The Subject Of The Contract Is Described In Detail By: Design Documentation, Technical Specification And Bills Of Quantities Attached To This Specification.2. The Bill Of Quantities Is Auxiliary. The Contractor Is Obliged To Carefully Check The Amount Of Works Against The Design Documentation. Due To The Fact That The Contract For Works Will Be A Lump-Sum Contract, If More Works Occur In The Course Of The Works In Any Position, It Will Not Be Considered As Additional Works With A Demand For Additional Remuneration. The Possible Lack In The Bill Of Quantities Of Certain Works Necessary To Be Performed On The Basis Of The Design Documentation (Including The Executive Design) Does Not Release The Contractor From The Obligation To Perform Them On The Basis Of The Design At The Contractual Price. 3. Quality And Material Requirements. To Perform The Order, The Contractor Is Obliged To Use Materials Guaranteeing Appropriate Quality With Technical And Quality Parameters Not Worse Than Those Specified In The Bill Of Quantities And Technical Specifications For The Execution And Acceptance Of Works. It Is Forbidden To Use Materials That Do Not Meet The Requirements Of Polish Standards. The Contractor Is Obliged To Have Documents Confirming The Permission To Use / Incorporation (Attestations, Certificates, Declarations Of Conformity, Quality Certificates) For The Materials And Devices Used. Any Proper Names, Trademarks, Patents, Origins, Sources Or Specific Processes Given In The Descriptions, Which Characterize The Product Or Services Provided By A Specific Contractor, Standards, Etc. Are Not Intended To Violate Art. 16 Of The Public Procurement Law And 99 Sec. 4 Of The Public Procurement Law, But In Particular They Serve The Implementation Of Art. 17 Sec. 1 Point 1 And 2 Of The Public Procurement Law. The Descriptions Contained In The Swz Are Intended To Specify The Quality, Technological, Performance Or Functional Expectations Of The Employer. According To Art. 99 Sec. 5 And Sec. 6 And Art. 101 Sec. 4 The Contracting Authority Indicates That The Contractor May Offer The Subject Of The Contract Specified In The Description Contained In The Tor Or Equivalent. The Employer Allows Equivalent Solutions Provided That The Same Technological, Performance And Functional Level Assumed In The Swz Are Met. The Contractors Obligation To Demonstrate Equivalence Is An Obligation Resulting From The Public Procurement Law, Which May Be Fulfilled In Any Way Allowing The Ordering Party To Unequivocally State The Compliance Of The Services/Products Offered In The Offer With The Requirements Set Out In The Tor, Which Should Be Demonstrated At The Stage Of Submitting Tenders.4. The Ordering Party Does Not Allow Variant Offers And Offers In The Form Of Electronic Catalogues.5. The Ordering Party Does Not Intend To Award The Contract Referred To In Art. 214 Sec. 1 Point 7 And 8 Pzp.6. The Ordering Party Does Not Provide For The Contractors Obligation To Visit The Site And Check The Documents Necessary For The Execution Of The Order Available On Site At The Ordering Partys.
