The Order Includes Making Periodic Deliveries Against Requests Of The Contracting Authority Or Persons Authorized By It Of Construction Materials, Consumables And Spare Parts For The Construction For The Needs Of The Property Management And Social Activities Directorate Of The Ministry Of The Interior, According To The Technical Specification And All Requirements Of The Contracting Authority. 1. The Contracting Authority Has The Right To Declare Types And Quantities Of Goods, According To Its Needs (Less Or More Than Those Declared In Section V Of The Technical Specification) Within The Total Estimated Value And Is Not Obliged To Declare All Types And Quantities Of Goods Specified In Section V Of The Technical Specification. 2. The Contracting Authority Reserves The Right To Request Materials And Goods For The Construction According To Its Needs, Beyond Those Included In Section V Of The Technical Specification. The Request Is Submitted To The Contractor, Who Within Two Working Days Should Send An Offer To The Specified E-Mail Address Of The Contracting Authority. The Materials And Goods Are Ordered After Acceptance Of The Offer By The Contracting Authority. 2.1. The Unit Prices Of Materials And Goods May Not Exceed Those Specified In The Electronic Edition Or The Printed Version Of The Construction Price Guide Of Stroyekspert - Sec Eood, Valid At The Time Of Their Purchase. Delivery Is Made Within Five Working Days, Starting From The Date Of Written Confirmation Of The Contractors Offer By The Employer. 2.2. In The Event That The Materials And Goods Are Not Available In The Sec, The Contracting Authority Performs A Market Analysis Of The Price Of The Relevant Material Or Goods From Among At Least Three Different Construction Exchanges, As A Result Of Which An Average Market Price Is Determined At The Time Of The Request. The Delivery Is Made After The Signing Of An Additional Agreement In Accordance With Article 116, Paragraph 1, Item 1 Of The Public Procurement Act Between The Employer And The Contractor. The Request For The Goods And Materials Together With The Results Of The Survey Are Sent To The Contractor, And The Delivery Takes Place Within Five Working Days, Counting From The Date Of Confirmation Of The Received Request By The Contractor. 3. When The Procedure Was Opened, Funding Was Not Secured, Which Is Why A Clause For Deferred Implementation Is Provided For In The Draft Contract. In This Case, Each Of The Parties May Request The Termination Of The Contract Without Notice After The Expiry Of A Three-Month Period From Its Conclusion, According To Art. 114 Of The Civil Code. When, After The Expiration Of 10 Months From The Conclusion Of The Contract, Financing Is Not Provided, The Contract Is Considered Terminated.
