1. The Subject Of The Contract Are Services Entitled: Maintenance Of Greenery In The Right-Of-Way Of Poviat Roads In 2023.2. The Subject Of The Contract Includes The Maintenance Of Greenery In The Right-Of-Way Of Poviat Roads In The Piła Poviat. The Order Provides For The Maintenance Of Poviat Roads In Nine Communes: Piła, Łobżenica, Ujście, Wyrzysk, Wysoka, Białośliwo, Kaczory, Miasteczko Krajeńskie, And Szydłowo In The Piła Poviat, Including Rural And Municipal Roads. 3. The Subject Of The Contract Includes The Following Works: 1) Felling Bushes With A Diameter Of Up To 50 Cm (Diameter Measured At The Ground) Along With Their Removal; 2) Felling Trees With A Trunk Circumference Of 50 Cm To 400 Cm (Circumference Measured At 1.3 M High);3) Felling Trees With A Trunk Circumference Of More Than 400 Cm (Circumference Measured At 1.3 M High);4) Correcting The Tree Crown By 1/3 (Using A Lift) Along With Removing The Branches;5) Pruning The Tree To The Height Road Gauge (4.5 M) Along With Shoots Near The Ground And Clearing Away Branches;6) Milling The Trunk Of A Felled Tree To The Level Of The Roadside;7) Planting Trees (Common Species) With A Trunk Circumference Of 8-11 Cm With Wrapping (2 Stakes 2 Pcs. Ø 4 Cm/250 Cm);8) Planting Trees (Common Species) With A Trunk Circumference Of 12-14 Cm With Wrapping (2 Stakes Ø 4 Cm/250 Cm);9) Planting Trees (Common Species) With A Trunk Circumference Of 15-16 Cm With Wrapping (2 Stakes, Ø 4 Cm / 250 Cm). The Contractor Undertakes To Perform The Contract With Due Accuracy, In Accordance With The Detailed Technical Specifications (Appendix No. 4 To The Swz) And With The Applicable Legal Regulations.4. As Part Of The Order, The Contractor Is Obliged To Perform All Preparatory, Cleaning And Management Of Waste Generated During The Performance Of The Works.5. The Contractor Is Obliged To Purchase From The Employer And Use On Its Own The Wood Obtained From Logging At The Price Specified In Resolution No. 872/2023 Of The Poviat Board In Piła Of February 8, 2023 On Determining The Sale Prices Of Wood From Logging Of Roadside Trees:1) Hard Deciduous Wood (Oak, Maple, Elm, Acacia, Hornbeam, Birch, Ash) - Pln 149.00/M³;2) Coniferous Wood - Pln 120.00/M³;3) Soft Deciduous Wood ( Poplar, Willow, Linden) - Pln 119.00 / M³. Value Added Tax Will Be Added To The Above Prices, In Accordance With Applicable Regulations. 6. The Contractor Is Obliged To Draw Up A Report On The Measurement Of The Obtained Wood Mass And Submit It For Approval To The Committee Of The Poviat Road Management In Piła.7. The Works Being The Subject Of The Order Will Be Performed Each Time On Commission As Needed. The Expected Scope Of Works Is Specified In Appendix No. 1 To The Swz - The Offer Form. The Quantities Indicated In The Offer Form Are Estimated Quantities And Are Used To Calculate The Price Of The Offer, Compare The Submitted Offers And Select The Contractor.8. All Works Being The Subject Of The Order Will Be Performed On The Basis Of Written Orders Issued By The Director Or An Authorized Employee Of The Poviat Road Administration In Piła, In Which Each Time The Place Of Work, Its Scope And Date Of Completion Will Be Indicated. The Minimum Completion Date Will Be Up To 21 Days From The Date Of Issuing The Written Order, Subject To Point 3.9. Swz. 9. In Emergency Situations, In The Event Of A Threat To Health And Life In Road Traffic, Verbal Orders Are Allowed, Which Must Be Immediately Confirmed In Writing. In The Above Situations, The Contractor Will Proceed To Perform The Works In Accordance With The Reaction Time Specified In The Offer (The Reaction Time Is The Criterion For Evaluating Offers - In Accordance With Point 16 Of The Swz).10. The Scope Of Work Specified In Each Order Is Subject To Protocol Acceptance. Readiness To Collect The Completed Works Should Be Reported To The Poviat Road Administration In Piła. The Works Will Be Accepted By The Committee Of The Poviat Road Administration In Piła Within 14 Days From The Date Of Notification Of Readiness For Acceptance By The Contractor. Performing The Works At The Same Time Involves Tidying Up The Area Where The Works Were Carried Out, I.E.: Removal Of Wood, Excavated Material, Removal Or Chipping Of Shrubs/Branches. It Is Allowed To Set A Longer Period For Clearing Branches Or Spoil.11. The Contractor Is Obliged To Maintain Public Traffic On The Roads During The Performance Of The Works Covered By The Contract.12. The Contractor Should Have Vertical Signs And Other Safety Devices For The Duration Of The Works In Order To Mark The Works Covered By The Order In Accordance With The Regulations. The Cost Of Securing Signs And Devices, As Well As Their Disassembly, Should Be Included In The Price Of The Offer.13. During The Performance Of The Contract, The Contractor Is Obliged To Apply All The Requirements Set Out In The Provisions On Environmental Protection.14. Comments Submitted By The Director Or Employee Of The Poviat Road Administration In Piła Regarding The Quality Of The Work Performed Should Be Removed On An Ongoing Basis, However, Not Later Than Within 14 Days From The Date Of Notification.15. The Contractor Undertakes To Provide A Guarantee For The Plantings Made For A Period Of 24 Months, In Accordance With The Provisions Of Appendix No. 5 To The Tor - Draft Provisions Of The Public Procurement Contract, Which Will Be Introduced To The Public Procurement Contract.16. The Contracting Authority Specifies The Requirements Referred To In Art. 95 Of The Public Procurement Law. The Ordering Party, Pursuant To Art. 95 Of The Public Procurement Law Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing The Following Activities In The Scope Of Order Performance: - Operation Of A Chainsaw, - Operation Of A Chainsaw At A Height, - Driver Of A Category C Car. The Method Of Verifying The Employment Of These Persons And The Employers The Scope Of Control Of The Contractors Compliance With The Above Requirements And The Sanctions For Failure To Meet These Requirements Are Set Out In Appendix No. 5 To The Tor - Draft Provisions Of The Public Procurement Contract, Which Will Be Introduced To The Content Of This Contract.17. The Ordering Party Does Not Provide For The Award Of Contracts Referred To In Art. 214 Sec. 1 Point 7 Of The Public Procurement Law.
