1. The Name Given To The Contract By The Ordering Party: Construction Of An Activity Center With A Workshop Part For Children And Teenagers Practicing Speed-Bike Sport.2. Subject Of The Contract. The Subject Of The Task Is Construction, Which Includes The Addition Of A Workshop Room On The Ground Floor, An External Staircase And A First Floor Of The Building Together With Partition Walls Of The Vestibule On The First Floor (Entrance To The Common Room). The Changing Rooms And Toilets Are Existing On The Ground Floor Of The Building. On The First Floor, There Is A Teaching Room With A Small Kitchen Area - No Equipment. Scope Of Works To Be Performed, E.G.: - Demolition Of The Existing Cube Within The Workshop Extension - Earthworks For The Concrete Slab Of The Extension - Foundation Slab For The Workshop - Footings For The Stairs - Workshop Room On The Ground Floor, Walls Without Plaster, Wall-Mounted Electrical Installation - Disassembly Of The Advertising Banner - Disassembly Of Temporary Insulation On The Ceiling - First Floor Walls - Structural + Partition Walls - Wooden Roof Above The First Floor Together With The Covering.3. A Detailed Description Of The Subject Of The Contract Is Contained In Annex I.4 To The Swz And In The Documents Referred To In Point 3.4. Swz.4. The Subject Of The Order Should Be Performed In Accordance With The Design Documentation And The Technical Specifications For The Execution And Acceptance Of Works Contained In Annex I.6 To The Swz. 5. In Order To Make A Full Valuation Of The Works, Each Of The Contractors Is Obliged To Read The Design Documentation, Stwior And The Provisions Of This Swz.6 Before Submitting The Offer. The Contractor Shall Provide A Guarantee For The Works Covered By The Contract For The Executed Subject Of The Order For A Period Of Min. 36 Months And Warranty For Defects In Works For A Period Equal To The Warranty Period. Note: The Additional Guarantee For The Works (Warranty Extension Period) Is Subject To Scoring In Accordance With The Bid Evaluation Criteria Set Out In Point 31.2. Swz.7. The Ordering Party Informs That The Indications Of Common Names, Trademarks, Names Of Producers, Photos In The Included Elements Of The Description Of The Subject Of The Contract, Which May Appear In The Swz Together With The Attachments, Serve Only To Determine The Visual, Technical And Qualitative Features. The Names Of Products, Trademarks, Patents Or Origin Used In The Swz Together With Attachments Should Be Treated As Examples - The Ordering Party Allows The Use Of Equivalent Products (Materials, Equipment). An Equivalent Product Is A Product That Will Have The Same Functional, Visual, Material And Technical Features As The Specific Product Indicated In The Stc, But It Is Marked With A Different Trademark, Patent Or Origin. The Quality Of The Equivalent Product May Not Be Worse Than That Described In The Subject Of The Order, It May Not Lower The Standard In Any Way And May Not Change The Rules And Technical Solutions Adopted In This Tor, And Thus Deprive The User Of Any Performance, Functionality, Usability Described Or Resulting From The Tor. The Contractor Who Accepts Equivalent Solutions (Products) For The Evaluation Of The Offer Is Obliged To Prove The Equivalence Of The Adopted Solutions, Including Equipment And Materials. In Order To Confirm That The Offered Equivalent Solution Meets The Requirements Set Out In The Tor, The Contractor Is Obliged To Submit A Detailed Description / List Of The Offered Subject Of The Equivalent Procurement Together With The Tender, In Which For Each Solution It Will Specify The Features Allowing For The Unambiguous Identification Of The Offered Solution And Confirmation Of Compliance With The Description Of The Subject Of The Procurement . Note: Failure To Submit Such A Description/List Will Be Tantamount To Acceptance Of The Solutions Indicated In The Swz And Annexes To The Swz.8. The Employer Informs That In The Case Of Reference In The Description Of The Subject Of The Contract Contained In The Tor With Attachments To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems, Solutions Equivalent To Those Described Are Allowed, Which Are Understood As Such Technical, Operational And Utility Solutions That Ensure Meeting The Minimum Requirements At A Level Not Worse Than Specified In The Above-Mentioned Documents, Enabling The Achievement Of The Effect Assumed By The Ordering Party Using The Technical Solutions Indicated In The Swz Together With Attachments. In The Event Of Reference In The Swz Together With Appendices To Specific Standards Or Other Regulations To Be Met By Materials, Equipment, Devices And Other Goods As Well As Performed And Tested Works, The Provisions Of The Latest Edition Or Revised Edition Of The Referenced Standards Or Regulations Shall Apply, Provided That The Documents The Order Is Not Indicated Otherwise. 9. The Information On Parameters And Functions Included In This Swz Together With The Attachments Are The Minimum Data - The Ordering Party Allows Offering Products With Extended Functions And Better Parameters, Provided That They Meet The Minimum Requirements Specified In This Order.10. According To Art. 100 Sec. 1 Of The Public Procurement Law, The Employer Requires That The Subject Of The Contract Be Implemented Taking Into Account The Requirements Regarding Accessibility For People With Disabilities And Designing For All Users, In Particular In Accordance With The Principles Of Universal Design Referred To In The Convention On The Rights Of Persons With Disabilities Of December 13, 2006 (Journal Of Laws Of 2012, Item 1169, As Amended).11. The Ordering Party Requires That The Persons Indicated By The Contractor, Who Will Participate In The Performance Of The Order And Contact The Ordering Party During The Execution Of The Subject Of The Order, Should Be Able To Communicate In Polish. In The Event That The Above Persons Who Do Not Speak Polish, During The Term Of The Contract And For The Purposes Of The Performance Of The Subject Of The Order, The Contractor Is Obliged To Provide An Interpreter At His Own Expense And With His Own Efforts.12. According To Art. 95 Of The Public Procurement Law, The Employer Requires The Contractor Or Subcontractor To Employ, On The Basis Of An Employment Relationship, Persons Performing Activities Related To The Performance Of The Contract, Consisting In The Performance Of: Masonry And Construction Works, If The Performance Of These Activities Consists In Performing Work In The Manner Specified In Art. 22 § 1 Of The Act Of June 26, 1974, The Labor Code (Journal Of Laws Of 2022, Item 1510, As Amended), Unless These Activities Are Performed By These Persons As Part Of Their Business Activity. The Selected Contractor Is Obliged To Submit To The Employer, Prior To Signing The Contract, The Contractors Or Subcontractors Statement On The Employment Of Employees Under The Employment Contract, Containing The Information Necessary To Verify The Employment, In Particular: Name And Surname Of The Employed Employee, Date Of Conclusion Of The Employment Contract, Type Of Employment Contract And Scope Of Duties Of The Employee . Information On Control Rights And Sanctions For Non-Compliance With The Above. Requirements Are Specified In The Contract Template, Constituting Appendix No. I.5 To Swz .13. The Selected Contractor Is Obliged To Implement The Subject Of The Contract In Accordance With The Requirements In The Field Of Electromobility Referred To In Point 43.14. The Selected Contractor Is Obliged To Submit To The Ordering Party, Before Signing The Contract, A Copy Of The Current Civil Liability Insurance Policy In The Scope Compliant With § 11 Section 7 Of The Contract Template.
