Responsible For Any Damage To The Turf Roads Or Headstones Caused By Dropping Parts Of The Tree All Wood Chip Particles And Debris From The Tree Removal Shall Be Cleaned Up Thoroughly And Removed From The Cemetery Daily The Contractor Shall Take Every Precaution To Prevent Any Falling Branches Or Trees From Damaging Any Headstones Adjacent Plant Material Or Cemetery Structures All Stumps Shall Be Removed Using Stump Grinding Equipment With The Stump Grinder Making Repeated Passes Over The Stump Stumps And All Surface Roots Shall Be Ground To At Least 4 Below The Soil Surface And All Stump Root Crossing Or Rubbing Branches Where Practicable So The Removal Will Not Leave Large Holes In The Canopy Of The Tree Natural Crown Characteristics And Growth Patterns Of The Tree The Contractor Is Responsible To Ensure That When Pruning Trees Known To Be Diseased Or Susceptible To Diseases Tools Are Disinfected With Alcohol After Each Cut And Between Trees Where There Is Known To Be Danger Of Transmitting The Disease On The Tools The Contractor Is Responsible For Reporting To The Cor All Of The Following Conditions When Old Scars Are Not Healing Properly Where Callus Growth Is Not Already Therefore The Contractor Is Responsible To Ensure That These Methods Are Never Performed Topping Stubbing De Horning And Pollarding Equipment That May Damage The Tree Bark Or Cambium Layer Should Not Be Used On Or In The Tree Unless Removing The Tree Altogether The Contractor Is Not Permitted To Use Climbing Spikes Or Spurs To Climb Any Live Tree Scheduled For Pruning The Contractor Is Responsible To Ensure That In Lifting The Bottom Branches Of The Trees For Under Clearance Care Shall Be Given To Symmetrical Appearance Aesthetic Appearance Natural Crown Characteristics And Growth Patterns Of The Trees In General The Contractor Shall Ensure When Reducing The Size Of A Tree And With Respect To Retaining The Tree S Natural Crown Characteristics And Patterns Not More Than 1 4 Of The Total Area Shall Be Reduced At A Single Operation Utility Lines Compliance Where Pruning Stump Grinding Or Tree Removal Conflicts With Existing Utility Service Lines Above Or Below Ground Cemetery Personnel Require Maximum Coordination Between The Government And The Contractor The Government Shall Provide At The Time Of Contract Award A List Of Government Personnel Authorized To Act As Contracting Officer S Representatives Meetings Unless Otherwise Agreed The Contractor Shall Meet With The Cor Grounds Foreman At The End Of Each Day To Determine The Work Accomplished And To Coordinate The Following Day S Schedule Daily Meetings Are Also An Opportunity For The Contractor To Communicate Ask Questions And Ensure He She Understands The Off Limit Areas Which May Vary Depending On The Event Complex So That Productive Use Of Labor And Equipment Is Assured And Downtime Is Avoided If The Contractor Fails To Re Direct Employees Away From An Event In A Timely Fashion The Cor May Then Do So In Addition To Meeting With The Cor The Contractor May Be Required To Attend Meeting S With Other Government Personnel Work Environment All Work Under This Service Contract Will Be Performed Primarily Outdoors And Personnel Performing The Services Will Be Exposed To Wind Sun Cold Dampness Frost Fog And Rain These Conditions May At Times Be Extreme And Dangerous The Contractor Shall Take All Necessary Precautions To Protect Its Employees From The Elements To The Maximum Practicable Extent In The Event Climate Or Weather Conditions Become Unsuitable For Work The Work Shall Resume As Soon As Conditions Permit Responsibilities All Contract Administration Matters Will Be Handled By The Government Contracting Officer The Contracting Officer s Representative For The Contract Will Be Adhere To The Following Standards Of Dress And Conduct While Performing Work In The Baltimore National Cemetery These Standards And Regulations Are Enforceable Under Title 38 U S C Section 218 Shall Be Fully Clothed At All Times To Include Long Slacks Or Pants And Shirt Buttoned Up From Neck To Waist Clothing Shall Be Clean Each Day Any Soiled Clothing Should Be Cemetery Work Related That Day T Shirts And Or Tank Tops As Outer Garments Are Prohibited Shoes Boots Will Have No Holes Or Loose Soles Steel Toed Shoes Will Be Required In Accordance With Osha Contractor Employees Will Maintain Personal Hygiene Shall Not Engage In Loud Or Boisterous Behavior Or Use Profane Or Abusive Language Will Show Proper Reverence During Committal Service Shall Not Eat Or Drink Beverages Except Water Or Non Alcoholic Drinks While In The Work Area Or In Site Of Committal Shelter During A Service Use Of Intoxicating Beverages And Or Drugs Is Strictly Prohibited Contractor Personnel Shall Not Lean Sit Or Stand On Or Against Headstones Or Monuments No Tools Equipment Or Other Items Will Be Placed Or Leaned On Headstones Or Monuments Smoking Is Not Permitted In Any Buildings Within The Baltimore National Cemetery Complex This Restriction Includes Offices Restrooms Stairwells Entrances Exits Or Any Other Public Area Use Of Cemetery Facilities The Government Shall Not Be Responsible For Any Loss Damage Or Theft Of Contractor Items Nor Shall Free Telephone Service Be Provided Contractor Shall Be Responsible For Acceptable Standards Of Housekeeping And Custodial Maintenance Of Department Of Veterans Affair S Facilities Used By Contractor s Employees Contractor Employees May Park Privately Owned Vehicles In The Area Designated For Parking By The Contracting Officer Representative There Are No Available Buildings Or Storage Areas At The Cemetery Site For The Contractor To Store Supplies And Or Equipment All Contractor Supplies Materials And Equipment Brought On Site Necessary For Contract Performance Shall Be Removed From The Premises At The End Of Each Workday The Contractor Will Be Responsible For Safely Handling Any Chemicals Pesticides Herbicides Cleaning Solutions Etc In Accordance With Manufacturers Recommendations An Msds Material Safety Data Sheet Is Required For All Chemicals Pesticides Herbicides And Cleaning Solutions Insurance Amp Evidence Of Coverage Prior To Commencing Work Under This Contract The Contractor Shall Furnish To The Contracting Officer A Certificate Of Insurance Indicating The Kinds And Types Coverage Specified In This Section And As Elsewhere Provided In This Contract The Insurance Certificate Shall Also Contain An Endorsement To The Effect That Cancellation Of Any Material Change In The Policies Which Adversely Affect The Interests Of The Government In Such Insurance Shall Not Be Effective Unless A 30 Day Advance Written Notice Of Cancellation Or Change Is Furnished To The Contracting Officer Workmen s Compensation The Contractor Agrees To Procure And Maintain For The Contract Period Workmen s Compensation And Employers Public Liability Insurance In Accordance With The Laws Of The State Of Maryland The Policy Shall Provide Coverage For Public Liability Limits Of Not Less Than Statutory Limitations If More Than One Person Is Involved Liability Amp Indemnification The Contractor Shall Take All Necessary Precautions To Prevent Damage To Headstones Markers Monuments Flower Vases And Other Cemetery Structures During Execution Of This Contract The Contractor Shall Be Charged Current Replacement Costs For Headstones Or Other Property Damaged Because Of Actions By Contractor Personnel It Is Agreed And Understood That There Is No Limitation On The Contractor S Liability In No Event Shall The Government Indemnify And Hold Harmless The Contractor From Any And All Damages Expenses Or Harm Incurred By The Contractor Or From Any And All Damages Expenses Or Claims Which May Arise From Third Party Claims The Department Of Veterans Affairs Shall Indemnify And Hold Harmless The Contractor From And Against Any And All Claims Demands Damages Liabilities Or Causes Of Action Resulting From The Negligent Acts Or Omissions Of The Department Its Agents And Employees Acting Within The Scope Of Their Federal Employment Arising From The Performance Of This Contract Contractors Shall Provide Proof Of Grounds At The End Of Each Workday No Chemicals Are To Be Used At Any Time On Government Property The Contractor Shall Bear All Costs Associated With Washing And Cleaning Any Such Washing Cleaning Shall Be Brought To The Immediate Attention Of The Cor Prior To Washing Cleaning The Contractor Shall Maintain Personal Liability And Property Damage Insurance Prescribed By The Laws Of The State Of Maryland The Contractor Shall Not Operate Trucks Tractors And Other Heavy Equipment On Any Turf Or Interment Area Except When Authorized In Writing By The Cor S Due To The Sensitive Mission Of The Cemetery The Work Often Requires Contact With And Exposure To Grieving Individuals Contractor Personnel Must Exercise And Exhibit Absolute Decorum Composure And Stability At All Times Adequate Warning Devices Barricades Guards Flagmen Or Other Necessary Precautions Shall Be Provided By The Contractor For The Protection Safety And Warnings All Pedestrians And Vehicular Traffic Within The Area Supervision Amp Training The Contractor Is Responsible For Maintaining Satisfactory Standards Of Personnel Conduct And Work Performance And Shall Administer Disciplinary Action As Required The Contractor Shall Remove Employees For Cause To Include But Not Limited To Misconduct In Performance Of Duty Under These Specifications And Or Conduct Contrary To The Best Interests Of The Government
