The Accepted Types Of Materials And Devices (Indicated In The Technical Documentation) Have Been Used Only As An Example To Describe The Subject Of The Order. The Contractor Is Entitled To Present In The Offer Materials And Devices Equivalent, With Not Worse Parameters. The Contractor Should Specify Their Parameters In Order To Prove That They Meet The Conditions Specified In The Description Of The Subject Of The Contract. Equivalent Solutions, According To Their Definition, Must Have Parameters And Meet Standards Not Worse Than The Products Given As Examples. In All Places Of The Tor And Appendices To The Tor, Where An Exemplary Trademark, Patent, Origin, Source Or Specific Process Is Used, Which Characterizes The Products Or Services Provided By A Specific Contractor, Or If The Employer Described The Subject Of The Contract By Reference To Standards, Technical Assessments, Technical Specifications And Technical Reference Systems Referred To In Art. 101 Sec. 1 Point 2 And Par. 3 Pzp, And In Each Case, Acting In Accordance With Art. 99 Sec. 6 And Art. 101 Sec. 4 Of The Ppl, The Employer Allows Solutions Equivalent To Those Specified In The Tor And In The Appendices To The Tor, Marking Such Indications Or References With The Words Or Equivalent Or Or Equivalent Respectively, Provided That The Parameters Are Not Worse Than Those Specified In The Description Of The Subject Of The Contract. An Equivalent Solution Is Also Acceptable If The Word Equivalent Or Equivalent Is Not Included In The Description Of The Subject Of The Contract. Equivalence Consists In The Possibility Of Offering The Subject Of The Contract With Not Worse Technical Parameters, Configurations, Normative Requirements, Etc. Some Manufacturer-Specific Dimensions May Be Given. Proper Names Of Manufacturers Of Materials And Devices Given In The Detailed Description Should Be Understood As The Preferred Type In Terms Of Determining The Minimum Quality Requirements. They Are Not Binding And You Can Provide Equivalent Elements That Have At Least The Same Or Better Standards, Technical Parameters; Qualitative, Functional, Thematically Identical And For The Same Purpose, And Will Not Lower The Standards Specified In The Description Of The Subject Of The Contract. All Products From Specific Manufacturers Specify The Minimum Quality Parameters And Functional Characteristics That The Goods Must Meet In Order To Meet The Requirements Set By The Ordering Party And Constitute Only The Quality Model Of The Subject Of The Order. By Recording The Minimum Requirements Of Quality Parameters, The Ordering Party Understands The Requirements Of The Goods Contained In Publicly Available Sources, Catalogs And Websites Of Manufacturers. The Use Of Exemplary Names Of The Manufacturer Is Only Intended To Clarify The Level Of Expectations Of The Ordering Party In Relation To A Specific Solution. Thus, The Use Of The Names Of Manufacturers/Products/ Is Only Exemplary. When Describing The Subject Of The Contract, The Contracting Authority, Indicating The Designation Of A Specific Manufacturer (Supplier) Or A Specific Product, Allows Equivalent Products With Quality Parameters And Functional Characteristics, At Least At The Level Of The Parameters Of The Indicated Product, Thus Recognizing Any Product With The Indicated Parameters Or Better. In Such A Situation, The Ordering Party Requires The Submission Of Relevant Documents To Authenticate These Materials Or Devices Along With The Offer. They Will Be Assessed During The Examination Of The Offer.
