Call-Off Regulations (1) If Several Framework Agreements Have Been Concluded For A Medium, The Call-Offs Of Individual Orders Are Carried Out In Accordance With The Following Objective And Non-Discriminatory Rules. (2) Calls Are Generally Made In The Order Of The Award Result Of The Underlying Framework Contract Tender. The Client First Directs The Request To The Contractor Whose Offer Was Considered The Most Economical Offer In The Award Evaluation. If This Contractor Is Unable To Carry Out The Specific Individual Order Within The Execution Deadline Set By The Client, The Request Will Be Directed To The Next-Placed Framework Contract Partner. (3) A Contractor Is Deemed Not To Be Able To Execute An Individual Order If, At The Time Of The Planned Start Of Execution, Two Individual Orders From The Clients Framework Contracts Have Already Been Assigned To Him, The Contractually Agreed Execution Periods Of Which Overlap With The Intended Execution Period Of The New Individual Order On A Calendar Day. (4) An Overlap Occurs If The Contractually Agreed Execution Periods Of Individual Orders Overlap By At Least One Calendar Day. Only The Construction Times Specified In The Respective Individual Order Are Decisive. (5) Before Placing An Individual Order, The Client Is Entitled To Obtain Binding Confirmation From The Contractor In Question That The Contractually Agreed Execution Deadlines Can Be Met. If The Contractor Does Not Provide A Corresponding Confirmation Within The Reasonable Period Set By The Client Or If He Declares That He Cannot Provide The Service Within The Intended Execution Period, This Is Deemed To Be A Lack Of Ability To Perform Within The Meaning Of Paragraph 2. (6) The Provisions Of This Paragraph Apply Equally To All Framework Contract Partners. Discretionary Decisions By The Client When Selecting The Contractor For A Call Are Excluded.
