1. The Subject Of The Contract Is Construction Of The Sewage Network In The Sławno Commune - Stage Iii2. Material Scope Of The Investment: 1) From The Technical Design Of The Construction Of The Sanitary Sewage Network With The Accompanying Infrastructure In The Following Towns: Janków-Psary, Dąbrowa, Sławno Commune, And From The Technical Design Of The Sewage Connection To The Meat Processing Plant - Plot No. 1503 Within Dąbrowa. List Of Network Lengths :A) Gravity Ducts - Pvc - U Ø 160 Class S (Sdr 34, Sn 8) L = 1997.50 Running Meters - Pvc - U Ø 200 Class S (Sdr 34, Sn 8) L = 3116.40 Running Meters - Hdpe Ø 160, Rc L = 1541.30 Lm - Hdpe Ø 225, Rc L = 689.30 Lm. Running Meters - Pehd Ø 110, Rc L = 148.00 Running Meters • Sewage Pumping Stations Ps15 And Ps16 With Power Supply (Wlz).3. Dividing The Contract Into Parts The Contracting Authority Does Not Divide The Contract Into Parts. Thus, The Contracting Authority Does Not Allow The Submission Of Partial Tenders Referred To In Art. 7 Points 15 Of The Public Procurement Law. Reasons For Not Making The Division: Coordination Of Activities Of Various Contractors Implementing Individual Parts Of The Contract Could Seriously Jeopardize The Proper Performance Of The Public Contract. One Contractor Guarantees Proper Coordination Of Works And Allows To Reduce The Costs Of Execution (Joint Transport, Common Machines For Each Type Of Works). An Important Element Is Also The Provision Of A Joint Guarantee For All Works By One Contractor. Moreover, Dividing The Contract Into Parts Would Cause Excessive Difficulties, Costs And The Inability To Coordinate The Scopes Performed, Resulting In A Serious Risk Of Incorrect And Untimely Performance Of The Contract.4. The Scope And Method Of Execution Of The Subject Of The Order Are Specified (Appendix No. 1 To The Tor) - Design Documentation And The Draft Agreement Constituting (Appendix No. 2 To The Tor).5. Objective Means Of Evidence. The Ordering Party Does Not Require The Means Of Evidence In Question In These Proceedings.7. The Contractor Is Obliged To Bear All Costs Related To The Occupation Of The Right-Of-Way (Municipal, District Roads And National Road No. 12).8. The Contractor Is Obliged To Bear All Costs Related To The Reconstruction Of The Surface In The Event Of Damage - The Surface To Be Restored Depends On The Technology Of The Execution Of Works By The Contractor.9. The Contractor Is Obliged To Remove Trees And Shrubs That Interfere With The Performance Of The Subject Of The Contract. 10. The Contractor Is Obliged To Carry Out And Mark The Works In Accordance With The Traffic Organization Design, Which He Will Prepare Himself For The Duration Of Construction.11. The Contractor Is Obliged To Provide Persons To Perform The Functions Of: - Construction Manager In The Field Of Sanitary Networks And Installations; - Construction Manager In The Field Of Power Connection - Power Supply To The Sewage Pumping Station.12. Information On Equivalent Solutions: 1) In The Event That In The Description Of The Subject Of The Contract (Annexes To The Tor) The Ordering Party Defined The Subject Of The Contract By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Characterizes The Products Or Services Provided By A Specific Contractor, If This Could Lead To The Privilege Or Elimination Of Certain Contractors Or Products, It Allows The Possibility Of Submitting Equivalent Tenders. The Above-Mentioned Specification Of The Subject Of The Contract Is Only Of An Auxiliary Nature In The Preparation Of The Offer And Is Intended To Indicate The Expected Standards As To The Minimum Technical Parameters Of The Expected Materials And Devices. 2) An Equivalent Offer Should Be Understood As An Offer With Technical Parameters Of Strength, Quality And Performance Not Worse Than The Description Indicated By The Ordering Party In The Description Of The Subject Of The Contract. The Parameters Indicated By The Ordering Party Are The Minimum And Limit Parameters. The Term Parameters Is Understood As Functionality, Purpose, Colors, Structure, Materials, Shape, Size, Safety, Durability, Etc. In Connection With The Above, The Ordering Party Allows The Possibility Of Offering Materials With Other Trademarks, Patents Or Origins, But Not With Other Properties And Functionalities Than Those Specified In The Swz. 3) The Contractor Referring To Solutions Equivalent Pursuant To Art. 101 Sec. 5 Of The Public Procurement Law. Must Prove That The Offered Deliveries Meet The Conditions Specified By The Ordering Party To A Degree Not Worse. If The Contractor Fails To Submit Documents On The Use Of Other Materials And Devices In The Offer, It Shall Be Understood That The Materials And Devices Proposed In The Description Of The Subject Of The Order Have Been Included In The Calculation Of The Offer Price And The Performance Of The Contract. The Obligation To Prove The Equivalence Rests With The Contractor. 101 Section 1-3 Of The Public Procurement Law, They Should Be Understood As Exemplary. Pursuant To Art. 101 Sec. 4 Of The Public Procurement Law. Allows In Each Case The Use Of Solutions Equivalent To Those Described In The Tor. Each Time A Standard Is Indicated In This Tor Or Appendices To The Tor, It Should Be Assumed That The Wording Or Equivalent Has Been Used In Relation To It.
