of Other Member States Of The European Economic Area. Describing The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, Referred To In Art. 101 Of The Public Procurement Law, The Employer Allows Solutions Equivalent To Those Described. The Contracting Authority May Not Reject A Tender Only Because The Offered Works, Supplies Or Services Do Not Comply With The Standards, Technical Assessments, Technical Specifications And Technical Reference Systems To Which The Description Of The Subject Of The Contract Refers, Provided That The Contractor Proves In The Tender, In Particular By The Means Of Evidence Referred To In Art. 104-107 Of The Public Procurement Law That The Proposed Solutions Meet The Requirements Specified In The Description Of The Subject Of The Contract To An Equivalent Degree. The Contractor Who Refers To Equivalent Solutions Is Obliged To Demonstrate That The Solution He Offers Meets The Requirements Specified By The Employer.
