1. The Subject Of The Tender Is The Selection Of A Contractor Who Will Perform Deliveries For The Ordering Party Consisting In The Successive Delivery Of Reagents (Tests) Along With The Lease Of An Analyzer For Identifying And Determining The Drug Susceptibility Of Strains For The Needs Of Szpital Powiatowy Im. Dr. Tytus Chałubiński In Zakopane, Ul. Kamieniec 10, 34-500 Zakopane. 2. The Ordering Party Stipulates That The Delivered Subject Of The Order Referred To Above Must Have The Current Authorization Required By Law Allowing For Marketing And Use In Poland, Allowing For Medical Use In Accordance With The Intended Purpose, And: 1) Meet The Recommendations Of The European Committee For Antimicrobial Susceptibility Testing (Eucast),2) Possess A Positive Opinion Of The National Reference Center For Antimicrobial Susceptibility Testing (Korld) For An Automatic System For Identification And Susceptibility Testing, As Well As Susceptibility Testing Media And Tests,3) Possess An Iso 13485 (Or Equivalent) Quality Certificate Of The Offered Products Being The Subject Of This Procedure, 4) Have Quality Control Certificates For Each Series Of Substrates, Serological/Diagnostic Tests And Drug Sensitivity Tests. 3, The Economic Operator May Have Equivalent Documents Issued By Entities Established In Another Member State Of The European Economic Area. In Addition, A Contractor Who, For Reasons Beyond His Control, Is Unable To Obtain The Certificate Referred To In Point 3, May Have Another Document On Quality Assurance Or Environmental Management Measures, Respectively, Confirming The Application By The Economic Operator Of Quality Assurance Measures Compliant With The Required Quality Assurance Standards Or Environmental Management Measures Equivalent To Those Required Under The Applicable Environmental Management System Or Standards. 3. The Ordering Party Stipulates That The Delivery Of Laboratory Reagents Being The Subject Of This Procedure For The Duration Of The Contract Will Be Carried Out Successively On The Basis Of Partial Orders Placed By The Laboratory Manager Via Electronic Means Of Communication.4. The Ordering Party Stipulates That The Implementation Of Each Partial Delivery Of Reagents Covered By The Subject Of This Order Will Be Carried Out Successively, No Later Than Within 7 Calendar Days (Note - Parameter Assessed In The Tender Selection Criteria) From The Date Of Placing The Partial Order From 8:00 To 14:00.5 . Replacement Of Defective Goods, Not In Accordance With The Partial Order, Goods Of Poor Quality, Delivered In Improper Packaging Will Take Place Within 48 Hours Of Submitting The Complaint At The Cost And Risk Of The Contractor.6. The Ordering Party Informs That The Amount Of Reagents Specified In The Tor, Which Are The Subject Of This Tender Procedure, Is An Estimated Value And During The Execution Of The Contract In Question May Be Changed, Reduced By No More Than 20%, Depending On The Actual Needs Of The Ordering Party.7. The Purpose Of This Procedure Is To Obtain Products With The Technical, Quality, Operational And Functional Parameters Specified In The Swz, And Not To Purchase Reagents And Lease An Analyzer From A Specific Manufacturer. For These Reasons, The Contracting Authority Has Exercised Due Diligence To Ensure That The Subject Of The Contract Is Not Described By Indicating Trademarks, Patents Or Origin, Source Or Specific Process That Could Lead To Favoring Or Eliminating Certain Contractors Or Products. If, Despite This, It Turns Out That Such Indications Appear In Any Place Of The Swz And In The Annexes Thereto, They Should Not Be Treated As Requirements Relating To The Subject Of The Contract, And Should Be Considered Only In Terms Of Informational Indications (Not Binding For Contractors) . For These Reasons, An Offer That Does Not Comply With Such Indications Will Not Be Considered Inconsistent With The Content Of The Tor And Will Not Be Rejected For These Reasons. 8. The Conditions For The Performance Of The Contract Are Included In The Draft Contract, Which Is Attached As Appendix 5 To This Tor.
