The Subject Of The Order Is The Supply Of Capacity Nvme Drives For The Expansion Of The Ordering Partys Vsan Cluster (Basic Order) And The Option Right To Include The Supply Of Cache Drives For Preventive Replacement And Technical Assistance In Expanding The Vsan Environment. The Ordering Party Performs The Physical Installation Of Disks In Servers On Its Own. 2. A Detailed Description Of The Subject Of The Order Is Included In Annex No. 1 To The Swz. 3. Order Completion Date: 28 Business Days From The Date Of Conclusion Of The Agreement, Whereas: 1) Basic Order: 14 Business Days From The Date Of Conclusion Of The Agreement. 2) Orders Under The Option Right: 14 Business Days From Submitting The Declaration Of Intention To Exercise The Option Right. The Option Right Will Be Exercised In Accordance With The Needs Of The Ordering Party, No Later Than 14 Business Days From The Date Of Conclusion Of The Agreement. 4. Pursuant To Art. 5K Of Council Regulation (Eu) No. 833/2014 Of 31 July 2014 Concerning Restrictive Measures In Connection With Russias Actions Destabilizing The Situation In Ukraine (Oj Eu No. L 229 Of 31/07/2014, P. 1), As Amended By Regulations 2022/57 And 2025/2033, Hereinafter Referred To As The Regulation 833/2014, It Is Prohibited To Award Or Continue To Perform A Public Contract For Or With The Participation Of: A) Russian Citizens, Natural Persons Residing In Russia Or Legal Persons, Entities Or Bodies Based In Russia; (B) Legal Persons, Entities Or Bodies Whose Ownership Rights, Directly Or Indirectly, Belong To More Than 50% Of The Natural Or Legal Person, Entity Or Body Referred To In Point (A). (A) Or (C) Natural Or Legal Persons, Entities Or Bodies Acting On Behalf Of Or Under The Direction Of A Natural Or Legal Person, Entity Or Body Referred To In Point (A). (A) Or (B), Including Subcontractors, Suppliers Or Entities Whose Capacity Is Relied Upon Within The Meaning Of Directive 2014/24/Eu, Where They Account For More Than 10 % Of The Value Of The Contract. 5. Pursuant To Art. 257 Of The Public Procurement Act, The Ordering Party Provides For The Possibility Of Invalidating The Procedure In Question If The Public Funds That The Ordering Party Intended To Use To Finance All Or Part Of The Order Were Not Granted To It. 6. The Analysis Of The Subject Of The Contract Shows That Art. 100 Of The Public Procurement Law Does Not Apply. 7. The Ordering Party Does Not Provide For Any Requirements Regarding The Employment Of Persons Referred To In Art. 95 Of The Public Procurement Law. 8. Pursuant To Art. 441 Of The Public Procurement Law, The Ordering Party Reserves The Right To Exercise The Right Of Option Beyond The Basic Scope Of The Subject Of The Order, Specified In The Sopz, Consisting In The Delivery Of Cache Drives For Preventive Replacement And/Or Technical Assistance In The Expansion Of The Vsan Environment. 9. The Ordering Party Is Entitled To Exercise The Option Right Successively, Depending On Its Needs, Within The Limit Specified In The Sopz.
