1. The Subject Of The Order Includes The Performance Of Construction Works Including The Reconstruction Of Roads In The Gomunice Commune - Ul. Partyzatów And Ul. Bema In Chrzanowice.2. The Subject Of The Order Referred To In Point 1 Will Include In Particular: 1.Execution Of Construction Works In Accordance With The Technical Documentation Constituting Annex No. 10 To Swz.2.Preparation Of As-Built Documentation (2 Copies Of The Paper Version And 1 Copy Of The Electronic Version). The Bills Of Quantities Attached To The Swz Are Of An Auxiliary Nature. Due To The Fact That The Contractors Remuneration Indicated In The Offer Will Be A Lump Sum, When Pricing The Offer, The Contractor Should Rely On The Scope Indicated In The Technical Documentation Constituting An Annex To The Swz. The Occurrence, During The Execution Of The Contract, Of Works Not Included In The Bill Of Quantities Or Of Works In A Larger Quantity Compared To The Quantity Accepted In The Bill Of Quantities Will Not Entitle The Contractor To Demand Additional Remuneration - If These Works Were Included In The Technical Documentation. Note: If References To Standards, European Technical Assessments, Approvals, Technical Specifications And Technical Reference Systems Are Used In The Swz Or Annexes, The Ordering Party Allows Solutions Equivalent To Those Described. When Analyzing The Design Documentation, The Contractor Should Assume That Each Reference Used In The Design Documentation Is Accompanied By The Word Or Equivalent. If Trademarks Are Used In The Swz Or Annexes, It Means That They Are Provided As Examples And Specify Only The Minimum Expected Quality Parameters And The Required Standard. The Contractor May Use Equivalent Materials Or Devices, But With Similar Or Better Technical And Quality Parameters, The Use Of Which Will In No Way Adversely Affect The Proper Functioning Of The Solutions Adopted In The Design Documentation. The Contractor Who Uses Equivalent Devices Or Materials Will Be Obliged To Demonstrate During The Execution Of The Order That The Devices And Materials He Uses Meet The Requirements Specified By The Ordering Party. The Use Of Labels In The Swz Or Annexes Means That The Ordering Party Accepts All Labels Confirming That Given Construction Works, Supplies Or Services Meet The Equivalent Requirements Of The Label Specified By The Ordering Party. If The Economic Operator, For Reasons Beyond Its Control, Cannot Obtain The Label Or Equivalent Label Specified By The Contracting Authority, The Contracting Authority Shall, Within The Deadline Set By Itself, Accept Other Appropriate Means Of Evidence, In Particular The Manufacturers Technical Documentation, Provided That The Economic Operator Proves That The Construction Works, Supplies Or Services To Be Performed By It Meet The Requirements Of A Specific Label Or Specific Requirements Indicated By The Contracting Authority.
